Jani, learned Additional Public Prosecutor waives service of<br \/>\nrule on behalf of the respondent-State.\n<\/p>\n<p>\tConsidering<br \/>\nthe rival submissions, I am of the considered view that prayer as set<br \/>\nout in paragraph 5(A) is required to be granted.\n<\/p>\n<p>\tCondition<br \/>\nNo.5 imposed by order dated 21.02.2008 shall be kept in abeyance for<br \/>\na further period of six months commencing from today, i.e. 15th<br \/>\nFebruary 2011.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. Nayak has produced the passports of the applicants<br \/>\nbefore this court and explained the situation as to why it could not<br \/>\nbe produced before the lower court. Non-production of the passport<br \/>\nbefore the lower court is condoned and the passports are returned to<br \/>\nlearned Advocate for the applicants. However, after expiry of the<br \/>\nperiod of six months granted by this order, the applicants shall<br \/>\ndeposit their passports before the lower court without fail.\n<\/p>\n<p>\tThis<br \/>\napplication is allowed accordingly.\n<\/p>\n<p>\tRule<br \/>\nis made absolute accordingly.\n<\/p>\n<p>\tDirect<br \/>\nService is permitted.\n<\/p>\n<p>mathew<br \/>\n\t\t\t\t\t[H.B.
