Local Bodies Lko. And Another\nPetitioner Counsel :- Mohd. Yusuf\nRespondent Counsel :- C.S.C.,A.T. Kulshrestra\n\nHon'ble Arun Tandon,J.\n<\/pre>\n<p>The Executive Officer under the impugned order dated<br \/>\n26.05.2010 has rejected the petitioner&#8217;s representation and<br \/>\nhas informed the petitioner that he shall attain the age of<br \/>\nretirement i.e. 60 years on 30.04.2010.\n<\/p>\n<p>The petitioner had earlier approached this Court by means of<br \/>\nCivil Misc. Writ Petition No. 22482 of 2010 raising a<br \/>\ngrievance that his date of birth as recorded in the service<br \/>\nrecord is 15.04.1955, therefore, the notice issued informing<br \/>\nthe petitioner that he shall retire on 30.04.2010 is bad.<br \/>\nThe writ Court permitted the petitioner to represent his<br \/>\ngrievance before respondent no. 3. It is in pursuance to the<br \/>\nsaid order that the impugned order has been passed. The<br \/>\nExecutive Engineer has enclosed a copy of the medical<br \/>\nreport at the time of appointment of the petitioner dated<br \/>\n14.04.1980 on which the petitioner had affixed his thumb<br \/>\nimpression as also a copy of the service book wherein the<br \/>\ndate of birth of the petitioner is stated to have been<br \/>\nmanipulated.\n<\/p>\n<p>The order is being challenged on the ground that the<br \/>\nallegation of manipulation is totally unfounded and that the<br \/>\nreport of the Chief Medical Officer has wrongly been relied<br \/>\nupon.\n<\/p>\n<p>In the facts of the present case, I am of the considered<br \/>\nopinion that pure issues of fact with regard to the exact date<br \/>\n of birth are involved which needs examination of oral as well<br \/>\nas documentary evidence.\n<\/p>\n<p>At this stage counsel for the petitioner submitted that he may<br \/>\nbe granted liberty to approach the respondent no. 1 for<br \/>\nventilating her grievances, instead of the matter being<br \/>\nexamined by this Court any further.\n<\/p>\n<p>In view of the aforesaid statement made by the petitioner, the<br \/>\npresent writ petition is disposed of with liberty to the petitioner<br \/>\nto make a representation ventilating all her grievances before<br \/>\nrespondent no. 1, within two weeks from today, along with a<br \/>\ncertified copy of this order.
