Shah, learned counsel for the appellant and Mr.H.L. Jani,<br \/>\n\tlearned Additional Public Prosecutor for the respondent-State.\n<\/p>\n<p>Even<br \/>\n\tBoard shows that Rule is unserved upon respondent Nos.1 to 7.\n<\/p>\n<p>Sufficient<br \/>\n\ttime was given to the applicant as also opportunities were also<br \/>\n\tgiven to the applicant. The applicant has tried to serve the<br \/>\n\trespondent Nos.1 to 7, but due to unavoidable circumstances, he<br \/>\n\tcould not serve the respondent Nos.1 to 7.\n<\/p>\n<p>Heard<br \/>\n\tMr.H.L. Jani, learned Additional Public Prosecutor for the<br \/>\n\trespondent-State and also perused papers. From the perusal of the<br \/>\n\tpapers it appears that the learned Judge has not committed any error<br \/>\n\tin passing the order of acquittal. In my opinion, when there is<br \/>\n\tnothing on record to say that the learned Judge has committed error<br \/>\n\tin acquitting the respondent Nos.1 to 7, cannot be considered<br \/>\n\tagainst the respondent Nos.1 to 7. Even I have not found any<br \/>\n\tsubstance in the application to condone delay of 234 days caused in<br \/>\n\tpreferring the appeal.\n<\/p>\n<p>In<br \/>\n\tview of above, present application deserves to be dismissed and is<br \/>\n\thereby dismissed.
