 on 10.07.2005 when the claimant was<\/p>\n
 driving; the car on T. Mariyappa road, Bangalore a<\/p>\n
l”‘._VVlViahindra Scorpio bearing registration No.KA-05-MQ<\/p>\n
“0444 came in a rash and negligent manner and dashed<\/p>\n

against his car as a result the claimant sustained
\ngrievous injuries. Hence he \ufb01led a claim petition ‘before<\/p>\n
MACT, Bangalore seeking compensatio.fi<\u00ab.. '  _ of<\/p>\n

V  Tribunal is not just and reasonable, it<\/p>\n

A 5′  The claimant has sustained the following injuries:<\/p>\n
1) Fracture mid shaft of right femur;<\/p>\n
g.\n<\/p>\n<\/p>\n
ii) Lateral crush fracture fibula head —~ right,
\nfracture nasal bone and nasal bridge skin<\/p>\n
‘ laceration in RTA.\n<\/p>\n
Injuries sustained by him are evident from wound<\/p>\n
certi\ufb01cate Ex. P 6, discharge summaries Es.  8<\/p>\n
and P 16, CT Scab Ex P 9, clinical ‘notes E2_~:;;”‘P\u00ab’<\/p>\n
card Ex. P 11, and supported by oral of by<\/p>\n
claimant and the doctor examined A. Pas-,PW’s <\/p>\n
respectively. PW 2 Dr. W;iO\u00ab.__l.\\\/Iotianllinphirs <\/p>\n

\nSurgeon) examined  A   the hospital on<\/p>\n

 if  middle 1 \/3 of right thigh with
\n  .te11cfie:f:i;:ss,_ ‘ ‘<\/p>\n
 tenderness over proximal 1\/3 of
\nltibiaf’ V<\/p>\n
 of right femur showed fracture of right
\n.p  -._C’I’ scan right knee showed rnultisegrnent
\n fracture of tibral tuberustly, Abrasion
\nfrae’tU\u00a7re of posterio medical aspect of medical
\n.–__condyle of right femur, fracture of head and neck
\n~ V of right \ufb01bula. CT brain plain done showed nasal
\n“bone fracture. On examination he found the
\nfollowing disability:\n<\/p>\n
i) Permanent scar over right thigh and
\nupper leg<\/p>\n
ii) Mild limp on walking;\n<\/p>\n
iii) Terminal large of movements at right
\nknee restricted;\n<\/p>\n
iv] Gross antero–polteor laxity  mild<\/p>\n
mediolaterla laxity right  ‘knee,
\nPosterior guiciate ligament in_i,-Liry:–\u00ab_V A’<\/p>\n
V) Quadiceps wating<\/p>\n
vi) Disability:- faccordiynig -I’   9<\/p>\n

8. Considering the  of  .5{.7HOV,000\/\u00abV<\/p>\n
awarded by the Tribriiaal  and suffering is
\njust and proper and it  call.’lbiiy\u00e9lnhancement.<\/p>\n
9.  \/.e:’_ax_2g_ra.rcled by the Tribunal towards
\nmedical\u00bb.p:’expenses’  on the medical bills<\/p>\n
prcjiduced foruthe said sum, there is no scope for<\/p>\n
.  ‘enhancernent under this head.<\/p>\n
 _C~l:ai:l.nant was treated as inpatient in Sagar Apollo<\/p>\n
 AA Hospital for 6 days. Considering the same 110,000\/–~<\/p>\n
 ‘..V”‘a\\xrarded by the Tribunal towards incidental expenses<\/p>\n
such as conveyance, nourishment and attendant<\/p>\n

charges is just and proper and it does not call for<\/p>\n
enhancement.\n<\/p>\n
11. The claimant claims to have been <\/p>\n
of 158.000\/~ pm. by working as a  <\/p>\n
Corporation Limited, Jayanagar  <\/p>\n
at Mahalakshmi Corporatio_r1, N”agatharpet’,; <\/p>\n
on part time basis. But _produced any
\ndocument in that  thgaabsence of proof of
\nincome the Tribunal~’i1as:ffi\u00a7rhtiy  the income of
\nthe    Nature of injuries
\nsuggve.sts_t’hat he  under treatment and
\nrestiyiat  p’ of five months and I award
\nRs.20,CiC-\u00abQ\/’–v.  of income du ring Iaid up<\/p>\n
 a\u00a7ai’r1\u00abs.t__Rs.12,O00\/m awarded by the Tribunal.<\/p>\n
     has not stated that after sustaining<\/p>\n
iri-Jiuriesvhxe has been terminated from service. In the<\/p>\n
 ~ absence of the same it is to be presumed that he must<\/p>\n
hare been continued in the job and therefore question<\/p>\n
H awarding loss of future income does not arise.<\/p>\n
Nevertheless having sustained multiple fractures and<\/p>\n
crush injuries and an amount of discomfort and
\nunhappiness he has to bear in his future life I award
\nRs.50,000\/– towards loss of ainenities as against<\/p>\n
Rs.30,000\/– awarded by the Tribunal.<\/p>\n
13. Considering the multiple fractures ‘by<\/p>\n
the claimant it is just and proper to award_:}’.., <\/p>\n
towards future medical and  <\/p>\n
award the same.\n<\/p>\n
14. Thus the claimant   for'”the’V4 following
\ncompensation:\n<\/p>\n

15. ‘~ Vvllkioeordingly the appeal is allowed in part. The<\/p>\n
 “grnent and award of the Tribunal is modi\ufb01ed to the<\/p>\n
extend stated hereinabove. The claimant is entitled for<\/p>\n
a total compensation of 33,05,600\/– as against<\/p>\n

?.2,67,600\/- awarded by the Tribunal with interest at
\n6% pa. on the enhanced compensation of ?’.38,000\/
\nfrom the date of claim petition till the date of<\/p>\n
realisation.\n<\/p>\n

enhanced compensation with interest, <\/p>\n
