Justice ANTONY DOMINIC\n\n Dated :22\/08\/2008\n\n O R D E R\n                       ANTONY DOMINIC, J.\n\n            --------------------------------------------------------\n\n                      W.P.(C) 25307 of 2008\n\n            --------------------------------------------------------\n\n                    Dated: AUGUST 22, 2008\n\n                               JUDGMENT\n<\/pre>\n<p>     Faced     with      Exts.P1       and       P2     revenue      recovery<\/p>\n<p>proceedings initiated against the petitioner for the amount<\/p>\n<p>that was due to the 1st respondent, this writ petition is filed.<\/p>\n<p>Though several contentions are raised, what is now pressed<\/p>\n<p>before me is an instalment facility to discharge the liability.<\/p>\n<p>     2.   I heard the learned counsel appearing for the<\/p>\n<p>respondents, who points out that in view of the fact that<\/p>\n<p>substantial amounts are due, indulgence should not be<\/p>\n<p>shown to the petitioner.\n<\/p>\n<p>     3. However, having regard to the limited nature of the<\/p>\n<p>relief that is sought for in this writ petitioner, I feel that<\/p>\n<p>instalment facility can be granted so that the petitioner can<\/p>\n<p>discharge the debt and avert coercive action and at the<\/p>\n<p>same time, the respondent can also realise its dues.                      On<\/p>\n<p>that basis I dispose of this writ petition with the following<\/p>\n<p>WP(C) 25307\/08<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>directions:-\n<\/p>\n<blockquote><p>       i. That within three weeks from today, petitioner<\/p>\n<p>           shall remit an amount of Rs.1 lakh with the 2nd<\/p>\n<p>           respondent.\n<\/p><\/blockquote>\n<blockquote><p>\n       ii. Subject to such payment, further proceedings<\/p>\n<p>           pursuant to Exts.P1 and P2 will be kept in<\/p>\n<p>           abeyance.\n<\/p><\/blockquote>\n<blockquote><p>\n       iii. The balance amount due from the petitioner shall<\/p>\n<p>           be paid in 10 equal monthly instalments. The 1st<\/p>\n<p>           instalment shall be paid by the petitioner on or<\/p>\n<p>           before    15.10.2008,     and    the  subsequent<\/p>\n<p>           instalments shall be paid on or before the 15th of<\/p>\n<p>           every succeeding month.\n<\/p><\/blockquote>\n<blockquote><p>\n       iv.
