At the same  time\t any\npossibility of the abscondence or evasion or other abuse can\nbe  taken  care of by a direction that the  petitioner\twill\nreport\t himself  before  the  police  station\tonce   every\nfortnight.   He\t was on bail throughout the  trial  but\t was\nreleased  after\t the judgment of the High  Court,  there  is\nnothing\t to suggest that he has abused the trust  placed  in\nhim  by the court.  He is not it desperate character  or  an\nunsocial element who is likely to betray the confidence that\nthe court may place on him to turn up to take justice at the\nhands of the court. [536 A-D]\nOBSERVATION:\nWhile  the system of pecuniary bail has a  tradition  behind\nit,  it\t may  well  be\tthat  in  most\tcases  not  monetary\nsuretyship but undertaking by relations of the petitioner or\norganisation  to  which he belongs may be  better  and\tmore\nsocially relevant.\n\n\n\nJUDGMENT:\n<\/pre>\n<p>CRIMINAL APPELLATE JURISDICTION : Crl.\tMisc. Khanduja,<br \/>\nfor the respondent.\n<\/p>\n<p>I. Makwana, for the intervener.\n<\/p>\n<p>The Order of the Court, was delivered by<br \/>\nKRISHNA\t IYER,\tJ.  The petitioner  moves  for\tbail  having<br \/>\nsurrendered after leave was granted to the State to file  an<br \/>\nappeal against acquittal by the High Court.\n<\/p>\n<p><span class=\"hidden_text\">536<\/span><\/p>\n<p>The basic rule may perhaps be tersely put as bail, not jail,<br \/>\nexcept\twhere there are circumstances suggestive of  fleeing<br \/>\nfrom justice or thwarting the course of justice or  creating<br \/>\nother  troubles\t in  the  shape\t of  repeating\toffences  or<br \/>\nintimidating  witnesses and the like, by the petitioner\t who<br \/>\nseeks enlargement on bail from the court.  We do. not intend<br \/>\nto be exhaustive but only illustrative.<br \/>\nIt  is\ttrue  that the gravity of the  offence\tinvolved  is<br \/>\nlikely\tto  induce  the petitioner to avoid  the  course  of<br \/>\njustice and must weigh with us when considering the question<br \/>\nof  jail.  So also the heinousness of the crime.   Even\t so,<br \/>\nthe  record  of the petitioner in this case is\tthat,  while<br \/>\nlie,  has been on bail throughout in the trial court and  he<br \/>\nwas released after the judgment of the High Court, there  is<br \/>\nnothing\t to suggest that he, has abused the trust placed  in<br \/>\nhim  by the court; his social circumstances also are not  so<br \/>\nunfavourable in the sense of his being a desparate character<br \/>\nor  unsocial element who is likely to betray the  confidence<br \/>\nthat the court may place in him to turn up to take  justice,<br \/>\nat  the hands of the court.  He is stated to be a young\t man<br \/>\nof  27 years with a family to maintain.\t  The  circumstances<br \/>\nand the social milieu do not militate against the petitioner<br \/>\nbeing  granted\tbail at this stage.  At the  same  time\t any<br \/>\npossibility of the abscondence or evasion or other abuse can<br \/>\nbe  taken  care of by a direction that the  petitioner\twill<br \/>\nreport himself before the notice station at Baren once every<br \/>\nfortnight.\n<\/p>\n<p>This  petitioner  will be released on bail on  his  entering<br \/>\ninto a bond of his own and one surety for Rs. 5,000\/- to the<br \/>\nsatisfaction  of the Additional District &amp;  Sessions  Judge,<br \/>\nBaren.\tWhile the system- of pecuniary bail has a  tradition<br \/>\nbehind it, the time has come for rethinking on the  subject.<br \/>\nIt  may well be that in most cases not\tmonetary  suretyship<br \/>\nbut  undertaking by relations of the petitioner\t or  organi-<br \/>\nsation\tto which he belongs may be better and more  socially<br \/>\nrelevant.
