00 E.  1 to 4 are accused NOS} to 4 before<\/p>\n
‘  TrIAI”\u00a7:o\ufb01rt (for Short Ad to A-4]. A4 is mother of A–}.<\/p>\n
A-3  A-4 are Sisters of A~1. One Bhavya the deceased<\/p>\n
 x _b_iS”A_InaI*ried to A-1 on 10.2.00. In the wediock, th.e deceased<\/p>\n
 had a male child by name Kruthesh. One Koragappa Raf<\/p>\n
PW~1 is the brother of the deceased and the complainant one<\/p>\n
Ramakrishna Rai PW-3 is also the brother of the
\ncomplainant and the deceased. PW–8 is the mediator.<\/p>\n
2. It is the case of the prosecution that the
\naccused persons were pestering and harassi.n”g,g the<\/p>\n
deceased to get money from her parents’V.g..ho.use;~..<\/p>\n
deceased during her visits to her parents”‘A.’__”ho”u.se’but <\/p>\n
informing the said fact to her”‘”mothe;r  bxrothevrs. b<\/p>\n
Sometime before the incident, A\u00bb  \u00a3i;.gig’de\u00a2eas\u00bb\u00a7a.<\/p>\n
her parental home did not_c’o.me to   to his’<\/p>\n
house. PW–1 and others approac”hed”\u00ab…A~1 ‘ it his wife
\nwith him. A-1 told they ctouidg  wife to his house.<\/p>\n
Accordingly, PW–_1 and deceased to the<\/p>\n
house of 1′:a’nd_V3ieft’\u00abhe1*._T11e accused persons continued<\/p>\n
to peste’r.__the  giving proper food and she<\/p>\n
was; il1–treatVed.’ ‘Oh iO.9x.03 the deceased informed PW~1 ‘<\/p>\n
.  th’ro{ug’\u00bbh’~ phone  she is being harassed and was not<\/p>\n
    by the accused persons and requested<\/p>\n
them to.  and take her.\n<\/p>\n
PW–3 who is another brother of the deceased,<\/p>\n
onu”2.1.9.03 visited the house of accused to bring his<\/p>\n
  sister to his house .To his surprise, he found that his sister<\/p>\n
was not found in the house. Aw} on the phone told<\/p>\n

\nhim, the deceased has left the house saying that she will
\ngo to her parents house. A-1 and PW–3 together made a
\nsearch to know the whereabouts of the deceasved;:’ll”\u00a5fgW~3<\/p>\n
also gave a missing Complaint with the is<\/p>\n
marked at Ex.P–27. PW~3 ultimately m’th_the”assis.tance  <\/p>\n
the Fire Service people traced the ‘deadbody: <\/p>\n
thrown in the tank on the outsl{irts’–of thelfv_illage. l5″Vl.7\u00a7J:a<\/p>\n
lodged the complaint befo’re.l”‘–the 1.:>oli._ce’-  Ex.P~1l<\/p>\n
making the abovg sxaid gallegaj\u00e9tiloiisg of \u00abharassing and
\ntorturing against the  is said to be
\nthe cause of  deceased. The post
\nmortem   of the deceased was<\/p>\n
deconiposed:’lviTherefore:,b”no definite opinion is given by the
\ndoctorllinlihel   However. it is observed that<\/p>\n
there can he giossilbility “of asphyxia death by smothering.<\/p>\n
‘  Thelaccused persons are charged for committing offence<\/p>\n
  arias :j:s;%,\u00a2-.\u00e9iss}1.A, 304-13 r\/W 34 IPC and Secs.3,4 and 6 of<\/p>\n
t1*;ealllDowryi’i?1’ohibition Act. The Trial Court has acquitted the<\/p>\n
 accus’ed.1 The State is in appeal.\n<\/p>\n
   3. It is submitted that A-1 is dead. Hence, the case<\/p>\n
 against; R\u00ab~1(A~1) abates.\n<\/p>\n

4. On a careful perusal of the evidence and allegations
\nin the complaint, it discloses that PW–1, PWWS and PW–8<\/p>\n
have indulged in embellishments and prevaricatioii;..f*eg:close<\/p>\n
scrutiny of FIR allegations discloses  a<\/p>\n
persons were demanding the deceased’ tollget’ m’o.ney’i’f_orl’e. l<\/p>\n
expenses. The FIR does not  cle_’a1’ly <\/p>\n
purpose and the quantity ‘o_f_v’iieInand,  not!’<\/p>\n
also disclose the payment ofyat thlgtttimpe  rriarriage.
\nIt is only in the course’–.zof_  3 1, PW-3 and PW-
\n8, allege that  \u00abcashed?  gold of 80 gms.
\nwas paid at   noii mentioning of this
\nmaterial   the payment of dowry
\n  evirlgenlcelof 1,3 “and 8 suspicious. it is only
\nfor the first   they come up with the<\/p>\n
theory of  of dowry and there is no mention of the<\/p>\n
 :}:s;._y:t”llie.j_1n the evidence of PWs.l. 3 and 8 that the<\/p>\n
accused. insisting the deceased to get Rs.50.000\/–<\/p>\n
 some tirne before the incident and in that regard. she was<\/p>\n
 vs_i_1h_’;”ected to harassment. However, this fact is not stated<\/p>\n
l  in the FIR at the earliest. The FIR allegations discloses that<\/p>\n
A-1 was telling that the deceased was not good looking.<\/p>\n

\nTherefore, he wanted to marry another lady. This theory of
\nA–1’s intention of marrying another lady has given Clear<\/p>\n
go–bye in the evidence and the case is projected”:as:.:th:ough<\/p>\n
the deceased committed suicide only for  \ufb02<\/p>\n
harassment. The theory of .devn1._and.”.o’fdvi  not ‘ p. <\/p>\n
mentioned in the FIR. Thei%efo:r:e,”‘lV the
\napplicability of Sec.304\u00ab~B  does not  d it<\/p>\n
6. The payment of  — and 80
\ngms. of gold as do  FIR and it is by
\nway of preVarication..\u00abwstatedViriitheitleyiddendce. Therefore, the
\nquestion of 4   the offence under
\nSec.3,4    Act also become
\ndoubtvfuliv 7.’ V  it t _ in p <\/p>\n
,__It’is  in the FIR that the deceased<\/p>\n
wasbeinghharassledt’ The FIR discloses that A-1 had<\/p>\n
. it  – pirit-entioin  of  another lady on the ground that the<\/p>\n
   good looking. Perhaps it is for this reason,<\/p>\n
tile dec-easieddn might be dejected and committed suicide.<\/p>\n
 Therevvis no categorical medical evidence to show that the<\/p>\n
 d_ec”eased was killed by smothering and later on thrown in<\/p>\n
the tank. It maybe an unnatural death of suicide but<\/p>\n

\nhowever, there is no clinching evidence to show regarding
\nharassment for dowry consideration.<\/p>\n
8. On a careful consideration of facts and evidence,<\/p>\n
we \ufb01nd that the Trial Court has properly appreciated the<\/p>\n
evidence in coming to the conclusion that <\/p>\n
has not proved the evidence beyond ‘in <\/p>\n
that View of the matter. the appe\u00e9d  ht  <\/p>\n
