N.  VARIAVA, J.\n<\/p>\n<p>      Leave  granted.  This Appeal is against an Order dated<br \/>\n10th  November,\t 1999  by  which, in  an  Application  under<br \/>\nSection\t 482  of the Code of Criminal Procedure, a  criminal<br \/>\ncomplaint  has been quashed on the ground that the complaint<br \/>\nspelled\t out  civil  wrong and continuance of  the  criminal<br \/>\nprosecution  would be an abuse of process of the court.\t The<br \/>\ncomplaint  was that Respondents 2 to 10 had fraudulently got<br \/>\nthe  father  of the Complainant to execute a gift deed.\t  On<br \/>\nthe  basis of this complaint the Magistrate held an  enquiry<br \/>\nunder  Section\t202  of the Code of Criminal  Procedure\t and<br \/>\ndismissed  the\tcomplaint under Section 203 of the  Code  of<br \/>\nCriminal  Procedure.  As against the Order of dismissal\t the<br \/>\nAppellant  went in Revision.  The learned Sessions Judge set<br \/>\naside  the Order of dismissal and remanded the case back  to<br \/>\nthe  Magistrate.   On  such  remand  the  Magistrate  issued<br \/>\nprocess\t against  Respondents  2 to 10 to face\ttrial  under<br \/>\nSections  419, 420, 467 and 120 B of the Indian Penal  Code.<br \/>\nRespondents  2 to 10 then filed a Petition under Section 482@@<br \/>\n\t\t\t\t\t\t\t JJJ<br \/>\nof  the\t Code  of  Criminal   Procedure\t for  quashing\t the@@<br \/>\nJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\ncomplaint.   By\t the impugned Order the complaint  has\tbeen<br \/>\nquashed\t on the ground, as set out above, that the complaint<br \/>\nspelled\t out a civil wrong and, therefore continuance of the<br \/>\ncriminal  prosecution  would be an abuse of process  of\t the<br \/>\ncourt.\t Mr.   Sinha submitted that the impugned  Order\t was<br \/>\nunsustainable.\t He  submitted that facts make out  a  civil<br \/>\nwrong  as  well as a criminal liability.  He submitted\tthat<br \/>\nmerely\tbecause civil action can be taken does not mean that<br \/>\na criminal complaint is not maintainable.  In support of his<br \/>\nsubmission  he\trelied\tupon the case  of  <a href=\"\/doc\/418835\/\">Trisuns  Chemical<br \/>\nIndustry  v.   Rajesh Agarwal and Ors.<\/a>\treported in JT\t1999<br \/>\n(6) SC 618.  In this case, the agreement between the parties<br \/>\ncontained  an  Arbitration  clause.  This  Court  held\tthat<br \/>\nmerely\tbecause the dispute could be referred to arbitration<br \/>\nit   was  not  an  effective   substitute  for\ta   criminal<br \/>\nprosecution  when the act also made out an offence.  On\t the<br \/>\nother  hand, Mr.  Singh submitted that the alleged acts have@@<br \/>\n\t\t\t\t\t\t   JJJJJJJJJ<br \/>\nmade  out no case for taking cognizance.  He submitted\tthat@@<br \/>\nJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJJ<br \/>\nat  the highest the remedy would lie in a Civil Court  only.<br \/>\nHe  relied upon the cases of <a href=\"\/doc\/1033637\/\">State of Haryana v.  Bhajan Lal<\/a><br \/>\nreported in 1992 Supp (1) SCC 335 and Mr.  K.  Ramakrishna &amp;<br \/>\nOrs.   v.  State of Bihar &amp; Anr.  reported in JT 2000 (Supp.\n<\/p>\n<p>1) SC 53, In these cases it is held that inherent powers can<br \/>\nbe  exercised  to quash proceedings to prevent abuse of\t the<br \/>\nprocess\t of law and to secure ends of justice.\tIt has\tbeen<br \/>\nheld that where the allegations in the FIR do not constitute<br \/>\nthe alleged offence or where the offence is not disclosed in<br \/>\nthe  complaint or the FIR the frivolous criminal  litigation<br \/>\ncould  be  quashed.   There  could  be\tno  dispute  to\t the<br \/>\nproposition  that  if  the complaint does not  make  out  an<br \/>\noffence\t it can be quashed.  However, it is also settled law<br \/>\nthat facts may give rise to a civil claim and also amount to<br \/>\nan  offence.   Merely because a civil claim is\tmaintainable<br \/>\ndoes  not  mean\t that  the   criminal  complaint  cannot  be<br \/>\nmaintained.   In  this\tcase,  on the facts,  it  cannot  be<br \/>\nstated,\t at this prima facie stage, that this is a frivolous<br \/>\ncomplaint.   The High Court does not state that on facts  no<br \/>\noffence\t is  made  out.\t If that be so, then merely  on\t the<br \/>\nground\tthat  it was a civil wrong the criminal\t prosecution<br \/>\ncould  not have been quashed.
