{"id":67397,"date":"2010-05-17T00:00:00","date_gmt":"2010-05-16T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/viredra-kumar-purohit-vs-the-state-of-madhya-pradesh-on-17-may-2010"},"modified":"2014-03-15T16:59:07","modified_gmt":"2014-03-15T11:29:07","slug":"viredra-kumar-purohit-vs-the-state-of-madhya-pradesh-on-17-may-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/viredra-kumar-purohit-vs-the-state-of-madhya-pradesh-on-17-may-2010","title":{"rendered":"Viredra Kumar Purohit vs The State Of Madhya Pradesh on 17 May, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Viredra Kumar Purohit vs The State Of Madhya Pradesh on 17 May, 2010<\/div>\n<pre>                        W.P.No.5928\/2010(s)\n17.5.2010\n      Shri Rajesh Dubey, learned counsel for the petitioner.\n\n      Shri Rajesh Tiwari, learned Govt.Adv. for the respondents.<\/pre>\n<p>      Petitioner who was appointed initially as Section Writer in<br \/>\nthe copying section has filed this petition claiming regularization<br \/>\nin service on the ground that in the cases of other similarly<br \/>\nsituated    employees the State Administrative Tribunal had<br \/>\ndirected to consider the cases of Section Writer for appointment<br \/>\nto the post of L.D.C. in the regular set up against first available<br \/>\nvacant post.\n<\/p>\n<p>      It is the case of the petitioner that the decision rendered by<br \/>\nthe Tribunal in O.A.No.389\/1993 (Ram Bahadur Sharma Vs.<br \/>\nState of Madhya Pradesh and others) decided on 13-05-1999<br \/>\nhas been implemented in the cases of some             employees and<br \/>\ntherefore petitioner is also entitled to similar benefits.\n<\/p>\n<p>      From the record, it is seen that after the order was passed<br \/>\nby the Tribunal on 13-05-1999 in the case of           Ram Bahadur<br \/>\nSharma (supra) a review application filed by the State<br \/>\nGovernment was rejected and          thereafter    writ petition being<br \/>\nW.P.No.1284\/2002 (State of Madhya Pradesh and others Vs.<br \/>\nRam Bahadur Sharma and others) was filed, which was<br \/>\ndismissed by the Division Bench of this court on 31-01-2008. In<br \/>\nview of this, matter has allowed finally and respondents have<br \/>\ngranted benefit of the said order to the employees.\n<\/p>\n<p>      It is seen that the case of Ram Bahadur Sharma was<br \/>\ndecided on the basis of another order dated 2-12-1994 passed by<br \/>\n              the Tribunal in the case of Sainey Prasad Soni Vs. State of<br \/>\n             M.P. and others, passed in O.A.No.3743\/1993.\n<\/p>\n<p>                   In   view     of the fact that the petitioner is also   similarly<br \/>\n             situated, there is no reason why the petitioner should be dealt in a<br \/>\n             different manner.\n<\/p>\n<p>                   Accordingly, this petition is also disposed of with direction to<br \/>\n             give appointment on the regular basis in the post of L.D.C. as per<br \/>\n             directive issued by the Tribunal in the case of Ram Bahadur<br \/>\n             Sharma (supra) to the petitioner also.\n<\/p>\n<p>                   For the present, petition is allowed and disposed of with the<br \/>\n             aforesaid directions.\n<\/p>\n<p>                   C.C. as per rules.\n<\/p>\n<p>                                                     (Rajendra Menon)<br \/>\n                                                           JUDGE<br \/>\nMrs.mishra\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Viredra Kumar Purohit vs The State Of Madhya Pradesh on 17 May, 2010 W.P.No.5928\/2010(s) 17.5.2010 Shri Rajesh Dubey, learned counsel for the petitioner.
