NO. 35634 OF 2008 P\n                 --------------------------------------\n               Dated this the 11th December, 2008\n\n                           JUDGMENT\n<\/pre>\n<p>     Case of the petitioner, in brief, is as follows:<\/p>\n<p>     Petitioner had availed a housing loan in 1999 from the first<\/p>\n<p>respondent. Proceedings were taken against him for recovery of<\/p>\n<p>the same which, according to him, is barred by limitation. He<\/p>\n<p>approached this Court and by Ext.P6 Judgment this Court<\/p>\n<p>proceeded to hold as follows:\n<\/p>\n<blockquote><p>            &#8220;This Court will not be in a position to decide<\/p>\n<p>      as to whether the present claim is barred by<\/p>\n<p>      limitation. That will depend on the terms of the<\/p>\n<p>      agreement entered into between the petitioner and<\/p>\n<p>      the first respondent. Further, in a case where a<\/p>\n<p>      loan is secured by mortgage, the question of<\/p>\n<p>      limitation under the Limitation Act has also to be<\/p>\n<p>      considered. If the petitioner files any objection in<\/p>\n<p>      that regard before the first respondent within two<\/p>\n<p>      weeks from today, the same will be duly considered<\/p>\n<p>      with reference to the agreement executed between<\/p>\n<p>      the petitioner and the first respondent.           If the<\/p>\n<p><span class=\"hidden_text\">WPC.35634\/08 P                   2<\/span><\/p>\n<p>       petitioner files any objection within two weeks from<\/p>\n<p>       today before the second respondent, the same will<\/p>\n<p>       be considered by the said respondent with notice to<\/p>\n<p>       the petitioner and the first respondent and with<\/p>\n<p>       reference to the agreement entered into between the<\/p>\n<p>       parties after hearing them also.           All further<\/p>\n<p>       proceedings pursuant to Exts.P4 and P5 revenue<\/p>\n<p>       recovery notices will be deferred on condition the<\/p>\n<p>       petitioner remits a sum of Rs.50,000\/= (Rupees<\/p>\n<p>       Fifty thousand only) within one month from today.&#8221;<\/p><\/blockquote>\n<p>      2. Petitioner filed Ext.P7 before the first respondent. That<\/p>\n<p>came to be disposed of by Ext.P9. Therein, it is stated that the<\/p>\n<p>objection was not filed within the time stipulated and therefore,<\/p>\n<p>rejected the petition.\n<\/p>\n<p>      3. I heard the learned counsel for the petitioner and the<\/p>\n<p>learned standing counsel appearing for the first respondent. The<\/p>\n<p>Secretary, Kerala State Housing Board, Thiruvananthapuram is<\/p>\n<p>suo motu impleaded as the additional fourth respondent and the<\/p>\n<p>learned standing counsel appears for him. Learned standing<\/p>\n<p>counsel would submit that it would be more appropriate if the<\/p>\n<p><span class=\"hidden_text\">WPC.35634\/08 P                   3<\/span><\/p>\n<p>additional fourth respondent looks into the question of<\/p>\n<p>limitation. He fairly submits that Ext.P9 would only reveal that<\/p>\n<p>a decision was not taken on account of the technical reason of<\/p>\n<p>the objection being filed belatedly. In such circumstances, the<\/p>\n<p>Writ Petition is disposed of as follows:<\/p>\n<p>      Petitioner is permitted to file his objections before the<\/p>\n<p>additional fourth respondent within two weeks from the date of<\/p>\n<p>receipt of a copy of this Judgment. In order that there may be an<\/p>\n<p>expeditious disposal of the matter, the petitioner or his<\/p>\n<p>representative shall be present before the additional fourth<\/p>\n<p>respondent at 11 A.M. on 3.1.2009 and the fourth respondent<\/p>\n<p>will proceed to consider the objections, after hearing the<\/p>\n<p>petitioner or his representative, and take a decision in<\/p>\n<p>accordance with law.\n<\/p>\n<p>                                              Sd\/=<br \/>\n                                      K.
