No. 4808 of 2008\n<\/p>\n<p>            &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n         Dated this the 19th day of January, 2009<\/p>\n<p>                               ORDER<\/p>\n<p>      The petitioner faces allegations as the 2nd accused in<\/p>\n<p>Crime No.115\/08 of the Kottarakkara Excise Range.               The 4th<\/p>\n<p>respondent herein is the 1st accused in that crime.              Some<\/p>\n<p>contraband articles were allegedly seized from the possession<\/p>\n<p>of the 4th respondent.      The 4th respondent allegedly made a<\/p>\n<p>statement before the detecting official that she was carrying<\/p>\n<p>them on behalf of the petitioner herein.            It is thus that the<\/p>\n<p>petitioner was shown as accused in the occurrence report.<\/p>\n<p>Investigation is in progress.\n<\/p>\n<p>      2. According to the petitioner, he is absolutely innocent.<\/p>\n<p>The local Excise Inspector and the 4th respondent have some<\/p>\n<p>animosity against the petitioner. The Excise Inspector and the<\/p>\n<p>4th respondent in collusion have most unnecessarily raised an<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No. 4808 of 2008 -: 2 :-<\/span><\/p>\n<p>allegation that the 4th respondent was carrying the contraband<\/p>\n<p>articles on behalf of the petitioner herein.     The petitioner is<\/p>\n<p>aggrieved by the conduct of the 4th respondent and the Excise<\/p>\n<p>Inspector who has registered the crime. The petitioner, in these<\/p>\n<p>circumstances, came to this Court with a prayer that the<\/p>\n<p>investigation may be entrusted to the 3rd respondent.<\/p>\n<p>      3. Notice was given to respondents 1 to 3.      The learned<\/p>\n<p>Public Prosecutor was requested to take instructions as to why<\/p>\n<p>the investigation in the given circumstances should not be<\/p>\n<p>directed to be conducted by a superior official of the police. The<\/p>\n<p>learned Public Prosecutor, after taking instructions, submits that<\/p>\n<p>necessary directions have already been issued to ensure that the<\/p>\n<p>detecting officer does not continue with the investigation and<\/p>\n<p>that the investigation shall be conducted by the Circle Inspector<\/p>\n<p>of Excise, Excise Enforcement and Anti Narcotic Special Squad,<\/p>\n<p>Kollam.    The petitioner need not have any apprehension now.<\/p>\n<p>The detecting officer will have no role in the investigation<\/p>\n<p>hereafter.   In these circumstances, this petition may now be<\/p>\n<p>dismissed, submits the learned Public Prosecutor.<\/p>\n<p>      4. The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is not satisfied with the said arrangement.  Directions<\/p>\n<p>may be issued to the 3rd respondent to personally conduct the<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No. 4808 of 2008 -: 3 :-<\/span><\/p>\n<p>investigation. If that is not done the investigation by the Circle<\/p>\n<p>Inspector of Excise will not alleviate the grievance of the<\/p>\n<p>petitioner. Appropriate directions may, in these circumstances,<\/p>\n<p>be issued, it is submitted.\n<\/p>\n<p>      5.  I have considered all the relevant inputs.    The State<\/p>\n<p>has now ensured that the detecting officer against whom<\/p>\n<p>allegations of mala fides are raised does not continue with the<\/p>\n<p>investigation and the investigation is entrusted with his superior<\/p>\n<p>&#8211; the Circle Inspector of Excise.   I am not persuaded to agree<\/p>\n<p>that the present arrangement for investigation is not fair or just<\/p>\n<p>and should not be accepted.\n<\/p>\n<p>      6. I am satisfied that to ensure purity of investigation, the<\/p>\n<p>3rd respondent can be      directed to personally supervise the<\/p>\n<p>investigation conducted by the Circle Inspector of Excise. Final<\/p>\n<p>report shall not be filed without specific approval of the 3rd<\/p>\n<p>respondent.\n<\/p>\n<p>      7. In the result:\n<\/p>\n<p>      (a) This Crl.M.C. is allowed.\n<\/p>\n<p>      (b) Accepting the submission of the learned Public<\/p>\n<p>Prosecutor that the investigation shall be conducted hereafter<\/p>\n<p>not by the Excise Inspector who detected the crime; but his<\/p>\n<p>superior &#8211; Circle Inspector of Excise, Excise Enforcement and<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No. 4808 of 2008 -: 4 :-<\/span><\/p>\n<p>Anti Narcotic Special Squad, Kollam, it is specifically directed<\/p>\n<p>that the 3rd respondent must hereafter personally monitor the<\/p>\n<p>investigation and the final report must be filed only after the<\/p>\n<p>specific approval of the 3rd respondent is received.<\/p>\n<p>                                                   Sd\/-\n<\/p>\n<p>\n                                        (R.
