I.A.No.11698\/2010\u00a0is\u00a0accordingly\u00a0allowed.\n         Heard\u00a0on\u00a0the\u00a0question\u00a0of\u00a0admission.\n         This\u00a0review\u00a0petition\u00a0has\u00a0been\u00a0filed\u00a0for\u00a0review\u00a0of\u00a0the\u00a0order\u00a0dated\u00a0\n5.8.2010\u00a0passed\u00a0by\u00a0this\u00a0Court\u00a0in\u00a0Writ\u00a0Petition\u00a0No.641\/2010.\n         Facts<\/pre>\n<p>\u00a0giving\u00a0rise\u00a0to\u00a0filing\u00a0of\u00a0the\u00a0review\u00a0petition\u00a0briefly\u00a0stated\u00a0are\u00a0<br \/>\nthat \u00a0 the \u00a0 petitioner \u00a0 was \u00a0 engaged \u00a0 on \u00a0 the \u00a0 post \u00a0 of \u00a0 Sub \u00a0 Engineer \u00a0 on\u00a0<br \/>\ncontract \u00a0 basis \u00a0 for \u00a0 a \u00a0 period \u00a0 of \u00a0 one \u00a0 year \u00a0 by \u00a0 order \u00a0 dated \u00a0 22.12.2007.\u00a0<br \/>\nThereafter,\u00a0the\u00a0appointment\u00a0of\u00a0the\u00a0petitioner\u00a0was\u00a0extended\u00a0from\u00a0time\u00a0<br \/>\nto \u00a0 time \u00a0 upto \u00a0 30.4.2010. \u00a0 \u00a0 A \u00a0 show \u00a0 cause \u00a0 notice \u00a0 was \u00a0 issued \u00a0 to \u00a0 the\u00a0<br \/>\npetitioner\u00a0on\u00a0the\u00a0ground\u00a0that\u00a0he\u00a0has\u00a0committed\u00a0certain\u00a0irregularities\u00a0in\u00a0<br \/>\nthe\u00a0work\u00a0performed\u00a0by\u00a0him.\u00a0 \u00a0The\u00a0petitioner\u00a0submitted\u00a0a\u00a0reply\u00a0to\u00a0the\u00a0<br \/>\nshow\u00a0cause\u00a0notice,\u00a0which\u00a0was\u00a0not\u00a0found\u00a0satisfactory.\u00a0\u00a0Thereafter,\u00a0by\u00a0an\u00a0<br \/>\norder\u00a0dated\u00a02.6.2010,\u00a0the\u00a0contract\u00a0appointment\u00a0of\u00a0the\u00a0petitioner\u00a0was\u00a0<br \/>\nterminated.\u00a0 \u00a0The\u00a0petitioner\u00a0challenged\u00a0the\u00a0validity\u00a0of\u00a0the\u00a0order\u00a0in\u00a0the\u00a0<br \/>\nwrit\u00a0petition\u00a0before\u00a0the\u00a0learned\u00a0single\u00a0Judge.\u00a0\u00a0Learned\u00a0single\u00a0Judge\u00a0vide\u00a0<br \/>\norder \u00a0 dated \u00a0 30.6.2010 \u00a0 dismissed \u00a0 the \u00a0 writ \u00a0 petition \u00a0 preferred \u00a0 by \u00a0 the\u00a0<br \/>\npetitioner. \u00a0 \u00a0 The \u00a0 order \u00a0 passed \u00a0 by \u00a0 the \u00a0 learned \u00a0 single \u00a0 Judge \u00a0 was\u00a0<br \/>\nchallenged\u00a0by\u00a0the\u00a0petitioner\u00a0in\u00a0Writ\u00a0Appeal\u00a0No.641\/2010.\n<\/p>\n<p>         This\u00a0Court\u00a0vide\u00a0order\u00a0dated\u00a05.8.2010\u00a0declined\u00a0to\u00a0interfere\u00a0with\u00a0<br \/>\nthe\u00a0order\u00a0passed\u00a0by\u00a0the\u00a0learned\u00a0single\u00a0Judge\u00a0on\u00a0the\u00a0ground\u00a0that\u00a0on\u00a0the\u00a0<br \/>\ndate\u00a0when\u00a0the\u00a0order\u00a0terminating\u00a0the\u00a0contractual\u00a0appointment\u00a0of\u00a0the\u00a0<br \/>\npetitioner\u00a0was\u00a0passed,\u00a0his\u00a0appointment\u00a0had\u00a0ceased\u00a0to\u00a0be\u00a0in\u00a0existence.\u00a0<br \/>\nA\u00a0finding\u00a0was\u00a0also\u00a0recorded\u00a0by\u00a0this\u00a0Court\u00a0that\u00a0from\u00a0tenor\u00a0of\u00a0the\u00a0order\u00a0<br \/>\n dated \u00a02.6.2010,\u00a0the \u00a0same \u00a0does\u00a0not\u00a0appear \u00a0to\u00a0be \u00a0stigmatic\u00a0in\u00a0 nature.\u00a0<br \/>\nAccordingly,\u00a0the\u00a0writ\u00a0appeal\u00a0was\u00a0dismissed.\u00a0\n<\/p>\n<p>        Learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 petitioner \u00a0 submitted \u00a0 that \u00a0 competent\u00a0<br \/>\nauthority\u00a0to\u00a0make\u00a0appointment,\u00a0to\u00a0grant\u00a0extension\u00a0and\u00a0to\u00a0terminate\u00a0<br \/>\nthe\u00a0services\u00a0of\u00a0the\u00a0employee\u00a0appointed\u00a0on\u00a0contractual\u00a0basis\u00a0is\u00a0District\u00a0<br \/>\nLevel\u00a0Committee.\u00a0\u00a0However,\u00a0the\u00a0order\u00a0of\u00a0termination\u00a0in\u00a0the\u00a0case\u00a0of\u00a0the\u00a0<br \/>\npetitioner\u00a0has\u00a0been\u00a0passed\u00a0by\u00a0the\u00a0Chief\u00a0Executive\u00a0Officer\u00a0who\u00a0is\u00a0not\u00a0the\u00a0<br \/>\ncompetent\u00a0authority\u00a0and,\u00a0therefore,\u00a0the\u00a0order\u00a0dated\u00a05.8.2010\u00a0passed\u00a0by\u00a0<br \/>\nthis\u00a0Court\u00a0deserves\u00a0to\u00a0be\u00a0reviewed.\u00a0\n<\/p>\n<p>        We\u00a0have\u00a0considered\u00a0the\u00a0submission\u00a0made\u00a0by\u00a0learned\u00a0counsel\u00a0for\u00a0<br \/>\nthe\u00a0petitioner.\n<\/p>\n<p>        From\u00a0perusal\u00a0of\u00a0the\u00a0order\u00a0dated\u00a05.8.2010,\u00a0it\u00a0is\u00a0apparent\u00a0that\u00a0the\u00a0<br \/>\nsolitary \u00a0contention \u00a0raised\u00a0before\u00a0this\u00a0Court\u00a0was\u00a0that\u00a0the \u00a0petitioner&#8217;s\u00a0<br \/>\ncase\u00a0was\u00a0similar\u00a0to\u00a0that\u00a0of\u00a0petitioner\u00a0in\u00a0Writ\u00a0Petition\u00a0No.7830\/2010(s).\u00a0<br \/>\nThough \u00a0 the \u00a0 said \u00a0writ \u00a0petition \u00a0 was \u00a0entertained \u00a0by \u00a0 the \u00a0learned \u00a0 single\u00a0<br \/>\nJudge \u00a0 and \u00a0 an \u00a0 interim \u00a0 order \u00a0 was \u00a0 passed \u00a0 on \u00a0 2.10.2010, \u00a0 yet \u00a0 the \u00a0 writ\u00a0<br \/>\npetition\u00a0preferred\u00a0by\u00a0the\u00a0petitioner\u00a0was\u00a0dismissed.\u00a0 \u00a0This\u00a0Court\u00a0dealt\u00a0<br \/>\nwith\u00a0the\u00a0aforesaid\u00a0submission\u00a0while\u00a0passing\u00a0the\u00a0order\u00a0dated\u00a05.8.2010\u00a0<br \/>\nand\u00a0held\u00a0that\u00a0on\u00a02.6.2010,\u00a0the\u00a0appointment\u00a0of\u00a0the\u00a0petitioner\u00a0was\u00a0not\u00a0in\u00a0<br \/>\nexistence\u00a0whereas,\u00a0the\u00a0petitioner\u00a0in\u00a0Writ\u00a0Petition\u00a0No.7830\/2010(s)\u00a0was\u00a0<br \/>\nin \u00a0 employment \u00a0 when \u00a0 an \u00a0 order \u00a0 terminating \u00a0 his \u00a0 services \u00a0 was \u00a0 passed.\u00a0<br \/>\nTherefore, \u00a0 the \u00a0 petitioner \u00a0 cannot \u00a0 claim \u00a0 parity \u00a0 with \u00a0 the \u00a0 case \u00a0 of \u00a0 the\u00a0<br \/>\npetitioner\u00a0in\u00a0Writ\u00a0Petition\u00a0No.7830\/2010(s).\n<\/p>\n<p>        It\u00a0is\u00a0well\u00a0settled\u00a0in\u00a0law\u00a0that\u00a0in\u00a0order\u00a0to\u00a0seek\u00a0review\u00a0of\u00a0order\u00a0the\u00a0<br \/>\nparty \u00a0 applying \u00a0 for \u00a0 review \u00a0 has \u00a0 to \u00a0 demonstrate \u00a0 that \u00a0 the \u00a0 order \u00a0 suffers\u00a0<br \/>\nfrom\u00a0a\u00a0mistake\u00a0or\u00a0an\u00a0error\u00a0apparent\u00a0on\u00a0the\u00a0face\u00a0of\u00a0the\u00a0record\u00a0which\u00a0<br \/>\nmeans\u00a0the\u00a0mistake\u00a0or\u00a0error,\u00a0which\u00a0is \u00a0prima\u00a0facie \u00a0visible\u00a0and\u00a0does\u00a0not\u00a0<br \/>\nrequire\u00a0any\u00a0detailed\u00a0examination.\u00a0\u00a0Mere\u00a0erroneous\u00a0view\u00a0of\u00a0law\u00a0is\u00a0not\u00a0a\u00a0<br \/>\nground\u00a0for\u00a0review.\u00a0\u00a0In\u00a0order\u00a0to\u00a0seek\u00a0review\u00a0of\u00a0the\u00a0order,\u00a0the\u00a0error\u00a0has\u00a0to\u00a0<br \/>\nbe \u00a0 an \u00a0 error \u00a0 or \u00a0 inadvertence \u00a0 and \u00a0 should \u00a0 be \u00a0 manifest \u00a0 on \u00a0 the \u00a0 face \u00a0 of\u00a0<br \/>\nrecord. \u00a0 \u00a0 Under \u00a0 the \u00a0 guise \u00a0 of \u00a0 review \u00a0 the \u00a0 parties \u00a0 are \u00a0 not \u00a0 entitled \u00a0 to\u00a0<br Supreme\u00a0Court\u00a0has\u00a0held\u00a0that\u00a0a\u00a0new\u00a0plea\u00a0cannot\u00a0be\u00a0allowed\u00a0to\u00a0be\u00a0raised\u00a0<br \/>\n          in \u00a0 the \u00a0 review\u00a0 permitted\u00a0to\u00a0raise\u00a0the\u00a0new\u00a0plea\u00a0which\u00a0was\u00a0not\u00a0raised\u00a0in\u00a0writ\u00a0appeal.\n<\/p>\n<p>
