The<br \/>\njudgment-debtor happens to be the brother of the appellant, the<br \/>\nobjector.\n<\/p>\n<p>\tDuring<br \/>\nthe course of hearing, it transpires that the execution was in<br \/>\nrespect of movable properties lying in the house of the objector i.e.<br \/>\nthe present appellant. But, because of the house was found to be<br \/>\nlocked, it was sealed.\n<\/p>\n<p>\tA<br \/>\nconsensus is arrived at between the appellant and the respondent that<br \/>\nthe appellant has no objection if the belongings of the<br \/>\njudgment-debtor lying in the premises are taken away pursuant to the<br \/>\norder of the Court and the respondent does not insist upon continuing<br \/>\nthe seal on the property if the execution is permitted by permitting<br \/>\nthe respondent to take away the belongings of the judgment-debtor,<br \/>\nthe husband of the respondent and the brother of the appellant.\n<\/p>\n<p>\tSince<br \/>\nthe respondent does not seems to have given an inventory of the<br \/>\nproperty of the ownership of her husband, the brother of the<br \/>\nappellant, a dispute may arise as to who is the owner of the movables<br \/>\nthat would found in the house. To avoid any dispute on this, the<br \/>\nappellant was asked to give list of her movable belongings lying in<br \/>\nthe house, which is sealed. The list is as under:\n<\/p>\n<p>T.V.\n<\/p>\n<p>\tStand;\n<\/p>\n<p>Sofa<br \/>\n\tSet;\n<\/p>\n<p>Two<br \/>\n\tWooden Cots;\n<\/p>\n<p>Two<br \/>\n\tMattresses with Pillows and Bedsheets;\n<\/p>\n<p>Old<br \/>\n\tSarees and Dresses; and<\/p>\n<p>Utensils,<br \/>\n\ton which the name of the appellant or her husband&#8217;s name is<br \/>\n\tengraved.\n<\/p>\n<p>\tThis<br \/>\nbroad inventory of the belongings of the appellant would be allowed<br \/>\nto remain untouched at the time when the seal is opened by the Court<br \/>\nOfficer in presence of panch witnesses and, other belongings of the<br \/>\nbrother of the appellant and the husband of the respondent, if any,<br \/>\nfound in the premises would be permitted to be taken in execution of<br \/>\nthe award.
