Thakur, learned counsel for the<\/p>\n<p>                  petitioner, Mr. Ravi S. Pankaj, learned counsel for opposite<\/p>\n<p>                  party no. 2 and Mr. U.S.P. Singh, learned APP for the State.<\/p>\n<p>                            Petitioner files supplementary affidavit. Let it be<\/p>\n<p>                  kept on the record.\n<\/p>\n<p>                            It is submitted on behalf of the petitioner that the<\/p>\n<p>                  petitioner is ready to lead conjugal life along with the<\/p>\n<p>                  petitioner. However, it is urged on behalf of opposite party<\/p>\n<p>                  no. 2 that she is not being treated well, thus, she is not<\/p>\n<p>                  desirous of going with the petitioner. The petitioner has also<\/p>\n<p>                  stated that he is ready either to transfer half of his landed<\/p>\n<p>                  property in favour of the informant or alternatively, he is<\/p>\n<p>                  ready to pay Rs. 1000\/-(one thousand) per month by way of<\/p>\n<p>                  maintenance to opposite party no. 2. Learned counsel<\/p>\n<p>                  appearing on behalf of opposite party no. 2 submits that she<\/p>\n<p>                  will accept the proposed maintenance amount, however, the<\/p>\n<p>                  same should not preclude her from taking recourse to legal<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>remedy with regard to maintenance. Further, as has been<\/p>\n<p>earlier alleged by the opposite party no. 2 that her ornaments<\/p>\n<p>have been kept by the petitioner and by filing a<\/p>\n<p>supplementary affidavit dated 30.06.2010, the petitioner had<\/p>\n<p>undertaken to give the gold coin weighing 55 grams, the<\/p>\n<p>same also be given to the opposite party no. 2. Learned<\/p>\n<p>counsel for the petitioner, upon this, submits that since the<\/p>\n<p>petitioner is ready with the gold coin and as per his earlier<\/p>\n<p>undertaking given on oath, he would also hand it over to her<\/p>\n<p>at the time of depositing the amount of maintenance for the<\/p>\n<p>first month.\n<\/p>\n<p>          Considering the facts and circumstances of the<\/p>\n<p>case and in view of the affidavit filed on behalf of the<\/p>\n<p>petitioner as well as the undertaking given by the petitioner,<\/p>\n<p>the provisional bail earlier granted to the petitioner vide<\/p>\n<p>order dated 13.10.2009 by this Court is made absolute<\/p>\n<p>subject to the condition that the petitioner, as per the<\/p>\n<p>undertaking, shall hand over the gold coin weighing 55<\/p>\n<p>grams purchased from any recognised Bank or Post Office<\/p>\n<p>and deposit Rs. 1000\/- (one thousand) per month in the<\/p>\n<p>court concerned, which is in seisin of the trial. The<\/p>\n<p>maintenance amount as well as gold coin should be<br \/>\n<span class=\"hidden_text\">                        3<\/span><\/p>\n<p>     deposited in the first week of February 2011 before the<\/p>\n<p>     court concerned and thereafter the said amount should be<\/p>\n<p>     deposited in the first week of every subsequent month. The<\/p>\n<p>     opposite party no. 2 would be at liberty to withdraw the<\/p>\n<p>     same.\n<\/p>\n<p>               It is made clear that if the aforesaid undertaking<\/p>\n<p>     given by the petitioner is violated by him then the court<\/p>\n<p>     concerned would be at liberty to take steps for cancellation<\/p>\n<p>     of his bail bonds.
