JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n\t\t\t\tDate\n: 08\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\napplication has been filed with a prayer to permit the applicants,<br \/>\nbeing heirs and legal representatives of the deceased petitioner of<br \/>\nSpecial Civil Application No.9016 of 1998, to be brought on the<br \/>\nrecord of the said petition, as petitioners.\n<\/p>\n<p>2.\tHeard<br \/>\nMr. Umang Oza, learned advocate for Mr. B.S. Patel, learned counsel<br \/>\nfor the applicants and perused the averments made in the application.\n<\/p>\n<p>3.\tIt<br \/>\nis stated in the application that Shri Navinchandra Amrutlal Shah,<br \/>\nthe petitioner, who filed Special Civil Application No.9016 of 1998,<br \/>\nexpired on 18.12.2010. A copy of the Death Certificate is annexed as<br \/>\nAnnexure-&#8216;A&#8217; to the petition. Applicant No.1 is the widow of deceased<br \/>\nNavinchandra Amrutlal Shah and applicant No.2 is his son, whereas<br \/>\napplicants Nos.3 and 4 are daughters of the deceased-original<br \/>\npetitioner. It is further stated that except for the above, there are<br \/>\nno other heirs of the deceased petitioner, therefore, the applicants<br \/>\nmay be brought on the record of the petition.\n<\/p>\n<p>4.\tHeard<br \/>\nthe learned advocate for the applicants. In view of the averments<br \/>\nmade in the application and as there is no delay in filing the<br \/>\napplication, the prayers made therein deserve to be granted.\n<\/p>\n<p>5.\tAccordingly,<br \/>\nthe application is allowed.
