Justice C.K.ABDUL REHIM\n\n Dated :20\/12\/2010\n\n O R D E R\n                   C.K.ABDUL REHIM, J.\n\n                -------------------------------------------\n                  W.P.(C).No.37510 of 2010\n                -------------------------------------------\n\n          Dated this the 20th day of December, 2010\n\n\n                        J U D G M E N T\n<\/pre>\n<p>                        &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-\n<\/p>\n<p>           Aggrieved by Ext.P1 order of assessment the<\/p>\n<p>petitioner had preferred statutory appeal before the 2nd<\/p>\n<p>respondent as evidenced from Ext.P3.                      The appeal was<\/p>\n<p>filed along with Ext.P3 petition seeking condonation of<\/p>\n<p>delay.   Along with appeal the petitioner had also filed<\/p>\n<p>Ext.P4 and P5 petitions seeking stay and early hearing,<\/p>\n<p>respectively. According to the petitioner, the appeal as<\/p>\n<p>well as the accompanying applications are pending<\/p>\n<p>consideration and disposal before the 2nd respondent.<\/p>\n<p>Grievance of the petitioner is that without considering<\/p>\n<p>pendency of the appeal recovery steps has now been<\/p>\n<p>initiated on the basis of Ext.P6 notice issued under the<\/p>\n<p>provisions of the Kerala Revenue Recovery Act, 1968.<\/p>\n<p>Hence the petitioner seeks interference of this court to<\/p>\n<p>restrain the recovery steps till the disposal of the appeal.<\/p>\n<p>     2.   Considering pendency of the statutory appeal I<\/p>\n<p>W.P.(C).37510\/10-K             -2-\n<\/p>\n<p>am of the view that the writ petition can be disposed of<\/p>\n<p>directing the appellate authority to take expeditious steps<\/p>\n<p>for consideration of the matter.\n<\/p>\n<p>      3.    In the result the writ petition is disposed of<\/p>\n<p>directing the 2nd respondent to consider and pass orders on<\/p>\n<p>Ext.P3 application filed seeking condonation of delay, after<\/p>\n<p>affording an opportunity of hearing to the petitioner, as<\/p>\n<p>early as possible, at any rate within a period of one month<\/p>\n<p>from the date of receipt of a copy of this judgment.<\/p>\n<p>      4.    If delay is condoned and appeal is registered on<\/p>\n<p>files, then the 2nd respondent shall consider and pass orders<\/p>\n<p>on Ext.P4 stay petition, simultaneously.<\/p>\n<p>      5.    Till such time orders are passed by the 2nd<\/p>\n<p>respondent as directed above, recovery of amounts covered<\/p>\n<p>under Ext.P1 which is initiated on the basis of Ext.P6 notice<\/p>\n<p>shall be kept in abeyance.\n<\/p>\n<p>      6.
