Srivastava, JSERC<br \/>\n                                 Mr. Mokhtar Khan    CBI\n<\/p>\n<p>                                &#8212;-\n<\/p>\n<p>          Order No.220               Dated 14th September, 2011<\/p>\n<p>               Mr. Aparesh Kumar Singh, Amicus Curiae, has shown his<\/p>\n<p>   inability to appear in this case due to his personal reason, but after<\/p>\n<p>   knowing the personal reason, learned counsel appearing for the<\/p>\n<p>   Jharkhand State Electricity Board, the State and the Jharkhand State<\/p>\n<p>   Regulatory Commission as well as this Court are of the opinion that<\/p>\n<p>   Mr.Singh, Amicus Curiae, can continue to assist in this matter where<\/p>\n<p>   no personal interest of any body is involved, but in a public interest<\/p>\n<p>   litigation matter, there is no conflict of interest of learned counsel<\/p>\n<p>   with any of the parties, nor he has any favour or bias for any party.<\/p>\n<p>               Therefore, we expect that he may continue to assist this<\/p>\n<p>   Court in this matter.\n<\/p>\n<p>               This bulky file is not because of bulky petition but because<\/p>\n<p>   of the orders passed by this Court in the last ten years. If all the<\/p>\n<p>   orders are published, it will become a good book dealing with the<\/p>\n<p>   problems of electric supply in the State of Jharkhand and more<\/p>\n<p>   particularly only for the capital city of State of Jharkhand, Ranchi.<\/p>\n<p>               Be that it may be, we do not want to increase pages and<br \/>\n we confining to our last order dated 1.08.2011, whereby this Court<\/p>\n<p>directed the Regulatory Commission to submit interim report with<\/p>\n<p>respect to the measures taken for providing adequate and continuous<\/p>\n<p>supply of electricity to the people of the State of Jharkhand. The<\/p>\n<p>Commission was permitted to submit interim report and the<\/p>\n<p>Commission, in time, submitted the interim report, which we have<\/p>\n<p>perused. The Commission in its interim report submitted as under:<\/p>\n<blockquote><p>                           &#8220;The Commission feels that at present<br \/>\n                    there is no shortage of availability of power.<br \/>\n                    The problem is in the distribution network<br \/>\n                    which needs to be strengthened and proper<br \/>\n                    maintenance at regular intervals which has<br \/>\n                    been dealt with in (A) above in the report.<br \/>\n                    The Commission will continue to monitor<br \/>\n                    this.&#8221;<\/p><\/blockquote>\n<p>      The above observation clearly indicates that in the opinion of<\/p>\n<p>the Commission there is no shortage of power generation\/supply to<\/p>\n<p>the Jharkhand State Electricity Board; meaning thereby the electricity<\/p>\n<p>is available but we are of the opinion that public is not getting.<\/p>\n<p>      Learned counsel for the Commission submitted that in a short<\/p>\n<p>period of ten plus years, the Electricity Board has fourteen chairmen.<\/p>\n<p>This itself is a sorry state of affairs in the matter of governance<\/p>\n<p>relating to the most essential public service. Other suggestion given<\/p>\n<p>by the Commission are as under:\n<\/p>\n<p>      &#8220;Besides reorganization and restructuring of JSEB, which is sub-<\/p>\n<p>judice, the Commission feels that the following suggestions may have<\/p>\n<p>direct impact of the overall functioning of the JSEB:<\/p>\n<blockquote><p>      \u25cf Finalize and notify State Electricity Policy.\n<\/p><\/blockquote>\n<blockquote><p>      \u25cf Fixed tenure for the post of the Chairman of the Board.<\/p><\/blockquote>\n<p>      \u25cfBoard must consist of Technocrats                with   laid    down<br \/>\naccountability.\n<\/p>\n<p>      \u25cf Upgradation and augmentation of                 transmission    and<br \/>\ndistribution network on priority.\n<\/p>\n<p>      \u25cf Perform as service provider with professional approach.<br \/>\n       \u25cf Prefer out of Court settlement than litigation.<\/p>\n<p>      \u25cf Bill all collect All.\n<\/p>\n<p>      \u25cf Realization of dues from Government\/Private consumers.<\/p>\n<p>      Thereafter, the Commission has observed as follows:<\/p>\n<blockquote><p>                             &#8220;JSEB has to improve a lot to bring its<br \/>\n                      services at the optimum level and the<br \/>\n                      Commission is also consciences of this with<br \/>\n                      limited option it has, therefore, all<br \/>\n                      endeavours are being       made towards to<br \/>\n                      improve the functioning of the JSEB. The<br \/>\n                      Commission is also persuading other<br \/>\n                      licensees to apply for distribution license<br \/>\n                      and the Commission is not averse to grant<br \/>\n                      such parallel license if one fulfils the<br \/>\n                      requirements as envisaged under the Act.<br \/>\n                      The competition certainly enhances the<br \/>\n                      efficiency. Interest of bonafide consumers is<br \/>\n                      of    paramount     consideration   for   the<br \/>\n                      Commission.&#8221;\n<\/p><\/blockquote>\n<p>      Learned Advocate General appearing on behalf of Jharkhand<\/p>\n<p>State Electricity Board submitted that the Commission has submitted<\/p>\n<p>the interim report and let them submit final report.<\/p>\n<p>      We cannot wait for that and we direct the State Electricity<\/p>\n<p>Board to address on the issue with respect to the stability in the<\/p>\n<p>management of the Board and to come out with State Electricity<\/p>\n<p>Policy as has been desired by the Commission in its first point<\/p>\n<p>requiring finalization and notification of the State Electricity Policy.<\/p>\n<p>We expect that the State Electricity Board will cover all the issues<\/p>\n<p>and, therefore, the State Electricity Board and the State Government<\/p>\n<p>may come out with their plea whether they have framed the State<\/p>\n<p>Electricity policy and, if framed, it has been reviewed to make out up-<\/p>\n<p>to-date policy. If that policy is not there and yet they are desirous of<\/p>\n<p>framing that policy, then what steps they are proposing for notifying<\/p>\n<p>the State Electricity Policy.\n<\/p>\n<p>      We are passing this order giving an opportunity to the State<\/p>\n<p>Government and the Electricity Board to take all the management in<br \/>\n       relation to the electric supply to the public in their own hand from the<\/p>\n<p>      Court monitoring any Public Interest Litigation and in case there will<\/p>\n<p>      be no effective steps, the Court will have to continue with this Public<\/p>\n<p>      Interest Litigation treating that they have yet not come up to the<\/p>\n<p>      expectations of the Court in the matter of governance. The State and<\/p>\n<p>      the Electricity Board both may have their meetings to work out on the<\/p>\n<p>      issues referred above and submit their plea before this Court on or<\/p>\n<p>      before 17th October, 2011.\n<\/p>\n<p>                 Learned counsel for the Regulatory Commission drew our<\/p>\n<p>      attention to a fact that the Commission has already framed a draft<\/p>\n<p>      policy in the year 2007 and the said policy has been forwarded to the<\/p>\n<p>      State Government. This fact may also be taken note of by the State<\/p>\n<p>      Government and the State Electricity Board that they have got<\/p>\n<p>      sufficient time in coming out the State Electricity Policy.<\/p>\n<p>                 Put up these matters on 17.10.2011.\n<\/p>\n<p>                 Let copies of this order be given to the learned Amicus Curie,<\/p>\n<p>      counsel for the Electricity Board and Commission.<\/p>\n<p>                                                          (Prakash Tatia, C J)<\/p>\n<p>                                                                (P.P.
