Songara, learned advocate appearing for the petitioner and<br \/>\n\tperused the award passed by the Labour Court as well as documents<br \/>\n\tattached with the petition.\n<\/p>\n<p>It<br \/>\n\tis the case of the petitioner that the petitioner was working as a<br \/>\n\tdriver with respondent No.2, for last about 5 years.  Before his<br \/>\n\torder of termination, he met with an accident during the course of<br \/>\n\temployment on 10.10.2005 and he was not able to drive the vehicle.<br \/>\n\tHe had, therefore, submitted leave report alongwith medical<br \/>\n\tcertificate.  Thereafter, on 10.11.2005 he resumed his duty<br \/>\n\talongwith fitness certificate, however, he was not allowed to report<br \/>\n\tfor duty.  The petitioner again reported for duty on 23.11.2005 with<br \/>\n\tall medical papers and the petitioner was not allowed to resume his<br \/>\n\tduty. Thereafter, he approached the Labour Commissioner for<br \/>\n\tconciliation and on failure of conciliation proceeding, reference<br \/>\n\twas filed being Reference No.33\/2006, wherein he has filed Statement<br \/>\n\tof Claim. On behalf of the respondents, written statement was filed<br \/>\n\tand ultimately after considering the evidence on record, the Labour<br \/>\n\tCourt has dismissed the reference on the ground that the petitioner<br \/>\n\thas himself left the service and there was no question of<br \/>\n\ttermination of service by the respondent employer.\n<\/p>\n<p>It<br \/>\n\tis this award which is under challenge in the present petition.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tSongara, learned advocate appearing for the petitioner has submitted<br \/>\n\tthat the Labour Court has not considered the evidence on record in<br \/>\n\tits true perspective. Despite the fact that the respondent&#8217;s<br \/>\n\tfitness, Mr. Viral Rajnikant Das has deposed before the Court that<br \/>\n\tthe petitioner has submitted the leave report along with medical<br \/>\n\tcertificate, it is observed by the Labour Court that no documentary<br \/>\n\tevidence was produced by the petitioner with regard to his leave<br \/>\n\treport as well as medical certificate.  He has further submitted<br \/>\n\tthat on 23.11.2005, the petitioner has reported his duty. As per the<br \/>\n\trespondent&#8217;s instruction, he went on 24.11.2005 to Gujarat State<br \/>\n\tPetronet Limited, however, he was not allowed to work there. He has,<br \/>\n\ttherefore, submitted that the petitioner&#8217;s services were orally<br \/>\n\tterminated by the respondents without complying with the provisions<br \/>\n\tof Industrial Disputes Act and hence the Labour Court has committed<br \/>\n\ta grave error in dismissing the reference preferred by the<br \/>\n\tpetitioner.\n<\/p>\n<p>Having<br \/>\n\theard, learned counsel appearing for the petitioner and having gone<br \/>\n\tthrough the impugned award alongwith evidence on record, the Court<br \/>\n\tis of the view that a contrary stand is taken by the petitioner in<br \/>\n\this statement of claim as well as in his evidence before the Labour<br \/>\n\tCourt.  In his statement of claim, he has stated that his services<br \/>\n\twere terminated orally on 10.10.2005.  However, the petitioner was<br \/>\n\tmet with an accident, thereafter he reported his duty on 11.11.2005.<br \/>\n\tHe again reported on 23.11.2005, hence there is no question of<br \/>\n\ttermination of services, however, petitioner is orally terminated on<br \/>\n\t10.10.2005. It has also come on record that the respondent employer<br \/>\n\thas issued a letter on 30.11.2005, directing the petitioner to<br \/>\n\treport his duty, no reply has been given by the petitioner to the<br \/>\n\tsaid letter.  The petitioner has submitted before the Labour Court<br \/>\n\tthat no one remain present on behalf of the employer before the<br \/>\n\tconcerned Assistant Labour Commissioner.  However, specific letter<br \/>\n\twas written by the respondent employer on 10.01.2006, wherein the<br \/>\n\tentire facts were reiterated and it was clearly stated that the<br \/>\n\trespondent employer has specifically asked the petitioner to report<br \/>\n\tto his duty on 24.11.2005, however, till that date he did not report<br \/>\n\tto the duty.  It is further stated that the respondent was paid the<br \/>\n\tbonus as well as salary which were accepted by him.  Purshis filed<br \/>\n\tby the petitioner before the Labour Court does not appear to be<br \/>\n\tcorrect.  Wrong facts were stated in the said purshis.  Despite the<br \/>\n\tfact that on behalf of the respondent employer a letter was written<br \/>\n\tand a representative of the respondent employer remained present<br \/>\n\tbefore the Assistant Labour Commissioner, in the purshis he stated<br \/>\n\tthat no one remained present and for the first time in the reference<br \/>\n\tproceeding, a stand is taken to that effect.\n<\/p>\n<p>Considering<br \/>\n\tall the above aspects of the matter, the Labour Court has rightly<br \/>\n\tobserved in its award that the petitioner was not dismissed from<br \/>\n\tservice by the respondent employer.
