This appeal is directed against the order of a Division<br \/>\nBench of the High Court of Andhra Pradesh passed in LPA\t No.<br \/>\n193 of 1993 upsetting the orders of a learned Single  Judge,<br \/>\npassed in breach of injunction proceedings.\n<\/p>\n<p>3.  The\t appellant  herein was injuncted by  the  court\t for<br \/>\nalienating  certain properties.\t According to the  appellant<br \/>\nbefore he was served with the injunction he had disposed  of<br \/>\nthose  properties.   The price fetched was Rs  75,000.\t The<br \/>\nbreach\tof  the injunction was reported to the\tHigh  Court.<br \/>\nThe<br \/>\n+   Arising out of SLP No. 17226 of 1993<br \/>\n<span class=\"hidden_text\">674<\/span><br \/>\nlearned\t Single Judge took the view that the  appellant\t had<br \/>\nevaded service of the injunction and had indulged in a\thide<br \/>\nand  seek  game and, therefore, deserved to  be\t dealt\twith<br \/>\nseverely.  The appellant was thus ordered to be detained  in<br \/>\ncivil  prison for three months.\t The appellant\tthen  showed<br \/>\ncause  to  the\tlearned\t Single\t Judge\tagainst\t the  action<br \/>\nordered.   He pleaded that he was not aware of the  issuance<br \/>\nof injunction and that the &#8216;refusal&#8217; recorded by the postman<br \/>\non the registered covered letter sent to him was wrong.\t The<br \/>\nlearned\t Single\t Judge\timpressed  by  the  version  of\t the<br \/>\nappellant  recalled  the  order\t of  detention\tand  ordered<br \/>\ninstead attachment of the sum of Rs 75,000, the price  which<br \/>\nthe  sold property had fetched, lying with the Vijaya  Bank,<br \/>\nSecunderabad.\tReflected inherently in the said  order\t was<br \/>\nrecall\tof the order of detention since the  court  effected<br \/>\nthe  said  attachment  and  directed  the  release  of\t the<br \/>\nappellant.  This view of the learned Single Judge was  upset<br \/>\nby  the Division Bench of the High Court in  Letters  Patent<br \/>\nAppeal\ttaking the view that it was not open to the  learned<br \/>\nSingle\tJudge  under  the guise of a review  to\t modify\t the<br \/>\nsentence  and order the appellant&#8217;s release  by\t exonerating<br \/>\nhim from his liability for flouting the injunction.\n<\/p>\n<p>4.   We\t do  not agree with the reasoning  of  the  Division<br \/>\nBench of the High Court.  Sub-rule (1) of Rule 2-A of  Order<br \/>\n39 of Civil Procedure Code reads as follows :\n<\/p>\n<blockquote><p>\t      &#8220;(1)  In\tthe  case  of  disobedience  of\t any<br \/>\n\t      injunction  granted or other order made  under<br \/>\n\t      Rule 1 or Rule 2 or breach of any of the terms<br \/>\n\t      on  which\t the injunction was granted  or\t the<br \/>\n\t      order   made,  of\t the  Court   granting\t the<br \/>\n\t      injunction  or making the order, or any  Court<br \/>\n\t      to   which   the\t suit\tor   proceeding\t  is<br \/>\n\t      transferred,  may\t order the property  of\t the<br \/>\n\t      person  guilty of such disobedience or  breach<br \/>\n\t      to be attached, and may also order such person<br \/>\n\t      to be detained in the civil prison for a\tterm<br \/>\n\t      not  exceeding  three months,  unless  in\t the<br \/>\n\t      meantime the Court directs his release.&#8221;\n<\/p><\/blockquote>\n<p>5.   The  orders  which\t the  court  could  pass  under\t the<br \/>\naforequoted  provision includes an order of recall since  it<br \/>\ncan  suspend the detention of the defaulter and\t direct\t his<br \/>\nrelease.   On  what terms would the court take such  a\tstep<br \/>\nwould  depend on the facts and circumstances of\t each  case.<br \/>\nNonetheless  it\t cannot ever be said that the court  had  no<br \/>\npower  to  pass\t related subsequent  orders  after  ordering<br \/>\ndetention  in civil prison of a defaulter.   Its  subsequent<br \/>\npowers,\t which are part and parcel of the  original  powers,<br \/>\ncannot be termed as review powers as has been viewed by\t the<br \/>\nDivision Bench of the High Court.  The order of the  learned<br \/>\nSingle Judge thus squarely fell within sub-rule (1) of\tRule<br \/>\n2-A of Order 39 of CPC; this being neither a case under\t the<br \/>\nContempt  of  Courts  Act, 1971 nor  a\tcriminal  or  quasi-<br \/>\ncriminal action.  This distinction needed to be kept in mind<br \/>\nwhen dealing with a matter under sub-rule (1) of Rule 2-A of<br \/>\nOrder 39 of Civil Procedure Code.\n<\/p>\n<p>6.   We are, therefore, of the view that the Division  Bench<br \/>\nwas  in error in upsetting the orders of the learned  Single<br \/>\nJudge.\t Accordingly,  we allow the appeal,  set  aside\t the<br \/>\nimpugned order of the Division Bench of the High<br \/>\n<span class=\"hidden_text\">675<\/span><br \/>\nCourt and restore that the learned Single Judge.
