Subramanian\n\n\n:JUDGMENT\n<\/pre>\n<p>\t(Judgment of the Court was delivered by P.K.MISRA,J)<\/p>\n<p>\tHeard the learned counsels appearing for the parties.\n<\/p>\n<p>\t2. This writ appeal is directed against the order dated 21.7.2007 in<br \/>\nW.P.No.3519 of 2004, whereunder the learned single Judge allowed the writ<br \/>\npetition filed by the present Respondent No.1 and quashed the order of the<br \/>\nChancellor of Manonmaniam Sundaranar University.\n<\/p>\n<p>\t3. The writ petitioner (present Respondent No.1) is a teacher and also a<br \/>\nregistered graduate of Manonmaniam Sundaranar University, which has been<br \/>\nconstituted under the Manonmaniam Sundaranar University Act, 1990, hereinafter<br \/>\nreferred to as &#8220;the Act&#8221;.  The University consists of Senate, Syndicate and a<br \/>\nStanding Committee on Academic Affairs.  Sections 19 and 23 of the Act relate to<br \/>\nconstitution of the Senate and the Syndicate respectively.  The main question<br \/>\nraised is relating to election to the Syndicate from Senate.\n<\/p>\n<p>\t\t4. The provisions contained in Sections 19 and 23 of the Act, to the<br \/>\nextent relevant for the present case, are extracted hereunder:-<br \/>\n\t&#8221; CHAPTER III<br \/>\n\tTHE SENATE AND THE STANDING COMMITTEE ON ACADEMIC AFFAIRS.<br \/>\n\tPOWERS AND DUTIES.\n<\/p>\n<p>\t19. (a) The Senate shall consist of the following members, namely:-<br \/>\n\t(1) to (13) . . .  (omitted as not necessary)<br \/>\n\tClass II &#8211; Other Members.\n<\/p>\n<p>\t(1) One Member elected by teachers of each affiliated college;<br \/>\n\t(2) and (3) . . . (omitted as not necessary)<br \/>\n\t(4) Two members elected by registered graduates in each revenue district<br \/>\nwithin the University area from among themselves;<br \/>\n\t(5) to (7) . . . (omitted as not necessary).&#8221;\n<\/p>\n<p>\t&#8220;CHAPTER IV.\n<\/p>\n<p>\tTHE SYNDICATE.\n<\/p>\n<p>\t23.(a) &#8230; (omitted as not necessary)\n<\/p>\n<p>\t   (b) The Syndicate shall, in addition to the Vice- Chancellor, consist<br \/>\nof the following members, namely :-\n<\/p>\n<p>\tClass I &#8211; Ex-officio Members<br \/>\n\t(1) to (7) &#8230;  (omitted as not necessary)<br \/>\n\tClass II &#8211; Other Members.\n<\/p>\n<p>\t(1) . . . (omitted as not necessary)<br \/>\n\t(2) Two members elected by teachers of affiliated colleges, other than<br \/>\nprincipals, from among themselves who are members of the Senate, in accordance<br \/>\nwith the system of proportional representation by means of the single<br \/>\ntransferable vote.\n<\/p>\n<p>\tExplanation &#8211; For the purpose of this item &#8220;teachers&#8221; shall mean those<br \/>\nteachers elected to the Senate by the teachers of the affiliated colleges from<br \/>\namong themselves;\n<\/p>\n<p>\t(3) . . . (omitted as not necessary)<br \/>\n\t(4) One member, not falling under any of the above three categories,<br \/>\nelected by the Senate from among its members;<br \/>\n\t(5) to (7) . . . (omitted as not necessary)&#8221;\n<\/p>\n<p>\t5. Learned single Judge on interpreting the provisions contained in<br \/>\nsections 19 and 23 has concluded that a teacher who is elected to the Senate not<br \/>\nin his capacity as a teacher but in his capacity as a registered graduate would<br \/>\nbe eligible for contesting to the office of the Member of the Syndicate as per<br \/>\nSection 23(4) of the Act.  On that basis, the learned single Judge has observed<br \/>\nthat the writ petitioner was eligible to contest for the membership of the<br \/>\nSyndicate as a registered graduate notwithstanding the fact that he was also a<br \/>\nteacher. Such conclusion is being challenged by the fourth respondent in the<br \/>\nwrit appeal.\n<\/p>\n<p>\t6. The main contention raised by the learned counsel for the appellant is<br \/>\nto the effect that since one member can be elected by the teachers of each<br \/>\naffiliated college and since two members can be elected to the Senate by<br \/>\nregistered graduates from among themselves as contemplated in Section 19(1) and<br \/>\n(4) and since under Section 23(2) two members can be elected to the Syndicate by<br \/>\nteachers, who are members of the Senate, any teacher should be excluded from the<br \/>\narena of consideration coming within Section 23(4) of the Act.\n<\/p>\n<p>\t7. Section 23(4) of the Act lays down that one member falling under any of<br \/>\nthe above three categories can be elected by the Senate from among its members.<br \/>\nCategory(2) relates to two members elected by teachers of affiliated colleges<br \/>\nfrom among themselves who are the members of the Senate.  Explanation to such<br \/>\nprovision makes it clear that the expression &#8220;teachers&#8221; means those teachers<br \/>\nelected to the Senate by the teachers of the affiliated colleges from among<br \/>\nthemselves.  In other words, the person who is elected as a registered graduate,<br \/>\nnotwithstanding the fact that he is also a teacher, does not come within<br \/>\ncategory (2) and obviously such a person cannot seek for election from category<br \/>\n(2) which specifically envisages that a teacher who is elected to the Senate as<br \/>\nsuch in his capacity as a teacher can be eligible under category (2).\n<\/p>\n<p>\t8. Learned single Judge has adopted the above interpretation.  Such<br \/>\ninterpretation given by the learned single Judge is clearly in accordance with<br \/>\nthe provisions contained in Section 23 of the Act and more particularly the<br \/>\nexplanation to category (2).  Learned single Judge has rightly observed that<br \/>\nSection 19 of the Act does not exclude a teacher from becoming a Senate member<br \/>\nfrom the constituency of registered graduate notwithstanding the fact that he is<br \/>\nalso a teacher.\n<\/p>\n<p>\t9. In view of the above conclusion, we do not find any scope to interfere<br \/>\nwith the decision of the learned single Judge.  The writ appeal is accordingly<br \/>\ndismissed.  No costs.
