intra\u00adcourt \u00a0 appeal \u00a0 filed \u00a0 under \u00a0 Section \u00a0 2(1) \u00a0 of \u00a0 M.P.\u00a0\nUchcha \u00a0 Nyayalaya \u00a0 (Khand \u00a0 Peeth \u00a0 Ko \u00a0 Appeal) \u00a0 Adhiniyam, \u00a0 2005,\u00a0\narises\u00a0from\u00a0the\u00a0order\u00a0of\u00a0learned\u00a0Single\u00a0Judge\u00a0 \u00a0dated\u00a03.12.2010\u00a0by\u00a0\nwhich\u00a0the\u00a0Writ\u00a0Petition\u00a0No.17230\/2010\u00a0preferred\u00a0by\u00a0the\u00a0appellant\u00a0\nhas\u00a0been\u00a0dismissed.\n\n        The \u00a0 facts \u00a0 leading \u00a0 to \u00a0 filing \u00a0 of \u00a0 the \u00a0 instant \u00a0 appeal \u00a0 briefly\u00a0\nstated,\u00a0are\u00a0that\u00a0the\u00a0appellant\u00a0who\u00a0was\u00a0appointed\u00a0on\u00a01.1.1990\u00a0on\u00a0\ndaily\u00a0wage\u00a0basis\u00a0vide\u00a0order\u00a0dated\u00a028.7.1992,\u00a0\u00a0was\u00a0terminated\u00a0by\u00a0an\u00a0\noral \u00a0 order \u00a0 dated \u00a0 7.8.1992. \u00a0 \u00a0 Admittedly, \u00a0 the \u00a0 petitioner \u00a0 did \u00a0 not\u00a0\nchallenge\u00a0the\u00a0order\u00a0dated\u00a028.7.1992\u00a0terminating\u00a0her\u00a0services\u00a0and\u00a0\nfor\u00a0the\u00a0first\u00a0time\u00a0filed\u00a0the\u00a0writ\u00a0petition,\u00a0which\u00a0has\u00a0been\u00a0dismissed\u00a0\nby \u00a0 the \u00a0 learned \u00a0 single \u00a0 Judge \u00a0 vide \u00a0 order \u00a0 dated \u00a0 3.12.2010 \u00a0 on \u00a0 the\u00a0\nground\u00a0of\u00a0laches.\u00a0\u00a0\n        Learned \u00a0counsel\u00a0for \u00a0the\u00a0appellant\u00a0vehemently\u00a0contended\u00a0\nthat \u00a0 the \u00a0 appellant \u00a0 made \u00a0 several \u00a0 representations \u00a0 for \u00a0 her\u00a0\nreinstatement,\u00a0but\u00a0it\u00a0yield\u00a0no\u00a0result\u00a0since\u00a0the\u00a0appellant\u00a0cannot\u00a0be\u00a0\nheld\u00a0to\u00a0be\u00a0guilty\u00a0of\u00a0laches.\n        We\u00a0do\u00a0not\u00a0find\u00a0any\u00a0force\u00a0in\u00a0the\u00a0submission\u00a0for\u00a0the\u00a0reason\u00a0\nthat\u00a0admittedly,\u00a0the\u00a0appellant\u00a0was\u00a0engaged\u00a0in\u00a0service\u00a0purely\u00a0on\u00a0\ndaily\u00a0wage\u00a0basis\u00a0on\u00a01.1.1990\u00a0and\u00a0he\u00a0was\u00a0disengaged\u00a0by\u00a0an\u00a0 oral\u00a0\norder \u00a0 dated \u00a0 7.8.1992, \u00a0 which \u00a0 was \u00a0 not \u00a0 challenged \u00a0 before \u00a0 the\u00a0\nappropriate \u00a0 authority \u00a0 immediately \u00a0 thereafter \u00a0 or \u00a0 even \u00a0 within \u00a0 a\u00a0\nreasonable \u00a0 period \u00a0 of \u00a0 time. \u00a0 \u00a0 It \u00a0 further \u00a0 appears \u00a0 from \u00a0 the \u00a0 writ\u00a0\npetition \u00a0 that \u00a0 for \u00a0 the \u00a0 first \u00a0 time, \u00a0 she \u00a0 made \u00a0 representation \u00a0 on\u00a0\n22.6.2004<\/pre>\n<p>;\u00a0a\u00a0copy\u00a0whereof\u00a0is\u00a0enclosed\u00a0as\u00a0Annx.P\/2\u00a0requesting\u00a0to\u00a0<br \/>\n           reinstate \u00a0 her \u00a0 after \u00a0 a \u00a0 gap \u00a0 of \u00a0 12 \u00a0 years. \u00a0 \u00a0 No \u00a0 document \u00a0 has \u00a0 been\u00a0<br \/>\n          brought \u00a0 on \u00a0 record \u00a0 to \u00a0 show \u00a0 that \u00a0 any \u00a0 representation \u00a0 was \u00a0 made\u00a0<br \/>\n          between \u00a0 7.8.1992 \u00a0 and \u00a0 prior \u00a0 to \u00a0 the \u00a0 first \u00a0 representation \u00a0 dated\u00a0<br \/>\n          22.6.2004\u00a0against\u00a0the\u00a0order\u00a0terminating\u00a0her\u00a0engagement\u00a0as\u00a0daily\u00a0<br \/>\n          wager \u00a0 and \u00a0 the \u00a0 writ \u00a0 petition \u00a0 has \u00a0 been \u00a0 filed \u00a0 in \u00a0 November \u00a0 2010,\u00a0<br \/>\n          merely \u00a0 after \u00a0 18 \u00a0 years \u00a0 and, \u00a0 therefore, \u00a0 it \u00a0 cannot \u00a0 be \u00a0 said \u00a0 that \u00a0 the\u00a0<br \/>\n          appellant\u00a0is\u00a0not\u00a0guilty\u00a0of\u00a0laches\u00a0or\u00a0negligence.\n<\/p>\n<p>                  It\u00a0is\u00a0well\u00a0settled\u00a0legal\u00a0position\u00a0that\u00a0person\u00a0guilty\u00a0of\u00a0laches\u00a0<br \/>\n          and \u00a0 negligence \u00a0 are \u00a0 disentitled \u00a0 to \u00a0 claim \u00a0 relief \u00a0 by \u00a0 invoking \u00a0 the\u00a0<br \/>\n          extraordinary\u00a0jurisdiction\u00a0of\u00a0this\u00a0Court.\u00a0 \u00a0Reference\u00a0may\u00a0be\u00a0made\u00a0<br \/>\n          to \u00a0 the \u00a0 judgment \u00a0 of \u00a0 the \u00a0 Apex \u00a0 Court \u00a0 in \u00a0Uttaranchal \u00a0 Forest\u00a0<br \/>\n          Development\u00a0Corpn.\u00a0\u00a0Vs.\u00a0\u00a0Jabar\u00a0Singh\u00a0[(2007)\u00a02\u00a0SCC\u00a0112],\u00a0NDMC \u00a0<br \/>\n          Vs. \u00a0 Pan \u00a0 Singh \u00a0 [2007(9) \u00a0 SCC \u00a0 78] \u00a0 and \u00a0Virendra \u00a0 Choudhary \u00a0Vs. \u00a0<br \/>\n          Bharat\u00a0Petroleum\u00a0Corporation\u00a0and\u00a0others\u00a0[2009\u00a0(1)\u00a0SCC\u00a0297].\n<\/p>\n<p>                  We,\u00a0therefore,\u00a0do\u00a0not\u00a0find\u00a0any\u00a0fault\u00a0in\u00a0the\u00a0order\u00a0of\u00a0learned\u00a0<br \/>\n          Single\u00a0Judge.\n<\/p>\n<p>
