It is further submitted<\/p>\n<p>                   that on account of dowry and torture, petitioner has filed<\/p>\n<p>                   a complaint case for the alleged offence under Section<\/p>\n<p>                   498A of the Indian Penal Code and Section \u00be of the<\/p>\n<p>                   Dowry Prohibition Act which is pending in the court of<\/p>\n<p>                   S.D.J.M.,   Muzuffarpur,   East.   Besides    the    above,<\/p>\n<p>                   petitioner has also filed a        maintenance      case at<\/p>\n<p>                   Muzuffarpur and as such, in the above circumstances,<\/p>\n<p>                   the aforesaid   matrimonial suit   filed by the Opposite<\/p>\n<p>                   Party &#8211; husband deserves to be transferred to the court<\/p>\n<p>                   of Principal Judge, Family Court, Muzuffarpur.<\/p>\n<p>                           On the other hand, learned counsel for the<\/p>\n<p>                   Opposite Party upon filing the counter affidavit submits<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>          that the allegation of demand of dowry and torture       is<\/p>\n<p>          absolutely incorrect and the petitioner is a daughter of a<\/p>\n<p>          well of businessman. However, the assertion of the<\/p>\n<p>          petitioner that she has no independent source of income<\/p>\n<p>          and as such she is not in a position to attend the court at<\/p>\n<p>          Motihari is not disputed.\n<\/p>\n<p>                   Considering the submissions of the parties and<\/p>\n<p>          their respective pleadings, it would appear that the<\/p>\n<p>          grounds put forth by the petitioner for seeking transfer<\/p>\n<p>          of the petition is sufficient and as such, let the<\/p>\n<p>          Matrimonial Suit No. 102 of 2009        pending before the<\/p>\n<p>          court of Principal Judge, Family Court, East Champaran,<\/p>\n<p>          Motihari be transferred to the court of Principal Judge,<\/p>\n<p>          Family Court, Muzuffarpur and also the records of the<\/p>\n<p>          aforesaid matrimonial suit       be sent to the court of<\/p>\n<p>          Principal Judge, Family Court, Muzuffarpur immediately.<\/p>\n<p>          Both the petitioner and the Opposite Party are directed<\/p>\n<p>          to appear before the court of Principal Judge, Family<\/p>\n<p>          Court on 28th of September 2011, when a fresh date of<\/p>\n<p>          hearing would be fixed.\n<\/p>\n<p>                   Accordingly, the M.J.C. application stands<\/p>\n<p>          disposed of.\n<\/p>\n<pre>Jagdish                          ( Shailesh Kumar Sinha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
