This Court is conscious of the fact that District<br \/>\nRegistrar, Surat is not party to the proceedings.\n<\/p>\n<p>3.\t\tThe<br \/>\nrespondent No.1-Registrar, Co-operative Society, State of Gujarat is<br \/>\nhereby directed to issue necessary directions to District Registrar,<br \/>\nSurat District to hold an independent inquiry to look into the<br \/>\nallegations levelled against the respondent No.2 in the petition. The<br \/>\nDistrict Registrar, Surat will pass appropriate orders after giving<br \/>\nan opportunity of hearing to respondent No.2 or any representative of<br \/>\nthe respondent No.2 &#8211; Bank.  It will be open for the respondent<br \/>\nNo.2 to raise all contentions including that of jurisdiction.  Both<br \/>\nthe sides will approach the District Registrar, Surat within a period<br \/>\nof four weeks from today and the District Registrar, Surat will pass<br \/>\nan order after considering the contentions raised by respective<br \/>\nparties, within a period of four months thereof.\n<\/p>\n<p>4.\t\tIt<br \/>\nis made clear that this Court has not expressed any opinion on merits<br \/>\nand it will be open for the District Registrar, Surat to take<br \/>\nindependent decision after conducting inquiry without being<br \/>\ninfluenced by any order.
