Shah, learned Additional Public Prosecutor, waives<br \/>\n\tservice of notice of Rule on behalf of the respondent-State.\n<\/p>\n<p>By<br \/>\n\tway of present application the applicant has prayed to release him<br \/>\n\ton temporary bail for a period of 30 days in connection with C.R.<br \/>\n\tNo.I-121 of 2010 registered with Pandesara Police Station on the<br \/>\n\tground of surgery of his father, which is likely to be performed on<br \/>\n\t29th September, 2011. The father of the applicant is<br \/>\n\tsuffering from acute liver abscess and as per the Certificate issued<br \/>\n\tby CMO, Govind-Prabha Arogya Sankool, Surat certifying the disease<br \/>\n\tand date of operation. The applicant submits that his presence is<br \/>\n\tnecessary at the time of operation and even for post treatment also.\n<\/p>\n<p>Heard<br \/>\n\tMs.Chetna Shah, learned Additional Public Prosecutor appearing for<br \/>\n\tthe respondent-State and also perused papers produced before me.\n<\/p>\n<p>It<br \/>\n\tappears from the papers that father of the applicant is suffering<br \/>\n\tfrom acute liver abscess and as per the Certificate issued by CMO,<br \/>\n\tGovind-Prabha Arogya Sankool, Surat, operation of the father of the<br \/>\n\tapplicant is planned on 29th September, 2011 and presence<br \/>\n\tof the applicant is necessary.\n<\/p>\n<p>Hence,<br \/>\n\tin view of above, present application is partly allowed. The<br \/>\n\tapplicant is ordered to be released on temporary bail from tomorrow,<br \/>\n\ti.e. 29th September, 2011 in the morning hours, to 08th<br \/>\n\tOctober, 2011 on the usual terms and conditions, which may deem fit<br \/>\n\tand proper by the Jail Authority. The applicant is directed to<br \/>\n\tsurrender himself before the Jail Authority on 08th<br \/>\n\tOctober, 2011 before 17.00 hours.
