    Revision is filed by the de facto complainant<\/p>\n
the injured in C.C.373\/2001 on the file of Judicial<\/p>\n
First Class Magistrate, Sasthamcotta challenging<\/p>\n
the order of acquittal of the second respondent,<\/p>\n
the accused in the case, under section 248(1) of<\/p>\n
Code of Criminal Procedure.\n<\/p>\n
    2.   Learned counsel appearing for petitioner<\/p>\n
and second respondent were heard.<\/p>\n
    3.   The order of acquittal shows that though<\/p>\n
prosecution  case   was   that  second   respondent<\/p>\n
committed the offence under section 498A of IPC and<\/p>\n
to prove the case ten witnesses were cited stating<\/p>\n
that  inspite of coercive steps     appearance  of<\/p>\n
witnesses could not be secured and as        is no<\/p>\n
evidence to prove the guilt, second respondent  was<\/p>\n
acquitted.\n<\/p>\n
    4.  The records of the courts below establish<\/p>\n
CRRP3588\/2008              2<\/span><\/p>\n
that second respondent appeared and charge was<\/p>\n
framed on 11.1.2002.    After granting bail the case<\/p>\n
was adjourned to 14.6.2002 to produce witness.    It<\/p>\n
was  adjourned    to  21.12.2002  and thereafter  to<\/p>\n
27.6.2003 and then to 18.10.2003.       On that day<\/p>\n
summons to Cws.1 to 3 were issued and case was<\/p>\n
posted    to  18.12.2003.    On  18.12.2003  it  was<\/p>\n
adjourned by notification to 26.2.2004 and     again<\/p>\n
adjourned by notification to 2.6.2004.   Proceedings<\/p>\n
of 2.6.2004 reads:-\n<\/p>\n
       “Accused    present.         No<\/p>\n
       witnesses   present.   Bailable<\/p>\n
       warrant against Cws.1 to 7.\n<\/p>\n
       Posted to 25.8.2004.”\n<\/p>\n
The records show that summons on Cws. 1 to 3 were<\/p>\n
not served     as  directed on  18.10.2003  and  the<\/p>\n
summons were returned praying time for service.<\/p>\n
Still    without  issuing  further summons  bailable<\/p>\n
warrant was issued on 25.8.2004.     The proceedings<\/p>\n
of 25.8.2004 reads:-\n<\/p>\n
           “Accused present.  Issue<\/p>\n
CRRP3588\/2008               3<\/span><\/p>\n
           summons  to  CW1  through<\/p>\n
           registered post.   Posted<\/p>\n
           to 15.10.2004.”\n<\/p><\/blockquote>\n
Records     establish that bailable warrants issued to<\/p>\n
Cws.1 to 7 were returned stating      that due to law<\/p>\n
and   order    duty  they    could  not  be  executed.<\/p>\n
Learned Magistrate did not pursue that matter and<\/p>\n
instead issued only summons to CW1 on 25.8.2004 by<\/p>\n
registered     post.    On  15.10.2004  the  case  was<\/p>\n
adjourned to 28.10.2004 as follows:-<\/p>\n
        \"Accused present.     No witness\n\n         present.    Evidence    closed.\n\n         Posted to 28.10.2004.\"\n\n<\/pre>\n
The registered cover which is available in the<\/p>\n
records shows that it was returned to the court as<\/p>\n
addressee     not   known  much   before   15.10.2004.<\/p>\n
Without issuing further summons learned Magistrate<\/p>\n
closed the evidence on 15.10.2004.<\/p>\n
     5.      On 28.10.2004 the accused was absent.<\/p>\n
Learned Magistrate reopened the evidence and issued<\/p>\n
summons to Cws.4 to 10 and posted the case to<\/p>\n
CRRP3588\/2008              4<\/span><\/p>\n
19.11.2004.       On  19.11.2004  recording  that  no<\/p>\n
witness was present bailable warrant was issued<\/p>\n
against     Cws.1 to  10   and  posted  the  case  to<\/p>\n
22.12.2004.     On 22.12.2004 the evidence was closed<\/p>\n
as follows:-\n<\/p>\n
        \"Accused    present.       No\n\n        witnesses present.   Evidence\n\n        closed.          Posted    to\n\n        28.12.2004.\"\n\n<\/pre>\n
On 28.12.2004 it was adjourned by notification to<\/p>\n
12.1.2005 on which day also it was adjourned as<\/p>\n
accused absent. For hearing to 25.1.2005.          On<\/p>\n
25.1.2005    it  was  adjourned  by  notification  to<\/p>\n
30.3.2005 and on that day it was adjourned to the<\/p>\n
next day. On that     day the order of acquittal was<\/p>\n
passed finding the accused not guilty.     Summons to<\/p>\n
Cws.4 to 10 were in fact returned to the court<\/p>\n
without     service  stating   that  there   was   no<\/p>\n
sufficient time to serve the summons.    Non bailable<\/p>\n
warrant issued to Cws. 4 to 10 on 19.11.2004 is<\/p>\n
also seen returned back to the court stating that<\/p>\n

because of law and order warrant could not be<\/p>\n
issued.\n<\/p>\n
    6. It is absolutely clear form the records<\/p>\n
that   when   the Magistrate  acquitted  the  second<\/p>\n
respondent under section 248(1) of Code of Criminal<\/p>\n
Procedure learned Magistrate did not verify the<\/p>\n
records to see whether the summons or warrant<\/p>\n
issued to the prosecution witnesses were served or<\/p>\n
executed.      When summons were not served on the<\/p>\n
accused and even the bailable warrant       returned<\/p>\n
back to the court without service stating that<\/p>\n
because of law and order     police could not serve<\/p>\n
the summons or execute the warrant,       Magistrate<\/p>\n
should have directed service of summons on       the<\/p>\n
prosecution witnesses and only if inspite of the<\/p>\n
service they did not appear,   an order of acquittal<\/p>\n
for want of evidence could have been passed.     The<\/p>\n
proceedings   establish  that    learned  Magistrate<\/p>\n
illegally acquitted    second respondent on 31.3.05.<\/p>\n
       The Criminal Revision Petition is allowed.<\/p>\n
The order of acquittal is   set aside.  C.C.373\/2001<\/p>\n
CRRP3588\/2008             6<\/span><\/p>\n
is restored to file and remanded to Judicial First<\/p>\n
Class Magistrate with a direction to issue   summons<\/p>\n
to the prosecution witnesses and dispose the case<\/p>\n
in accordance with law.   As the revision petitioner<\/p>\n
is  the     first witness to  be  examined  by   the<\/p>\n
prosecution,     revision  petitioner   and   second<\/p>\n
respondent accused are directed to appear before<\/p>\n
the   Magistrate on 30.12.2008.     Send  back   the<\/p>\n
records.\n<\/p>\n
    Criminal Revision Petition is disposed.<\/p>\n
