Civil Application No. 168 of 2009 in Spl. Summary Suit No. 202<br \/>\nof 2001.\n<\/p>\n<p>2.\tIt<br \/>\nis the case of the petitioner that by Ex. 71 the respondent Bank<br \/>\nfiled an application to defend on behalf of the original defendant<br \/>\nHDFC Bank.  The trial court allowed the said application and also<br \/>\nheld therein that the bank is entitled to defend the suit<br \/>\nunconditionally.  Thereafter, Civil Revision Application was filed<br \/>\nbefore this court which later on came to be withdrawn.  The<br \/>\npetitioner then filed application for review\/recall of the order<br \/>\npassed by the trial court in order below Ex. 71 which is impugned in<br \/>\nthe present petition.  The Civil Court rejected the review\/recall<br \/>\napplication and hence the present petition is preferred.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Dagli, learned advocate appearing for the petitioner has submitted<br \/>\nthat the court below has committed a serious error of law inasmuch as<br \/>\nit is settled proposition of law that once any order which was<br \/>\nobtained from the court by suppressing material facts the court below<br \/>\nought not to have rejected the application on flimsy and technical<br \/>\ngrounds.\n<\/p>\n<p>4.\tThis<br \/>\ncourt has heard the learned advocates for the parties and perused the<br \/>\npapers on record.  The court below has considered that the<br \/>\napplication for review\/recall falls under the purview of the<br \/>\nprovisions of Order 47, Rule 4(2)(b) because no application shall be<br \/>\ngranted on the ground of discovery of new matter or evidence which<br \/>\nthe applicant alleges was not within his knowledge or could not be<br \/>\nadduced by him when the decree or order was passed or made.  The<br \/>\ncourt below has also observed that so many triable issues are<br \/>\ninvolved in the matter which cannot be decided or determined without<br \/>\nrecording evidence from both the sides.  This court is in complete<br \/>\nagreement with the reasonings adopted by the court below.\n<\/p>\n<p>4.1\tHowever,<br \/>\nin the interest of justice, since the view taken by the court below<br \/>\nis tentative, it shall be appropriate if while considering the<br \/>\nappeal, which is subject matter before the lower court, the<br \/>\npetitioner raises all the contentions before the trial court.  The<br \/>\norder impugned in the present petition is just and proper and does<br \/>\nnot call for any interference by this court.\n<\/p>\n<p>5.\tIn<br \/>\nthe above view of the matter, petition is dismissed.  It shall be<br \/>\nopen to the petitioner to argue all points at the time of hearing of<br \/>\nappeal by the lower court and to cross examine the witnesses to prove<br \/>\nhis case at the time of trial.
