        notings \u00a0 right \u00a0 from \u00a0 13.1.2000 \u00a0 on \u00a0 the \u00a0 file \u00a0 dealing \u00a0 with \u00a0 disciplinary \u00a0 proceedings \u00a0 against \u00a0 the\u00a0<\/p>\n
        Applicant.\u00a0The\u00a0Applicant\u00a0also\u00a0sought\u00a0file\u00a0notings\u00a0for\u00a0the\u00a0period\u00a0between\u00a004.10.96\u00a0to\u00a016.12.96\u00a0of\u00a0<\/p>\n
        MOSR\u00a0and\u00a0various\u00a0other\u00a0officers\u00a0of\u00a0the\u00a0Railway\u00a0Board\u00a0in\u00a0the\u00a0allegedly\u00a0false\u00a0complaint\u00a0of\u00a0sexual\u00a0<\/p>\n
        harassment.\u00a0The\u00a0PIO\u00a0responded\u00a0on\u00a006.07.2010\u00a0furnishing\u00a0the\u00a0information\u00a0from\u00a0the\u00a0Directorate\u00a0<\/p>\n
        (s)\u00a0concerned.\u00a0The\u00a0information\u00a0was\u00a0denied\u00a0to\u00a0the\u00a0Applicant\u00a0seeking\u00a0exemption\u00a0under\u00a0Section\u00a08\u00a0<\/p>\n
        (1)\u00a0(b)\u00a0stating\u00a0that\u00a0the\u00a0same\u00a0issue\u00a0was\u00a0sub\u00a0judice\u00a0before\u00a0the\u00a0Hon’ble\u00a0Supreme\u00a0Court\u00a0of\u00a0India.\u00a0<\/p>\n
        Furthermore,\u00a0the\u00a0Public\u00a0Authority\u00a0cited\u00a0that\u00a0the\u00a0information\u00a0was\u00a0barred\u00a0from\u00a0disclosure\u00a0under\u00a0<\/p>\n
        Section\u00a08\u00a0(1)\u00a0(e),\u00a0(i)\u00a0and\u00a0(j)\u00a0also.\u00a0\u00a0\u00a0\n<\/p>\n<\/p>\n
2.      Being\u00a0aggrieved\u00a0by\u00a0such\u00a0response\u00a0from\u00a0the\u00a0Public\u00a0Authority,\u00a0the\u00a0Applicant\u00a0filed\u00a0a\u00a0First\u00a0Appeal\u00a0<\/p>\n
        dated\u00a004\/06.08.2010\u00a0with\u00a0the\u00a0Appellate\u00a0Authority\u00a0viz.\u00a0the\u00a0Addl.\u00a0Member\u00a0(Staff)\u00a0Railway\u00a0Board\u00a0<\/p>\n
        challenging \u00a0 the \u00a0 PIO’s \u00a0 order \u00a0 alleging \u00a0 that \u00a0 the \u00a0 PIO \u00a0 had \u00a0 rejected \u00a0 the \u00a0 RTI \u00a0 application \u00a0 seeking\u00a0<\/p>\n
        exemption \u00a0 under \u00a0 incorrect \u00a0 applying \u00a0 improper \u00a0 provisions \u00a0 of \u00a0 the \u00a0 RTI \u00a0 Act \u00a0 2005. \u00a0 The \u00a0 Appellant\u00a0<\/p>\n
        herein \u00a0 rebutted \u00a0 each \u00a0 of \u00a0 the \u00a0 grounds \u00a0 of \u00a0 exemption \u00a0 sought \u00a0 by \u00a0 the \u00a0 Respondent \u00a0 with \u00a0 detailed\u00a0<\/p>\n
        reasons.\u00a0The\u00a0Appellate\u00a0Authority\u00a0responded\u00a0vide\u00a0letter\u00a0dated\u00a004.10.2010\u00a0enclosing\u00a0a\u00a0brief\u00a0note\u00a0<\/p>\n
        about\u00a0the\u00a0case.\u00a0The\u00a0Appellate\u00a0Authority\u00a0rejected\u00a0the\u00a0First\u00a0Appeal\u00a0upholding\u00a0and\u00a0justifying\u00a0the\u00a0<\/p>\n
        CPIO’s\u00a0order\u00a0dated\u00a006.07.2010.\u00a0\n<\/p>\n<\/p>\n
3.      Being\u00a0thus\u00a0denied\u00a0the\u00a0information,\u00a0the\u00a0Appellant\u00a0approached\u00a0the\u00a0Central\u00a0Information\u00a0Commission\u00a0<\/p>\n
        with\u00a0the\u00a0instant\u00a0Appeal\u00a0dated\u00a024.12.2010\u00a0challenging\u00a0the\u00a0acts\/omissions\u00a0of\u00a0the\u00a0Public\u00a0Authority\u00a0<\/p>\n
        contending\u00a0various\u00a0factual\u00a0and\u00a0legal\u00a0propositions\u00a0in\u00a0details.\u00a0In\u00a0the\u00a0instant\u00a0appeal,\u00a0the\u00a0Appellant\u00a0<\/p>\n
        agreed \u00a0 that \u00a0 his \u00a0 case \u00a0 is \u00a0 before \u00a0 the \u00a0 Hon’ble \u00a0 Supreme \u00a0 Court, \u00a0 the \u00a0 Respondent \u00a0 Ministry \u00a0 having\u00a0
\n       challenged \u00a0 the \u00a0 decision \u00a0 of \u00a0 the \u00a0 Delhi \u00a0 High \u00a0 Court \u00a0 which \u00a0 had \u00a0 been \u00a0 in \u00a0 favor \u00a0 of \u00a0 the \u00a0 Appellant.\u00a0<\/p>\n
      However,\u00a0it\u00a0is\u00a0also\u00a0a\u00a0matter\u00a0of\u00a0fact\u00a0that\u00a0there\u00a0was\u00a0no\u00a0specific\u00a0order\u00a0of\u00a0the\u00a0Apex\u00a0Court\u00a0either\u00a0<\/p>\n
      staying\u00a0the\u00a0impugned\u00a0decision\u00a0of\u00a0the\u00a0Hon’ble\u00a0Delhi\u00a0High\u00a0Court\u00a0nor\u00a0any\u00a0Supreme\u00a0Court\u00a0order\u00a0<\/p>\n
      directing\u00a0all\u00a0information\u00a0pertaining\u00a0to\u00a0the\u00a0instant\u00a0matter\u00a0to\u00a0be\u00a0kept\u00a0under\u00a0wraps\u00a0of\u00a0confidentiality.\u00a0<\/p>\n
      Apart \u00a0 from \u00a0 these \u00a0 contentions, \u00a0 the \u00a0 Appellant \u00a0 has \u00a0 reiterated \u00a0 the \u00a0 contentions \u00a0 from \u00a0 his \u00a0 previous\u00a0<\/p>\n
      submissions \u00a0 in \u00a0 the \u00a0 form \u00a0 of \u00a0 the \u00a0 RTI \u00a0 application \u00a0 and \u00a0 First \u00a0 Appeal. \u00a0 The \u00a0 Commission \u00a0 upon\u00a0<\/p>\n
      registering \u00a0 the \u00a0 case, \u00a0 issued \u00a0 notice \u00a0 dated \u00a0 08.04.2011 \u00a0 calling \u00a0 the \u00a0 parties \u00a0 to \u00a0 the \u00a0 hearing \u00a0 on\u00a0<\/p>\n
      18.05.2011.\u00a0\n<\/p>\n
\nDecision<\/p>\n
 4.        During\u00a0the\u00a0hearing,\u00a0the\u00a0Appellant\u00a0and\u00a0the\u00a0Respondents\u00a0reiterated\u00a0their\u00a0contentions\u00a0briefly\u00a0as\u00a0<\/p>\n
           already\u00a0submitted\u00a0in\u00a0the\u00a0Appeal\u00a0before\u00a0the\u00a0Commission.\u00a0The\u00a0Commission\u00a0                          notes \u00a0 that\u00a0<\/p>\n
           the\u00a0Respondent\u00a0has\u00a0sought\u00a0exemption\u00a0under\u00a0Section\u00a08\u00a0(1)\u00a0(b)\u00a0of\u00a0the\u00a0Act,\u00a0which\u00a0reads\u00a0thus:\u00a0<\/p>\n
           “….(b)\u00a0information\u00a0which\u00a0has\u00a0been\u00a0expressly\u00a0forbidden\u00a0to\u00a0be\u00a0published\u00a0by\u00a0any\u00a0court\u00a0of\u00a0law\u00a0or \u00a0<\/p>\n
           tribunal\u00a0or\u00a0the\u00a0disclosure\u00a0of\u00a0which\u00a0may\u00a0constitute\u00a0contempt\u00a0of\u00a0court;”<\/p>\n
           However, \u00a0 the \u00a0 Respondent \u00a0 has \u00a0 failed \u00a0 to \u00a0 refer\/rely \u00a0 on \u00a0 any \u00a0 Court\/ \u00a0 Tribunal \u00a0 direction\/order\u00a0<\/p>\n
           forbidding\u00a0the\u00a0publishing\/dissemination\u00a0of\u00a0information\u00a0pertaining\u00a0to\u00a0the\u00a0instant\u00a0case.\u00a0Hence\u00a0<\/p>\n
           providing\u00a0the\u00a0information\u00a0will\u00a0not\u00a0constitute\u00a0contempt\u00a0of\u00a0court\u00a0in\u00a0so\u00a0far\u00a0as\u00a0the\u00a0Section\u00a08\u00a0(1)\u00a0(b)\u00a0<\/p>\n
           of\u00a0the\u00a0RTI\u00a0Act\u00a02005\u00a0is\u00a0concerned,\u00a0in\u00a0this\u00a0case.\u00a0Since\u00a0there\u00a0is\u00a0no\u00a0specific\u00a0order\/direction\u00a0from\u00a0<\/p>\n
           the\u00a0Apex\u00a0Court\u00a0prohibiting\u00a0the\u00a0disclosure\u00a0of\u00a0information,\u00a0Contempt\u00a0of\u00a0Court\u00a0proceedings\u00a0are\u00a0<\/p>\n
           clearly\u00a0not\u00a0attracted.\u00a0Also,\u00a0since\u00a0the\u00a0final\u00a0order\u00a0passed\u00a0by\u00a0the\u00a0Delhi\u00a0High\u00a0Court\u00a0on\u00a004.12.2008\u00a0<\/p>\n
           has\u00a0 not \u00a0 been\u00a0 stayed \u00a0 so \u00a0 far\u00a0 by\u00a0 the \u00a0 Hon’ble \u00a0 Supreme \u00a0 Court, \u00a0 therefore, \u00a0 the \u00a0 said \u00a0 order \u00a0 has\u00a0<\/p>\n
           attained\u00a0finality.\u00a0\u00a0Likewise,\u00a0the\u00a0Respondents\u00a0have\u00a0failed\u00a0to\u00a0prove\u00a0the\u00a0applicability\u00a0of\u00a0Section\u00a08\u00a0<\/p>\n
           (1)\u00a0(e)\u00a0of\u00a0the\u00a0RTI\u00a0Act\u00a02005\u00a0in\u00a0this\u00a0case,\u00a0having\u00a0merely\u00a0reasoned\u00a0that\u00a0“….deliberations\u00a0made \u00a0<\/p>\n
           under \u00a0 complete \u00a0 confidence \u00a0 …are \u00a0 under \u00a0 fiduciary \u00a0 relationship..”\u00a0 The \u00a0 argument \u00a0 of \u00a0 the\u00a0<\/p>\n
           Respondent\u00a0lacks\u00a0reason\u00a0and\u00a0merit\u00a0about\u00a0applicability\u00a0of\u00a0the\u00a0Section\u00a08\u00a0(1)\u00a0(e)\u00a0of\u00a0the\u00a0RTI\u00a0Act\u00a0<\/p>\n
           2005\u00a0because\u00a0in\u00a0a\u00a0fiduciary\u00a0relation,\u00a0there\u00a0need\u00a0to\u00a0be\u00a0two\u00a0parties,\u00a0one\u00a0in\u00a0a\u00a0position\u00a0of\u00a0trust\u00a0<\/p>\n
           with\u00a0respect\u00a0to\u00a0the\u00a0other,\u00a0such\u00a0that\u00a0one\u00a0is\u00a0in\u00a0a\u00a0position\u00a0to\u00a0influence\u00a0the\u00a0other.\u00a0No\u00a0such\u00a0relation\u00a0<\/p>\n
           of \u00a0 holding \u00a0 information \u00a0 in \u00a0 fiduciary \u00a0 capacity \u00a0 could \u00a0 be \u00a0 established \u00a0 by \u00a0 the \u00a0 Respondents.\u00a0<\/p>\n
           Likewise,\u00a0seeking\u00a0exemption\u00a0from\u00a0disclosure\u00a0of\u00a0information\u00a0under\u00a0Section\u00a08\u00a0()\u00a0(i)\u00a0and\u00a0(j)\u00a0also\u00a0<\/p>\n
           defy\u00a0logic\u00a0and\u00a0reasoning.\u00a0The\u00a0exemptions\u00a0sought\u00a0by\u00a0the\u00a0Respondent\u00a0are\u00a0not\u00a0applicable\u00a0to\u00a0<\/p>\n
           prevent\u00a0disclosure\u00a0of\u00a0the\u00a0information\u00a0in\u00a0this\u00a0case.\u00a0The\u00a0Commission\u00a0has\u00a0also\u00a0gone\u00a0through\u00a0the\u00a0
\n              recent\u00a0decision\u00a0in\u00a0a\u00a0related\u00a0matter,\u00a0viz.\u00a0WP\u00a0(C)\u00a0No.\u00a01810\/2011\u00a0passed\u00a0by\u00a0the\u00a0Hon’ble\u00a0High\u00a0<\/p>\n
             Court\u00a0of\u00a0Delhi\u00a0on\u00a018.03.2011\u00a0in\u00a0the\u00a0case\u00a0of\u00a0Union\u00a0of\u00a0India\u00a0Through\u00a0Secretary,\u00a0Ministry\u00a0of\u00a0<\/p>\n
             Railways\u00a0versus\u00a0N\u00a0N\u00a0S\u00a0Rana,\u00a0wherein\u00a0it\u00a0has\u00a0been\u00a0held\u00a0that:\u00a0\n<\/p>\n
                      “…4.\u00a0In\u00a0the\u00a0context\u00a0of\u00a0the\u00a0proceedings\u00a0pending\u00a0by\u00a0way\u00a0of\u00a0the\u00a0contempt\u00a0petition \u00a0<\/p>\n
                      in\u00a0this\u00a0Court\u00a0or\u00a0the\u00a0Special\u00a0Leave\u00a0Petition\u00a0pending\u00a0in\u00a0the\u00a0Supreme\u00a0Court,\u00a0the \u00a0<\/p>\n
                      Respondents \u00a0 cannot \u00a0 possibly \u00a0 deny \u00a0 to \u00a0 the \u00a0 Respondent \u00a0 the \u00a0 DPC \u00a0 proceedings \u00a0<\/p>\n
                      concerning \u00a0 him. \u00a0 No \u00a0 prejudice \u00a0 would \u00a0 be \u00a0 caused \u00a0 to \u00a0 the \u00a0 Petitioner \u00a0 if \u00a0 the \u00a0 DPC \u00a0<\/p>\n
                      proceedings\u00a0concerning\u00a0the\u00a0Respondent\u00a0are\u00a0disclosed\u00a0to\u00a0him\u00a0subject\u00a0to\u00a0Section \u00a0<\/p>\n
