Justice M.N.KRISHNAN\n\n Dated :06\/03\/2008\n\n O R D E R\n                        M.N.KRISHNAN, J.\n                   -------------------------------------------\n                        C.R.P.No.276 of 2007\n                  -------------------------------------------\n               Dated this the 6th day of March, 2008\n\n\n                                  ORDER\n<\/pre>\n<p>     This revision petition is preferred against the award of the<\/p>\n<p>Additional District Judge, Kottayam, whereby the court below<\/p>\n<p>has granted an enhanced compensation of Rs.70,550\/- with 6%<\/p>\n<p>interest. The learned counsel for the revision petitioner would<\/p>\n<p>contend that the court has relied upon the decision of this court<\/p>\n<p>in Kumba Amma v. K.S.E.B. [2000 (1) KLT 542] wherein the<\/p>\n<p>court has ordered to take uniform annuity of 5% for calculation<\/p>\n<p>of compensation. In K.S.E.B. v. Livisha [2007 (3) KLT 1] the<\/p>\n<p>Apex court has held that each case has to be considered on the<\/p>\n<p>facts and circumstances of that case and for that purpose it has<\/p>\n<p>given the following guidelines.\n<\/p>\n<\/p>\n<blockquote><p>      &#8220;The situs of the land, the distance between the high<br \/>\n      voltage electricity line laid thereover, the extent of<br \/>\n      the line thereon as also the fact as to whether the<br \/>\n      high voltage line passes over a small track of land or<br \/>\n      through the middle of the land and other similar<br \/>\n      relevant   factors       in    our       opinion        would be<br \/>\n      determinative. The value of the land would also be a<br \/>\n      relevant factor. The owner of the land furthermore,<br \/>\n      in a given situation may lose his substantive right to<br \/>\n      use the property for the purpose for which the same<br \/>\n      was meant to be used. So far as the compensation<br \/>\n      in relation to fruit bearing trees are concerned the<\/p>\n<p><span class=\"hidden_text\">CRP No.276\/2007                  2<\/span><\/p>\n<p>     same would also depend upon the facts and<br \/>\n     circumstances of each case.&#8221;<\/p><\/blockquote>\n<p>     2. So in the light of these guidelines, it appears that the<\/p>\n<p>matter requires reconsideration at the hands of the court below.<\/p>\n<p>Therefore, the award under challenge is set aside and the matter<\/p>\n<p>is remitted back to the court below for fresh consideration after<\/p>\n<p>allowing both sides to adduce both oral and documentary<\/p>\n<p>evidence in support of their respective contentions and then<\/p>\n<p>decide the matter in the light of the enunciated principles<\/p>\n<p>referred to in the decision of the Apex court.<\/p>\n<p>     Parties are directed to appear before the court below on<\/p>\n<p>7.4.2008.\n<\/p>\n<\/p>\n<p>                                       M.N.KRISHNAN, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Power Grid Corporation Of India &#8230; vs Sri.
