He was, therefore,\nreinstated in  service and when the Commissioner wrote again\nfor the sanction, the Standing Committee recorded on 17-6-70\nto drop\t the case  on the ground that it was an old case and\nthe appellant had already been reinstated in service.\n     The Hyderabad  Municipal Corporation (Amendment) Act II\nof 1970\t came into force on 27-6-70, under which a provision\nwas made  for  the  appointment\t of  a\tspecial\t officer  to\nexercise the powers, to perform the duties and discharge the\nfunctions of  (a) the Corporation (b) the Standing Committee\nand (c)\t the Commission under the Act. This provision was to\nbe in  force for a period of two years with effect from 3-8-\n70 with\t a further  provision that  it shall not be extended\nbeyond 31-10-75.\n     After Act\tII of  1970 came  into force,  on 29-7-72  a\nmemorandum was\tsubmitted in  the nature  of a\tnote to\t the\nStanding Committee  to take a fresh decision on the issue of\nprosecution of\tthe appellant  and for\tgranting sanction to\nprosecute the  appellant. On 15-5-73, the Standing Committee\nby its resolution authorised the special officer to sign the\nsanction order\tand to\tsend it\t to Anti-Corruption  Bureau,\nHyderabad. In  pursuance of the resolution, a sanction order\nwas passed  on 16-6-73. On 29-11-73 the appellant was placed\nunder  suspension   and\t on   11-12-75,\t the  special  judge\ndismissed the petitioner's objections to the validity of the\nsanction. The  appellant filed\tthe appeal by special leave,\nas the High Court dismissed his criminal revision petition.\n     Allowing the appeal, the Court\n^\n     HELD :  1. There can be no legal bar to the sanctioning\nauthority revising  its opinion before the sanction order is\nplaced before  the Court.  The validity\t of the sanction can\nonly be\t considered at\tthe time when it is filed before the\nSpecial Judge. Subsequent sanction having been given, in the\npresent case,  by the competent authority, the plea that the\nStanding Committee again considered the question but decided\nto drop\t the proceedings  on the  ground that  it was an old\ncase and  the  appellant  had  already\tbeen  reinstated  in\nservice cannot be accepted. The  validity of  the sanction\tcannot be upheld, as\nthe special  officer who  is entitled  under  the  Hyderabad\nMunicipal Corporation  Act, 1955  as amended  by Act  II  of\n1970, has  not given the sanction as a special officer or by\nhimself exercising the powers of the Standing Committee, but\nissued the sanction order in pursuance of the sanction given\nby the\tStanding Committee  by its resolution dt. 15-5-1973.\n[796C-D]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CRIMINAL APPELLATE\t JURISDICTION :\t Criminal Appeal No.<br \/>\n482 of 1976.\n<\/p>\n<p>     Appeal by\tSpecial Leave  from the Judgment dated 20-1-<br \/>\n1976 of\t the Andhra  Pradesh High Court in Criminal Revision<br \/>\nCase No. 18 of 1976.\n<\/p>\n<p>     R. This appeal\tis by  special leave against<br \/>\nthe judgment  of Andhra\t Pradesh  High\tCourt,\tin  Criminal<br \/>\nRevision No.  18 of  1976 holding  that the  sanction  order<br \/>\ngiven for  prosecuting the appellant is valid and dismissing<br \/>\nhis Revision Petition.\n<\/p>\n<p>     The appellant  Parmanand Dass, was appointed as a clerk<br \/>\nin Hyderabad Municipal Corporation on 15-1-1951 in the scale<br \/>\nof Rs.\t40-50 and was promoted to the scale of Rs. 50-105 on<br \/>\n1-9-1956.  A   charge  of   having   received\tan   illegal<br \/>\ngratification of Rs. 15\/- was brought against him and he was<br \/>\nsuspended on  22-9-1966. On  27-5-1967, the  Commissioner of<br \/>\nthe Municipal  Corporation  gave  sanction  for\t prosecution<br \/>\nunder section  6 of  the Prevention  of Corruption  Act. The<br \/>\nappellant questioned  the validity  of the  sanction on\t the<br \/>\nground that the Commissioner was not the competent authority<br \/>\nto grant  the  sanction.  The  Special\tJudge  accepted\t the<br \/>\ncontention and\tfound that  the Standing  Committee  of\t the<br \/>\nMunicipality alone can give sanction and as the Commissioner<br \/>\nhad no\tpowers, the sanction was not valid. Soon after on 4-<br \/>\n5-1970, the  appellant prayed  for his reinstatement, and on<br \/>\n12-6-1970, the\tappellant was  reinstated. The Commissioning<br \/>\non 17-6-1970  again wrote  to the Standing Committee seeking<br \/>\nfor a  fresh sanction.\tOn 27-6-1970, the Standing Committee<br \/>\nresolved to  drop the  case on the ground that it was an old<br \/>\ncase and  that the  appellant had already been reinstated in<br \/>\nservice.\n<\/p>\n<p>     On 27-6-1970,  Act II  of 1970 came into force. The Act<br \/>\nprovided that  the special  officer appointed  under the Act<br \/>\nwill exercise  the powers  of the  Standing Committee of the<br \/>\nMunicipal Corporation.\tAfter the Act came into force on 29-<br \/>\n7-1972 a memorandum in the nature of a<br \/>\n<span class=\"hidden_text\">794<\/span><br \/>\nnote to\t the Standing  Committee was prepared requesting the<br \/>\nStanding Committee  to take  fresh decision  on the issue of<br \/>\nprosecution of\tthe appellant,\tand for granting sanction to<br \/>\nprosecute  the\t appellant.  On\t  15-5-1973,  the   Standing<br \/>\nCommittee by  its resolution  authorised the Special Officer<br \/>\nto sign\t the sanction  order and  to send  it to  the  Anti-<br \/>\ncorruption  Bureau,   Hyderabad.   In\tpursuance   of\t the<br \/>\nresolution, a sanction order was passed on 16-6-1973. On 29-<br \/>\n11-1973, the  appellant was  placed under suspension. On 11-<br \/>\n12-1975,  the\tSpecial\t Judge\tdismissed  the\tpetitioner&#8217;s<br \/>\nobjection to  the validity  of the  sanction. The  appellant<br \/>\nfiled Criminal Revision No. 18 of 1976 before the High Court<br \/>\nagainst the  order of  Special\tJudge  and  the\t High  Court<br \/>\ndismissed the  Revision\t Petition  on  20-1-1976,  and\tthis<br \/>\nappeal by special leave is against that order.\n<\/p>\n<p>     It was  submitted that  having once  declined to  grant<br \/>\nsanction,  a  subsequent  Standing  Committee  cannot  grant<br \/>\nsanction on  the same facts. It was contended that the grant<br \/>\nof sanction by the Special Officer was not bona fide and was<br \/>\ndue to\tulterior motive.  We do\t not see any merit in any of<br \/>\nthese submissions.  Sanction given  by the  Commissioner was<br \/>\nrightly rejected by the Special Judge on the ground that the<br \/>\nCommissioner was  not competent\t to grant the sanction. This<br \/>\ncould not  prevent a  subsequent sanction being given by the<br \/>\nCompetent Authority, but the plea of the learned counsel was<br \/>\nthat the  Standing Committee  again considered\tthe question<br \/>\nbut decided  to drop  the proceedings  on the ground that it<br \/>\nwas an\told case and the accused had already been reinstated<br \/>\nin service.  There could  be no\t objection to  the  Standing<br \/>\nCommittee again\t reconsidering its decision. The validity of<br \/>\nthe sanction  can only\tbe considered at the time when it is<br \/>\nfiled before  the Special Judge. We find that there could be<br \/>\nno legal  bar to  the sanctioning authority revising its own<br \/>\nopinion before\tthe sanction  order  is\t placed\t before\t the<br \/>\nCourt.\n<\/p>\n<p>     On a  consideration  of  the  record  which  ultimately<br \/>\nresulted in  the order of the sanction, we find however that<br \/>\nthe sanction  order cannot  be held to be in accordance with<br \/>\nthe  law.  It  was  on\t27-6-1970,  the\t Standing  Committee<br \/>\nresolved to  drop further  proceedings. On the same day, Act<br \/>\nII of 1970 came into force. Under section 2 of the Hyderabad<br \/>\nMunicipal Corporations\t(Amendment) Act,  1970,\t which\tcame<br \/>\ninto  force   on  27th\tJune  1970,  it\t was  provided\tthat<br \/>\nnotwithstanding\t anything   contained\tin   the   Hyderabad<br \/>\nMunicipal Corporation Act, 1955, there shall be appointed by<br \/>\nthe State  Government, by notification in the Andhra Pradesh<br \/>\nGazette, a  Special  Officer  to  exercise  the\t powers,  to<br \/>\nperform the duties and discharge the functions of-\n<\/p>\n<blockquote><p>\t  (a) the Corporation;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">795<\/span><\/p>\n<blockquote><p>\t  (b) the Standing Committee; and\n<\/p><\/blockquote>\n<blockquote><p>\t  (c) the Commissioner.\n<\/p><\/blockquote>\n<p>This provision\twas to be in force for a period of two years<br \/>\nwith effect  from 3rd August, 1970, with a provision that it<br \/>\nshall not  be extended\tbeyond 31st October, 1975. It is not<br \/>\ndisputed before\t us that  the Amendment Act was not extended<br \/>\nto cover  the period  in question. After the introduction of<br \/>\nthe amending  Act, a  Special Officer  was appointed  by the<br \/>\nState Government  by  notification  in\tthe  Andhra  Pradesh<br \/>\nGazette. The  Special Officer was to exercise the powers and<br \/>\nperform the  duties  and  discharge  the  functions  of\t the<br \/>\nStanding Committee.  After the\tdate of coming into force of<br \/>\nthe Amending  Act, the\tSpecial\t Officer  can  himself\tgive<br \/>\nsanction as  he is  empowered to  discharge the functions of<br \/>\nthe Standing  Committee. What happened in this case was that<br \/>\non 29-7-1972  a note  was  prepared  and  submitted  to\t the<br \/>\nStanding Committee  which is  signed by\t one M. Narsing Rao,<br \/>\nfor  Special   Officer.\t The  note  requested  the  Standing<br \/>\nCommittee  to  take  a\tfresh  decision\t on  the  issue\t for<br \/>\nprosecuting  Shri   Parmanand  Dass  for  accepting  illegal<br \/>\ngratification under  Section 6(1)  (c) of  the Prevention of<br \/>\nCorruption Act\t1947. The  Standing Committee  on 15-5-1973,<br \/>\nafter stating  that the\t Standing Committee of the Municipal<br \/>\nCorporation  of\t  Hyderabad  is\t  the  authority  to  remove<br \/>\nParmanand  Dass\t  from\this  office  and  that\tafter  fully<br \/>\nconsidering and examining the materials placed before it, it<br \/>\nwas of the view that the appellant should be prosecuted in a<br \/>\ncourt of  law for  the said offence, accorded sanction under<br \/>\nsection 6(1) (c) of the Prevention of Corruption Act 1974. A<br \/>\ndraft sanction\torder was  signed by  the  Special  Officer,<br \/>\nMunicipal Corporation  of Hyderabad  with a  note that he is<br \/>\nthe officer  authorised by  the Standing  Committee  of\t the<br \/>\nMunicipal Corporation  of Hyderabad  to\t sign  the  sanction<br \/>\norder. After  the coming  into force  of Act II of 1970, the<br \/>\nSpecial Officer\t is entitled to exercise powers, perform the<br \/>\nduties\tand   discharge\t the   functions  of   the  Standing<br \/>\nCommittee. If  the Special  Officer acting  as the  Standing<br \/>\nCommittee had  given the  sanction there  would have been no<br \/>\nflaw in the procedure but in this case what we find is, that<br \/>\na note is prepared for the Standing Committee by one Narsing<br \/>\nRao signing  on\t behalf\t of  the  Special  Officer  and\t the<br \/>\nStanding  Committee   purporting  to  act  as  the  Standing<br \/>\nCommittee, granting  sanction on  16-6-1973. When  asked  to<br \/>\nexplain as to what was the procedure that was adopted by the<br \/>\nSpecial Officer\t and the Standing Committee, and whether the<br \/>\nStanding Committee  was functioning  apart from\t the Special<br \/>\nOfficer, Mr.  Parmeshwar Rao,  learned counsel appearing for<br \/>\nthe State  of Andhra  Pradesh, submitted  that\tthe  Special<br \/>\nOfficer is himself the Standing<br \/>\n<span class=\"hidden_text\">796<\/span><br \/>\nCommittee and  that  the  note\twas  sent  to  the  Standing<br \/>\nCommittee that\twas Special  Officer himself and that he, as<br \/>\nthe Standing  Committee,  gave\tthe  sanction.\tWe  find  it<br \/>\ndifficult to  accept this  explanation, for,  the High Court<br \/>\nproceeded on  the basis\t that by  the resolution dated 15-5-<br \/>\n1973, the Standing Committee accorded sanction under section<br \/>\n6(1)(c) of  the Prevention  of Corruption Act and authorised<br \/>\nthe Special Officer to sign the order according sanction and<br \/>\naccordingly the Special Officer issued the order dated 16-6-<br \/>\n1973.  It  appears,  before  the  High\tCourt,\tthe  parties<br \/>\nproceeded on  the basis that the Standing Committee accorded<br \/>\nsanction on  15-5-1973 and authorised the Special Officer to<br \/>\nsign the  order and  accordingly the  Special Officer issued<br \/>\nthe  sanction\torder.\tThe  draft  order  of  the  Standing<br \/>\nCommittee which is signed by the Special Officer states that<br \/>\nhe is  the officer authorised by the Standing Committee. The<br \/>\nplea of\t the learned counsel for the State that the Standing<br \/>\nCommittee and  the Special  Officer are\t one and the same is<br \/>\ndifficult to  accept in\t the circumstances.  As the  Special<br \/>\nOfficer who  is entitled  under the  Act has  not given\t the<br \/>\nsanction as  a Special\tOfficer or by himself exercising the<br \/>\npowers of  the Standing\t Committee but\tissued the  sanction<br \/>\norder in  pursuance of\tthe sanction  given by\tthe Standing<br \/>\nCommittee, we  are unable  to uphold  the  validity  of\t the<br \/>\nsanction.
