By this petition under Article 226 of the Constitution<\/p>\n<p>    of India, the petitioner seeks (i) quashing of the communication<\/p>\n<p>    dated 4.1.1998 made by under Secretary, Government of<\/p>\n<p>    Maharashtra (Respondent no.1) to the petitioner and the<\/p>\n<p>    communication dated 2.3.1998 by the Deputy Director of<\/p>\n<p>    Education, Nagpur Region, Nagpur (respondent no.3) to the<\/p>\n<p>    Head Master, Yugantar Mahiya Vidyalaya, Nagpur in respect of<\/p>\n<p>    condoning the break in service period of the petitioner and (ii)<\/p>\n<p>    directing the respondents to condone the break in service of the<\/p>\n<p>    petitioner on par with two other employees and finalise the<\/p>\n<p>    pension of the petitioner accordingly.\n<\/p>\n<p>    2.        The facts which gave rise to the present petition are<\/p>\n<p>    all admitted and they are as under:-\n<\/p>\n<p>              The petitioner having acquired the qualification of<\/p>\n<p>    B.Sc. B.T. was appointed as Assistant Teacher in Mahatma<\/p>\n<p>    Gandhi Vidyalaya, Armori on 18.10.1956. He was confirmed<\/p>\n<p>    there and thereafter was promoted as Head Master in the same<\/p>\n<p><span class=\"hidden_text\">                                              ::: Downloaded on &#8211; 09\/06\/2013 13:58:40 :::<\/span><br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>    school on 1.4.1958. However, on 1.5.1961 the services of the<\/p>\n<p>    petitioner were terminated by paying three months&#8217; salary he<\/p>\n<p>    being permanent employee.       This was the first break in his<\/p>\n<p>    service.   Thereafter on 1.6.1961 he was appointed as Head<\/p>\n<p>    Master in Katol High School, Katol. On 6.4.1969 he resigned<\/p>\n<p>    from the said post. His resignation was accepted on 1.10.1969<\/p>\n<p>    and he was relieved on 6.10.1969. This was the second break<\/p>\n<p>    in his service. Thereafter he was appointed as Assistant Head<\/p>\n<p>    Master in temporary post in Tidke Vidyalaya, Nagpur on<\/p>\n<p>    26.7.1971.     However, his services were terminated on<\/p>\n<p>    25.6.1972. This was the third break in his service. Thereafter<\/p>\n<p>    he was appointed as Head Master in Pragatik Vidyalaya, Koradi<\/p>\n<p>    on 3.7.1972. His services were terminated on 30.4.1974. This<\/p>\n<p>    was the fourth and last break in his service. Lastly he was<\/p>\n<p>    appointed as Assistant Teacher in Yugantar Mahila Vidyalaya,<\/p>\n<p>    Nagpur on 14.8.1976 and continued there till he retired on<\/p>\n<p>    attaining the age of superannuation ( i.e. 60 years) on<\/p>\n<p>    30.9.1988. Thus he rendered total service of 32 years including<\/p>\n<p>    the break of about 4 years 3 months and 15 days. All these<\/p>\n<p><span class=\"hidden_text\">                                              ::: Downloaded on &#8211; 09\/06\/2013 13:58:40 :::<\/span><br \/>\n<span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>    schools wherein the petitioner served were aided and<\/p>\n<p>    recognised and the petitioner served there on full time basis<\/p>\n<p>    and was permanent employee.\n<\/p>\n<p>    3.           Even before his retirement, the petitioner made a<\/p>\n<p>    representation to the Education Officer, Zilla Parishad, Nagpur<\/p>\n<p>    on 30.11.1987 for condoning the said break in his service<\/p>\n<p>    period. The case of the petitioner was also recommended by<\/p>\n<p>    the Education Officer as well as Deputy Director of Education<\/p>\n<p>    to the Government.       However, by communication dated Nil<\/p>\n<p>    July, 1992 the Education Department informed the petitioner<\/p>\n<p>    its regret    that the break in service during the period from<\/p>\n<p>    1.5.1974 to       13.8.1976 cannot be condoned as per the<\/p>\n<p>    prevailing rules.     Thereafter the petitioner made several<\/p>\n<p>    representations to the Secretary, Education Department,<\/p>\n<p>    Bombay.      However, by communications dated 4.1.1998 and<\/p>\n<p>    2.3.1998 the petitioner was informed that the break in his<\/p>\n<p>    service cannot be condoned.       The petitioner has challenged<\/p>\n<p>    those communications.\n<\/p>\n<p>    4.           According to the petitioner the breaks in the service<\/p>\n<p><span class=\"hidden_text\">                                                ::: Downloaded on &#8211; 09\/06\/2013 13:58:40 :::<\/span><br \/>\n<span class=\"hidden_text\">                                   5<\/span><\/p>\n<p>    of Shri B.L. Deshmukh and Shri Jagdish Khebudkar were<\/p>\n<p>    condoned by the State.            However, the petitioner was<\/p>\n<p>    discriminated and has been denied the benefit of his long<\/p>\n<p>    service while giving pensionary benefit to him.\n<\/p>\n<p>    5.        Respondents no.1 to 3 as well as respondent no.4<\/p>\n<p>    filed separate returns. According to them there has been no<\/p>\n<p>    discrimination as alleged by the petitioner because the<\/p>\n<p>    petitioner&#8217;s case cannot be equated with that of Shri B.L.\n<\/p>\n<p>    Deshmuklh and Shri Jagdish Khebudkar.         The breaks in the<\/p>\n<p>    services of those two teachers were condoned because under<\/p>\n<p>    normal rules they were not entitled for any pension and in<\/p>\n<p>    order to allow them to draw at least minimum pension, the<\/p>\n<p>    break in their services was condoned as special cases.               The<\/p>\n<p>    policy of the State Government is not to condone break in<\/p>\n<p>    service in order to enhance the pension. Thus the petitioner is<\/p>\n<p>    not entitled to the relief sought.\n<\/p>\n<p>    6.        We have heard Shri A.D. Mohgaonkar, Advocate for<\/p>\n<p>    the petitioner and Shri S.B. Ahirkar, AGP for the respondents.\n<\/p>\n<p>    7.        Shri Mohgaonkar invited our attention to Rule 70.1<\/p>\n<p><span class=\"hidden_text\">                                               ::: Downloaded on &#8211; 09\/06\/2013 13:58:40 :::<\/span><br \/>\n<span class=\"hidden_text\">                                      6<\/span><\/p>\n<p>    of   the   Secondary      School         Code    under      the      caption<\/p>\n<p>    &#8220;Pension\/Provident Fund&#8221;. It provides that every employee on<\/p>\n<p>    a full-time basis in aided and recognised schools who was<\/p>\n<p>    appointed before 1st April, 1966 and had exercised in writing<\/p>\n<p>    his option for a pension scheme, shall be eligible to get pension<\/p>\n<p>    as per rules prescribed by Government.                 Shri Mohgaonkar<\/p>\n<p>    further invited our attention to Annexure 34 of the Secondary<\/p>\n<p>    School Code which provides for &#8220;Pension Scheme for the<\/p>\n<p>    employees in the Non-Government Secondary Schools&#8221;. Clause<\/p>\n<p>    (1) of the said Scheme provides that:\n<\/p>\n<pre>                \"Government        directs    that   the     pension,\n      \n\n\n                gratuity     and    other     retirement     benefits\n   \n\n\n\n                admissible         to the Maharashtra State\n                Government servants under the Revised\n<\/pre>\n<p>                Pension Rules, 1950, as amended from time<\/p>\n<p>                to time, should be made applicable to full<br \/>\n                time teaching staff in recognised and aided<br \/>\n                Non-Government Secondary Schools in the<\/p>\n<p>                State who retires on or after 1st April, 1966.&#8221;\n<\/p>\n<p>    Clause 7 of the Scheme provides that:\n<\/p>\n<p>               &#8220;In computing the length of qualifying service<br \/>\n               for pension under this Scheme, all previous<\/p>\n<p><span class=\"hidden_text\">                                                     ::: Downloaded on &#8211; 09\/06\/2013 13:58:40 :::<\/span><br \/>\n<span class=\"hidden_text\">                             7<\/span><\/p>\n<p>      service,   whether temporary, officiating or<br \/>\n      permanent, either in one or more than one<\/p>\n<p>      Non-Government Secondary School, shall be<\/p>\n<p>      taken into account. Subject to the general<br \/>\n      condition that the period of each break does<br \/>\n      not exceed 6 months and the total period of<\/p>\n<p>      six breaks hereinafrer referred to do not<br \/>\n      exceed two years, breaks in service on<\/p>\n<p>      account of any of the reasons listed below not<br \/>\n      exceeding six in number,<br \/>\n              ig                           should not be<br \/>\n      treated as interruptions entailing forfeiture<\/p>\n<p>      of past service.\n<\/p>\n<pre>      (1)    Break     in     service    on    account        of\n      resignation of the teachers from a                  Non-\n      \n\n\n<\/pre>\n<p>      Government Secondary School, provided it is<\/p>\n<p>      followed by his taking up service as a teacher<br \/>\n      to    another      recognised      Non-Government<br \/>\n      Secondary School and is not intervened by<\/p>\n<p>      his taking employment in any other capacity.<br \/>\n      Out of the maximum number of six breaks<br \/>\n      that can be condoned, not more than three<\/p>\n<p>      breaks should, however, be on account of<br \/>\n      such resignations.\n<\/p>\n<p>      (2) Termination of service due to no fault of<br \/>\n      the    teacher     or     on      account      of     the<\/p>\n<p><span class=\"hidden_text\">                                              ::: Downloaded on &#8211; 09\/06\/2013 13:58:40 :::<\/span><br \/>\n<span class=\"hidden_text\">                                   8<\/span><\/p>\n<p>                circumstances beyond the       control of the<br \/>\n                teacher. If the services of a teacher have been<\/p>\n<p>                terminated on disciplinary grounds after<\/p>\n<p>                following the prescribed procedure, such<br \/>\n                break in service cannot be condoned and the<br \/>\n                services rendered by the teacher in the school<\/p>\n<p>                from which his services are so terminated on<br \/>\n                disciplinary grounds will not account for<\/p>\n<p>                pension.&#8221;\n<\/p>\n<p>    8.<\/p>\n<p>              Shri Mohgaonkar also invited our attention to<\/p>\n<p>    Appendix A which is an Accompaniment of Government<\/p>\n<p>    Resolution, Education Youth Services Department                        No.<\/p>\n<p>    PEN1076-81126(1491) XII dated 12.11.1976 which provides<\/p>\n<p>    that breaks after 30.9.1974 in respect of teachers should not be<\/p>\n<p>    condoned.     The cut-off date prescribed by the State for<\/p>\n<p>    condoning the break in service is wholly irrational and it results<\/p>\n<p>    in discrimination between the employees and it has no nexus<\/p>\n<p>    with the object sought to be achieved by the pension scheme.\n<\/p>\n<p>    Perhaps     that   is   why         by     Circular        No.       PEN-\n<\/p>\n<p>    1088\/120973\/(582)\/Sec.-Edu. 6 dated 10.5.1989 the Secretary<\/p>\n<p>    of Department of Education was empowered to condone the<\/p>\n<p><span class=\"hidden_text\">                                                 ::: Downloaded on &#8211; 09\/06\/2013 13:58:40 :::<\/span><br \/>\n<span class=\"hidden_text\">                                  9<\/span><\/p>\n<p>    breaks in services of teachers even after 30.9.1974.\n<\/p>\n<p>    9.        Shri Mohgaonkar pointed out that in case of the<\/p>\n<p>    petitioner all those contentions are fulfilled and hence there<\/p>\n<p>    was no difficulty in condoning the break in his service for the<\/p>\n<p>    period from 30.4.1974 14.8.1976 which is of 2 years 3 months<\/p>\n<p>    and 13 days.\n<\/p>\n<p>    10.       The   reasons put forth by the respondents for not<\/p>\n<p>    condoning the break in service of the petitioner are (i) that the<\/p>\n<p>    policy of the State is not to condone the break in service in<\/p>\n<p>    order to enhance the pension and (ii) that the cases of Shri B.L.\n<\/p>\n<p>    Deshmukh and Shri Jagdish Khebudkar cannot be equated with<\/p>\n<p>    that of the petitioner, because those two employees would not<\/p>\n<p>    have been entitled for any pension unless the break in their<\/p>\n<p>    service was condoned and hence the same was condoned as<\/p>\n<p>    special cases. We are unable to find any logic in these reasons.\n<\/p>\n<p>    If it is the policy of the State to give pension to every employee<\/p>\n<p>    on a full-time basis in aided and recognized schools appointed<\/p>\n<p>    before 1st April, 1966, there is no question of any policy of the<\/p>\n<p>    State not to condone break in service       in order to enhance<\/p>\n<p><span class=\"hidden_text\">                                                ::: Downloaded on &#8211; 09\/06\/2013 13:58:40 :::<\/span><br \/>\n<span class=\"hidden_text\">                                 10<\/span><\/p>\n<p>    pension.   If an employee is benefitted in calculation of his<\/p>\n<p>    pension by condoning break in his service, there is no reason<\/p>\n<p>    why such break should not be condoned. It fact it would be in<\/p>\n<p>    consonance with the pension scheme introduced by the State.\n<\/p>\n<p>    Hence the ground for not condoning the break in service of the<\/p>\n<p>    petitioner does not stand to reason.\n<\/p>\n<p>    11.        So far as equating the case of the petitioner with<\/p>\n<p>    that of Shri B.L. Deshmukh and Shri Jagdish Khebudkar, it is<\/p>\n<p>    true that they cannot be equated because in the absence of<\/p>\n<p>    condonation of break in their services, those two employees<\/p>\n<p>    would not have been entitled to draw any pension. However,<\/p>\n<p>    this does not mean that if because of the condonation of break<\/p>\n<p>    in service of the petitioner, he is benefitted by getting more<\/p>\n<p>    pension, the break in his service should not be condoned. It<\/p>\n<p>    may not be forgotten that the petitioner rendered 32 years of<\/p>\n<p>    total service including break for 4 years 3 months and 15 days.\n<\/p>\n<p>    As the last break in the service of the petitioner is not<\/p>\n<p>    condoned, his pension has been calculated on the basis of his<\/p>\n<p>    service of about 12 years only whereas if the last break in the<\/p>\n<p><span class=\"hidden_text\">                                              ::: Downloaded on &#8211; 09\/06\/2013 13:58:40 :::<\/span><br \/>\n<span class=\"hidden_text\">                                  11<\/span><\/p>\n<p>    service of the petitioner is condoned, he would get benefit of<\/p>\n<p>    the earlier 16 years of service.    Since the last break in the<\/p>\n<p>    service of the petitioner for 2 years 3 months and 13 days is not<\/p>\n<p>    condoned, he gets pensionable service only from 14.8.1976 to<\/p>\n<p>    30.9.1988 i.e. for about 12 years whereas if the last break in<\/p>\n<p>    the service of the petitioner is condoned, he would get benefit<\/p>\n<p>    of earlier     20 years of service for calculating pension and<\/p>\n<p>    pensionable benefits. In our view the State was not justified in<\/p>\n<p>    refusing to condone the last break in service of the petitioner<\/p>\n<p>    depriving him all the benefits of the long service. Such a<\/p>\n<p>    decision is against public policy. We are surprised to see that<\/p>\n<p>    the last break in the service of the petitioner was not condoned<\/p>\n<p>    by the State despite the authorities below having recommended<\/p>\n<p>    the case of the petitioner for condonation of break in service.\n<\/p>\n<p>    12.          In view of above reasons, we find that the<\/p>\n<p>    communication by the State dated Nil July,1992 so also the<\/p>\n<p>    communication dated 4.1.1998 and 2.3.1998 are liable to be<\/p>\n<p>    quashed and set aside. Hence we pass the following order:-\n<\/p>\n<p>                 The petition is allowed. The communications dated<\/p>\n<p><span class=\"hidden_text\">                                                ::: Downloaded on &#8211; 09\/06\/2013 13:58:40 :::<\/span><br \/>\n<span class=\"hidden_text\">                                 12<\/span><\/p>\n<p>    4.1.1998 by the Under Secretary, Government of Maharashtra<\/p>\n<p>    (R-1) to the petitioner and 2.3.1998 by the Deputy Director of<\/p>\n<p>    Education, Nagpur Region, Nagpur (R-3) to the Head Master,<\/p>\n<p>    Yugantar Mahila Vidyalaya, Nagpur are hereby quashed and set<\/p>\n<p>    aside. Respondent no.1 is directed to condone the break in<\/p>\n<p>    service of the petitioner   and to refix the pension of the<\/p>\n<p>    petitioner accordingly.   Rule is made absolute in the above<\/p>\n<p>    terms.\n<\/p>\n<p>              (PRASANNA B. VARALE, J.)           (K.J.
