The other witnesses, including the<br \/>\nfather and brother of deceased Jamilaben, not having supported the<br \/>\nprosecution, the only evidence on which the prosecution relied for<br \/>\nproving the guilt of accused before the trial court is the so-called<br \/>\ndying declaration said to have been made by deceased Jamilaben before<br \/>\nDr. Hasumatiben Patel (PW-3).  The Trial Judge, however, did not find<br \/>\nthe said dying declaration truthful and genuine and, therefore, in<br \/>\nabsence of any other evidence connecting the accused with the crime,<br \/>\nacquitted them of all charges.\n<\/p>\n<p>\tWe<br \/>\nhave heard Mr. Maulik Nanavati, Additional Public Prosecutor, for the<br \/>\nState.  We have perused the judgment impugned before us and have gone<br \/>\nthrough the entire evidence on record.\n<\/p>\n<p>\tAt<br \/>\nthe outset, it has been fairly submitted by Mr. Nanavati, learned<br \/>\nCounsel for the State that there is no other cogent evidence except<br \/>\nthe oral dying declaration made by deceased Jamilaben before Dr.<br \/>\nPatel at the hospital for establishing the guilt of accused persons.<br \/>\nHe has, however, submitted that the said declaration is genuine and<br \/>\ntrustworthy, and is amply corroborated by the documentary and other<br \/>\nevidence adduced by the prosecution, and therefore can be relied upon<br \/>\nto found the conviction of accused persons.  He has further submitted<br \/>\nthat there is no reason for the doctor to falsely implicate the<br \/>\naccused or say something which was otherwise not informed to her by<br \/>\nthe deceased.  In support of his submission that dying declaration,<br \/>\nif found reliable, can be made the sole basis for conviction he has<br \/>\ncited several judgments of the Supreme Court and this High Court.<br \/>\nThere cannot be any dispute with the position of law but the moot<br \/>\nquestion is whether the dying declaration in the present case is<br \/>\nreliable and inspires confidence.\n<\/p>\n<p>\tJamila<br \/>\nwas brought to the hospital at 11:25am and died within 10 minutes at<br \/>\nabout 11:35am.  Dr. Patel (PW-3), on the day of incident, was<br \/>\nAssistant Police Surgeon at the Civil Hospital, Ahmedabad and she was<br \/>\nthe first one to examine Jamila when she was brought to the Casualty<br \/>\nDepartment by her father-in-law and husband.  Dr. Patel noticed that<br \/>\nJamila had severe third degree burns all over her body.  She was<br \/>\nwrithing with excruciating pain and gasping for breath.  Therefore,<br \/>\nshe instantaneously referred her to the emergency where she was<br \/>\nexamined by another doctor who made the following note on her case<br \/>\npaper:\n<\/p>\n<p>Pulse<br \/>\n\tnot palpable.\n<\/p>\n<p>B.P.\n<\/p>\n<p>\tnot recordable<\/p>\n<p>Pupils<br \/>\n\tbilaterally dilated and fixed, not reacting to light.\n<\/p>\n<p>Respiration<br \/>\n\tfast and shallow.\n<\/p>\n<p>Patient<br \/>\n\tis gasping.\n<\/p>\n<p>Heart<br \/>\n\trate 140 per minute.\n<\/p>\n<p>\tAbout<br \/>\n10 minutes later Jamila died.  Her case papers show a note that her<br \/>\nheart sound is absent and respiration is absent.  In the background<br \/>\nof this evidence which records the condition of deceased at the time<br \/>\nwhen she was brought to the hospital and the fact that within ten<br \/>\nminutes thereafter she died, we are in agreement with the conclusion<br \/>\narrived at by the Trial Judge that even if a statement had been made<br \/>\nby the deceased, it would be unsafe to rely on the same to convict<br \/>\nthe accused, especially in absence of any other corroborating<br \/>\nevidence.  We may note here that Dr. Patel in her cross examination<br \/>\nhas admitted that the mental condition of the patient was very badly<br \/>\naffected at the time when she was brought to the hospital and that<br \/>\nthe patient was not coherent in her speech.  Also, as per the<br \/>\nprosecution the incident is stated to have occurred at around 9:30am<br \/>\nand Mohmedkhan (PW-1), father of deceased, and Ayub (PW-2), brother<br \/>\nof deceased, who brought the deceased to the hospital have stated in<br \/>\ntheir evidence that Jamila had become unconscious after the incident<br \/>\nand had not regained consciousness thereafter till the time of her<br \/>\ndeath.  Under these circumstances, as rightly observed by the Trial<br \/>\nJudge, the possibility of doctor having confounded the statement made<br \/>\nby someone else as to what had happened as the statement made by<br \/>\ndeceased cannot be ruled out completely.  Lastly, in the E.P.R.<br \/>\nRegister maintained at the hospital, Dr. Patel has mentioned the name<br \/>\nof only accused Jayedaben and not accused Mehboobkhan.  As a<br \/>\ncumulative effect of all these circumstances, we are of the opinion<br \/>\nthat the dying declaration upon which the prosecution is relying is<br \/>\nnot convincing and free from such doubt as to make it the sole basis<br \/>\nfor convicting the accused in absence of any other independent and<br \/>\nreliable corroborating evidence.
