It was further alleged that as<\/p>\n<p>the statements of passengers were not recorded, the punishing authority<\/p>\n<p>could not have accepted the enquiry report and punished the respondent. In<\/p>\n<p>opposition to the plaint, the appellant filed a written statement denying the<br \/>\n<span class=\"hidden_text\"> RSA No.268 of 1998                                                    2<\/span><\/p>\n<p>correctness of the averments in the plaint and asserting that departmental<\/p>\n<p>proceedings and the order of punishment did not suffer from any error<\/p>\n<p>prayed that the suit be dismissed. On the basis of the pleadings, the trial<\/p>\n<p>Court framed the following issues :-\n<\/p>\n<blockquote><p>                   &#8220;1.Whether orders dated 17.5.1991 and 20.8.1991 are<\/p>\n<p>                   illegal and void ? OPP<\/p>\n<\/blockquote>\n<blockquote><p>                   2. Whether the civil Court has no jurisdiction to try the<\/p>\n<p>                     suit ? OPD<\/p>\n<\/blockquote>\n<blockquote><p>                   3. Whether the plaintiff is entitled to the declaration<\/p>\n<p>                     prayed for ? OPP<\/p>\n<\/blockquote>\n<blockquote><p>                   4. Relief.&#8221;<\/p><\/blockquote>\n<p>             After considering the pleadings, the evidence adduced and the<\/p>\n<p>arguments addressed, the trial Court decreed the suit by holding that the<\/p>\n<p>enquiry and the order of punishment were vitiated, for failure to record<\/p>\n<p>statements of passengers. Reliance was placed on a judgement reported as<\/p>\n<p><a href=\"\/doc\/65113821\/\">State of Haryana V. Mohan Singh,<\/a> 1985(2) SLR 116. Aggrieved by the<\/p>\n<p>aforementioned judgement and decree of the trial court the appellant filed<\/p>\n<p>an appeal.   The Additional District Judge, Patiala, vide judgement and<\/p>\n<p>decree dated 14.10.1997 dismissed the appeal.\n<\/p>\n<p>             Counsel for the appellant submits that the Courts below<\/p>\n<p>committed an error as the judgment in Mohan Singh&#8217;s case (supra), has<\/p>\n<p>been over-ruled by a Division Bench of this Court in <a href=\"\/doc\/1404436\/\">Surat Singh V.<\/p>\n<p>Presiding Officer, Labour Court, Rohtak and<\/a> another, 1997(4) RSJ, 386<\/p>\n<p>by holding that to bring home the guilt of a bus conductor, accused of not<\/p>\n<p>issuing tickets to passengers, it is not necessary to record the statements of<br \/>\n<span class=\"hidden_text\"> RSA No.268 of 1998                                                    3<\/span><\/p>\n<p>passengers. Reliance is also placed on State of Haryana and another V.<\/p>\n<p>Rattan Singh, AIR 1977 S.C. 1512(1) to urge that the impugned<\/p>\n<p>judgements be set aside.\n<\/p>\n<p>            Counsel for the respondent does not deny the correctness of the<\/p>\n<p>arguments advanced by the counsel for the appellant but submits that Courts<\/p>\n<p>below set aside the punishment on another ground as well namely; that the<\/p>\n<p>Inspector who appeared as a departmental witness did not depose that<\/p>\n<p>passengers informed him that tickets had not been issued to them. It is<\/p>\n<p>submitted that this fact assumes significance, in view of the respondent&#8217;s<\/p>\n<p>stand that the bus was checked        before he could issue tickets to the<\/p>\n<p>passengers. It is, therefore, argued that as the basic ingredients required to<\/p>\n<p>bring home the respondent&#8217;s guilt are missing, the Courts below rightly<\/p>\n<p>decreed the suit and dismissed the appeal. It is further submitted that as<\/p>\n<p>during the pendency of the appeal the respondent has retired after he was<\/p>\n<p>reinstated, a lenient view should be taken.\n<\/p>\n<p>            I have heard learned counsel for the parties and perused the<\/p>\n<p>impugned judgements.\n<\/p>\n<p>            The question of law that arises for consideration is :<\/p>\n<p>            &#8220;1.    Whether a domestic enquiry and the consequent order of<\/p>\n<p>            punishment can be held to be illegal for failure to record the<\/p>\n<p>            statements of the passengers ?&#8221;\n<\/p>\n<p>            Admittedly, the judgment in Mohan Singh&#8217;s case (supra), has<\/p>\n<p>been over-ruled in <a href=\"\/doc\/1404436\/\">Surat Singh V. Presiding Officer, Labour Court,<\/p>\n<p>Rohtak and<\/a> another, 1997(4) RSJ, 386 by holding it is not necessary to<\/p>\n<p>record the statements of passengers to hold a defaulting conductor guilty. It<br \/>\n<span class=\"hidden_text\"> RSA No.268 of 1998                                                   4<\/span><\/p>\n<p>appears that the aforementioned fact was not brought to the notice of the<\/p>\n<p>courts below. It would, therefore, have to be held that the Courts below<\/p>\n<p>erred   in placing reliance upon the judgment in Mohan Singh&#8217;s case<\/p>\n<p>(supra) to hold that the domestic enquiry and the order of punishment are<\/p>\n<p>illegal and void and as a result, their findings to that effect would have to<\/p>\n<p>be set aside.\n<\/p>\n<p>                As regards the submission by counsel for the respondent that<\/p>\n<p>departmental proceedings and the order of punishment are illegal, as the<\/p>\n<p>Inspector failed to depose that passengers informed him that tickets had<\/p>\n<p>not been issued, cannot be accepted, as such a statement falls within the<\/p>\n<p>realm of hearsay evidence and would, therefore, be inadmissible.<\/p>\n<p>                In view of what has been stated herein above, the appeal is<\/p>\n<p>accepted, the judgements and decrees passed by the Courts below are set<\/p>\n<p>aside and the suit filed by the respondent is dismissed.<\/p>\n<p>                However, as the respondent has retired from service, after<\/p>\n<p>reinstatement, pursuant to the judgements and decrees passed by the Courts<\/p>\n<p>below, no recoveries of any amount already received by the respondent<\/p>\n<p>shall be effected.
