Rule is fixed forthwith with the<br \/>\n\tconsent of learned counsel for the parties.\n<\/p>\n<p>The<br \/>\n\tapplicant accused who has been arrested in connection with C.R. No:<br \/>\n\tI- 100\/ 2009 registered with Gondal City Police Station for the<br \/>\n\toffence punishable under section 392 and 114  of I.P. Code, has<br \/>\n\tmoved this Court under section 439 of Cr.P.C. For seeking regular<br \/>\n\tbail, pending trial.\n<\/p>\n<p>The<br \/>\n\taccused applicant appears to have approached the Sessions Court,<br \/>\n\tGondal, by preferring Cri. Misc. Application No. 115 of 2010 which<br \/>\n\tcame to be rejected by Ld. Addl. Sessions Judge, Gondal, vide order<br \/>\n\tdated 1\/4\/2010.\n<\/p>\n<p>This<br \/>\n\tCourt has taken into consideration the averments made in the FIR,<br \/>\n\tand the nature of evidence as it is reflected in the order of the<br \/>\n\ttrial court. It is submitted by learned counsel for the applicant<br \/>\n\tthat looking to the age of the applicant and the manner in which he<br \/>\n\thas been arrested and the fact that nothing has recovered from the<br \/>\n\tpossession of the applicant, the applicant is required to be<br \/>\n\tenlarged on bail. This Court is  convinced that the applicant has<br \/>\n\tmade out case for enlarging him on bail pending trial for the<br \/>\n\tfollowing reasons:\n<\/p>\n<p>Allegations<br \/>\n\tmade in the FIR and the nature of evidence so far as the present<br \/>\n\tapplicant is concerned deserves to be taken into consideration for<br \/>\n\tenlarging him on bail.\n<\/p>\n<p>Prosecution<br \/>\n\thas not expressed any apprehension that if the applicant is enlarged<br \/>\n\ton bail he is likely to influence the witnesses.\n<\/p>\n<p>Prosecution<br \/>\n\thas not expressed any apprehension about applicant\/accused that if<br \/>\n\the is enlarged on bail, is likely to flee from justice.\n<\/p>\n<p>The<br \/>\n\tinvestigation is over and charge sheet is filed.\n<\/p>\n<p>The<br \/>\n\ttrial court has not appreciated this aspects of the case and<br \/>\n\ttherefore the order of the trial court is required to be quashed and<br \/>\n\tset aside and accordingly it is hereby quashed and set aside.\n<\/p>\n<p>The<br \/>\n\taforesaid observations are made only for the purpose of examining<br \/>\n\tthe prayer for bail pending trial. These observations are prima<br \/>\n\tfacie and shall have no bearing whatsoever upon the trial and the<br \/>\n\ttrial court shall not be influenced by it in any way and come to its<br \/>\n\town conclusion after analyzing the evidence that may be led during<br \/>\n\tthe trial.\n<\/p>\n<p>In<br \/>\n\tview of the above, applicant&#8217;s case for bail deserves positive<br \/>\n\tconsideration.\n<\/p>\n<p>Accordingly<br \/>\n\tthe application is allowed. The applicant is ordered to be released<br \/>\n\ton bail in connection with Crime Register No.I- 100\/2009 of Gondal<br \/>\n\tCity Police Station, on his executing a bond of Rs. 5,000=00 (Rupees<br \/>\n\tFive Thousand only), with one surety of same amount to the<br \/>\n\tsatisfaction of the  Court below and subject to the conditions that<br \/>\n\the shall :\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty:\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution:\n<\/p>\n<p>(c<br \/>\n)  maintain law and order:\n<\/p>\n<p>(d)<br \/>\n not leave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned:\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt:\n<\/p>\n<p>(f)<br \/>\n mark his presence once  before concerned Police Station between<br \/>\n15th to 20th  day of every month between 9.00 a.m. and<br \/>\n2.00 p.m., for a period of six months.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the  Court below within a week.\n<\/p>\n<p>8.<br \/>\n If breach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.<br \/>\nBail before the Court below having jurisdiction to try the case.\n<\/p>\n<p>10.<br \/>\nRule made absolute.
