JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/08\/2008 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThis<br \/>\npetition has been filed by the petitioner, with the following<br \/>\nprayers:\n<\/p>\n<p> (A)<br \/>\nYour Lordships be pleased to issue a writ or order or direction,<br \/>\nquashing the impugned order at Annexure :A dated 2nd<br \/>\nNovember, 1999<\/p>\n<p>(B)\tYour<br \/>\nLordships be pleased to stay the implementation of the order dtd.2nd<br \/>\nNovember, 1999 and direct the Executive Engineer, Medium Irrigation<br \/>\nScheme,Ankleshwar, not to relieve the petitioner from the Post of<br \/>\nSenior Clerk;\n<\/p>\n<p>(C<br \/>\n)\tPending admission, hearing and final disposal of this petition;<br \/>\ngrant such other and further relief\/s that may be deemed fit and<br \/>\nproper in the facts and circumstances of the case in the interest of<br \/>\njustice.\n<\/p>\n<p>2.\tThe<br \/>\nbrief facts of the case, as emerging from a perusal of the averments<br \/>\nmade in the petition, are that the petitioner, who was at the<br \/>\nrelevant period of time, serving as Senior Clerk at Ankleshwar, was<br \/>\ntransferred by the impugned order dated 2-11-1999, to Palanpur.<br \/>\nAccording to the petitioner, Palanpur is at a distance of more than<br \/>\n400 Kms. from Ankleshwar and since, the transfer has been made in the<br \/>\nacademic term of the children of the petitioner, he is put to great<br \/>\nhardship and, therefore, the impugned order deserves to be quashed<br \/>\nand set aside.\n<\/p>\n<p>3.\tMr.R.A.Patel,<br \/>\nlearned counsel for the petitioner, submits that even though the<br \/>\nimpugned transfer order has been issued under the pretext of<br \/>\nadministrative exigency, the said order has caused hardship to the<br \/>\npetitioner, who has two daughters and one son, who were studying in<br \/>\nCollege and School and, therefore, it is very difficult for the<br \/>\npetitioner to move from one place to the other. It is further alleged<br \/>\nthat the transfer has been made on the basis of a vague letter<br \/>\nwritten by someone else, whose interest is not being fulfilled by the<br \/>\npetitioner and, therefore, the impugned order of transfer has not<br \/>\nbeen passed on the ground of administrative exigency and is liable to<br \/>\nbe quashed and set aside.\n<\/p>\n<p>4.\tAn<br \/>\naffidavit-in-reply has been filed by the respondent No.2 wherein it<br \/>\nis stated that the allegation that the transfer of the petitioner has<br \/>\nbeen effected due to some vested interest is wrong and misleading and<br \/>\nis not supported by any material on record. It is further stated that<br \/>\nthe transfer of the petitioner has been effected due to<br \/>\nadministrative reasons and as far as the academic term of the<br \/>\nchildren of the petitioner is concerned, the court has taken care of<br \/>\nthe same by passing order dated 15-2-2000.\n<\/p>\n<p>5.\tI<br \/>\nhave heard Mr.R.A.Patel,learned counsel  for the petitioner and<br \/>\nMr.K.L.Pandya,learned Assistant Government Pleader for the<br \/>\nrespondents.\n<\/p>\n<p>6.\tIt<br \/>\nis relevant to notice that this court (Coram:Miss.R.M.Doshit,J) by<br \/>\norder dated 15-2-2000 has directed that the implementation and<br \/>\noperation of the impugned order of transfer dated 2-11-1999 shall<br \/>\nremain stayed till 30-4-2000. A perusal of the order of the court<br \/>\nshows that it has been passed keeping in mind the fact that the<br \/>\ntransfer of the petitioner has been made in the midst of the academic<br \/>\nterm, which will adversely affect the education of his children. It<br \/>\nhas been categorically stated in the said order that the<br \/>\nimplementation of the transfer order shall remain stayed till<br \/>\n30-4-2000,  meaning thereby that the respondents shall permit the<br \/>\npetitioner to resume duty at Ankleshawr, restoring the status quo<br \/>\nante, till 30-4-2000. Mr.K.L.Pandya, learned Assistant Government<br \/>\nPleader has produced a copy of the order dated 29-4-2000 issued by<br \/>\nthe respondent No.2 whereby the petitioner has been directed to join<br \/>\nhis duties at Palanpur, on 1-5-2000.\n<\/p>\n<p>7.\tIt<br \/>\nis a settled position of law as held by the Supreme Court in <a href=\"\/doc\/220487\/\">Union<br \/>\nof India v. S.L.Abbas, AIR<\/a> 1993 SC 2444 that  Who should be<br \/>\ntransferred where, is a matter for the appropriate authority to<br \/>\ndecide. Unless the order of transfer is vitiated by mala fides or is<br \/>\nmade in violation of any statutory provisions, the Court cannot<br \/>\ninterfere with it.  Transfer is an incidence of service and the<br \/>\nemployer is the best person to decide where  the services of the<br \/>\nemployee are to be placed. As long as the transfer of the employee is<br \/>\nnot in violation of any statutory rule or motivated by malafide<br \/>\nintention, the courts, normally, shall refrain from interfering with<br \/>\nthe same. In the present case, although vague allegations of malafide<br \/>\nhave been raised but, they are totally un-substantiated and there is<br \/>\nno material on record to show that the transfer of the petitioner has<br \/>\nbeen effected for any reason otherwise than that of administrative<br \/>\nexigency.\n<\/p>\n<p>8.\tThe<br \/>\nmain thrust of the argument of the learned counsel  for the<br \/>\npetitioner is that the place of transfer i.e. Palanpur is 400 Kms.<br \/>\naway from Ankleshwar and the impugned order of transfer will disturb<br \/>\nthe eduction of his children as it has been made in the midst of the<br \/>\nacademic session. As has been noticed above, this Court  by order<br \/>\ndated 15-2-2000 has taken care of the situation and has directed that<br \/>\nthe implementation of the impugned order of transfer shall remain<br \/>\nstayed till 30-4-2000. By efflux of time, the impugned order no<br \/>\nlonger survives and, as is clear from order dated 29-4-2000, whereby<br \/>\nthe petitioner has been directed to join at Palanpur on 1-5-2000. The<br \/>\npetitioner has no vested right to remain posted at a particular<br \/>\nplace, especially as the reason for impugning the transfer that is<br \/>\nthe mid-academic sessions of his children, no longer survives. There<br \/>\nis no merit in the petition which deserves dismissal.\n<\/p>\n<p>9.\tIt<br \/>\nis, accordingly, dismissed. Rule is discharged.
