Heard both sides.\n<\/p>\n<p>\t3. A re&#8217;sume&#8217; of facts absolutely necessary and germane for the disposal<br \/>\nof this Civil Miscellaneous Appeal would run thus:<br \/>\n\tThe Tribunal vide Judgement dated 28.11.2005 has awarded compensation to a<br \/>\ntune of Rs.1,66,800\/- (Rupees one lakh sixty six thousand and eight hundred<br \/>\nonly) on the following sub-heads:\n<\/p>\n<p>For injuries\t \t&#8211;\tRs.  70,000\/-\n<\/p>\n<p>For medical expenses \t&#8211;\tRs.  21,800\/-\n<\/p>\n<p>For disability\t\t&#8211;\tRs.  25,000\/-\n<\/p>\n<p>For pain and sufferings\t&#8211;\tRs.  20,000\/-\n<\/p>\n<p>For transportation and<br \/>\n    extra nourishment\t&#8211;\tRs.   5,000\/-\n<\/p>\n<p>For loss of future<br \/>\namenities\t\t&#8211;\tRs.  25,000\/-\n<\/p>\n<blockquote><p>\t\t\t\t&#8212;&#8212;&#8212;&#8212;-<br \/>\n\t\tTotal\t&#8211;\tRs.1,66,800\/-\n<\/p><\/blockquote>\n<p>\t\t\t\t&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>\t4. Being aggrieved by and dissatisfied with, the Judgment and decree of<br \/>\nthe Tribunal, this appeal has been filed on the main ground that the Tribunal<br \/>\nhas awarded Rs.25,000\/- (Rupees twenty five thousand only) for two grievous<br \/>\ninjuries and for four simple injuries at the rate of Rs.5000\/- (Rupees five<br \/>\nthousand only) each and it totally quantified the compensation for injuries<br \/>\nalone at Rs.70,000\/- (Rupees seventy thousand only) in addition to awarding a<br \/>\nsum of Rs.1,00,000\/- (Rupees one lakh only) towards sub heads.\n<\/p>\n<p>\t5. The point for consideration is as to whether the method and manner in<br \/>\nwhich the compensation was arrived at in accordance with law?\n<\/p>\n<p>6.On point:\n<\/p>\n<p>\tThe learned counsel for the appellant Insurance Company would submit that<br \/>\nfor each type of injury awarding separate compensation would not be tenable and<br \/>\nin an overall manner, the injuries ought to have been viewed by the Tribunal and<br \/>\naccordingly compensation should have been quantified.\n<\/p>\n<p>\t7. The learned counsel for the first respondent\/claimant would draw the<br \/>\nattention of this Court to the seriousness of the head injury sustained by the<br \/>\npetitioner and accordingly, he would submit that the compensation awarded need<br \/>\nnot be disturbed.\n<\/p>\n<p>\t8. The wound certificate would reveal the following injuries:<br \/>\n\t&#8220;1.Multiple lacerated wounds present over the (Lt) side of the face.<br \/>\nContaminated wound +.\n<\/p>\n<p>\t2. Multiple lacerated wounds present over the (Rt) side of the neck.<br \/>\nContaminated wound +.\n<\/p>\n<p>\t3.Pain &amp; tenderness present over the neck &amp; head.\n<\/p>\n<p>\t4.Multiple small abrasions all over the body varying in size and shape&#8221;.\n<\/p>\n<p>\t9. As per the C.T. Scan Brain, the following results are found recorded:<br \/>\n\t&#8220;23.09.2004: 1.Intra ventricular hemorrhage with cerebral edema.\n<\/p>\n<p>\t2. Fracture (Lt) temporal bone present.\n<\/p>\n<p>\t02.10.2004: No evidence of intra cerebral hemorrhage.  No evidence of<br \/>\ncerebral edema&#8221;.\n<\/p>\n<p>\t10. As such, in my opinion, the study of C.T.Scan Brain, demonstrates the<br \/>\nseriousness of the injury sustained by the claimant.  In my opinion, the<br \/>\nmethodology adopted by the Tribunal in awarding compensation for each and every<br \/>\ninjury is not tenable.  However, I would agree with the submissions made by the<br \/>\nlearned counsel for the first respondent\/claimant that the fracture of skull<br \/>\nbone should not be taken lightly.  Hence, considering the fact that the<br \/>\npetitioner sustained fracture of the skull bone and the intra ventricular<br \/>\nhemorrhage with cerebral edema, in addition to the simple injuries, awarding a<br \/>\nsum of Rs.50,000\/- (Rupees fifty thousand only) towards the sub head &#8220;injuries&#8221;<br \/>\nwould meet the ends of justice and in respect of other sub heads, the<br \/>\ncompensation awarded can be left as such without being interfered with.<br \/>\nAccordingly, the compensation is modified as under:\n<\/p>\n<p>For injuries\t\t&#8211;\tRs.  50,000\/-\n<\/p>\n<p>For medical expenses \t&#8211;\tRs.  21,800\/-\n<\/p>\n<p>For disability\t\t&#8211;\tRs.  25,000\/-\n<\/p>\n<p>For pain and sufferings\t&#8211;\tRs.  20,000\/-\n<\/p>\n<p>For transportation and<br \/>\n    extra nourishment\t&#8211;\tRs.   5,000\/-\n<\/p>\n<p>For loss of future<br \/>\namenities\t\t&#8211;\tRs.  25,000\/-\n<\/p>\n<blockquote><p>\t\t\t\t&#8212;&#8212;&#8212;&#8212;-<br \/>\n\t\tTotal\t&#8211;\tRs.1,46,800\/-\n<\/p><\/blockquote>\n<p>\t\t\t\t&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>\t7. In the result, this Civil Miscellaneous Appeal is partly allowed and<br \/>\nthe award of the Tribunal is reduced from Rs.1,66,800\/- (Rupees one lakh sixty<br \/>\nthousand  and eight hundred only) to Rs.1,46,800\/- (Rupees one lakh forty<br \/>\nthousand and eight hundred only), which shall carry<br \/>\ninterest at the rate of 7.5% as directed by the Tribunal.
