Opposite parties\n\n                              ----------\n\nHon'ble Rajiv Sharma, J.\n<\/pre>\n<p>        Heard learned counsel for the parties.\n<\/p>\n<p>        In nutshell, the case of the petitioner is that by the order<br \/>\ndated 7.4.1990, the petitioner was appointed as Junior Clerk. The<br \/>\npetitioner submitted his joining report on 12.4.1990. Since then,<br \/>\ntill passing of the impugned order, the petitioner has continuously<br \/>\nbeen working efficiently and diligently without giving any chance<br \/>\nof complaint to anybody. All of a sudden, the impugned order<br \/>\ndated 4.1.1991 has been passed cancelling the appointment of<br \/>\nthe petitioner.\n<\/p>\n<p>        Learned Counsel for the petitioner submits that the order<br \/>\ncancelling the appointment of the petitioner, after such a long<br \/>\ntime and without giving him an opportunity of hearing is legally<br \/>\nunsustainable. The petitioner has continuously worked for more<br \/>\nthan 240 days and as such, the impugned order violates the<br \/>\nprovisions of Industrial Disputes Act as the petitioner is workman<br \/>\nalso.\n<\/p>\n<p>        Rebutting the arguments of the learned counsel for the<br \/>\npetitioner, learned Standing Counsel submits that the appointment<br \/>\nof the petitioner was an illegal appointment, as the committee,<br \/>\nwhich was constituted for selection was not properly constituted<br \/>\nand was not in accordance with the relevant Government Order.<br \/>\nHence, the petitioner could not be treated as properly selected<br \/>\ncandidate. No approval of the District Magistrate or nominate of<br \/>\nthe District Magistrate was taken in the Selection Committee. In<br \/>\nthis way, the whole process of selection and constitution of<br \/>\nselection committee was illegal, hence the order of appointment is<br \/>\nnot tenable. As the appointment of the petitioner is not valid in<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>the eyes of law, question does not arise for providing opportunity<br \/>\nor one month&#8217;s notice before relieving him from his work or<br \/>\ncancelling the illegal appointment. Since the U. P. Temporary<br \/>\nEmployees Termination of Service Rules, 1975 were not applicable<br \/>\nin the case of the petitioner, as his services were not terminated,<br \/>\nbut due to his illegal appointment his appointment was cancelled.<br \/>\nTherefore, he pleads for dismissal of the writ petition.\n<\/p>\n<p>      While entertaining the writ petition, this Court on 15.1.1991<br \/>\nstayed the operation and implementation of the impugned orders,<br \/>\ncontained in Annexure Nos.4 and 5. Further, the opposite parties<br \/>\nwere directed to allow the petitioner to continue in service and<br \/>\npay salary accordingly.\n<\/p>\n<p>      Natural justice is the essence of fair adjudication, deeply<br \/>\nrooted in tradition and conscience to be ranked as fundamental.<br \/>\nThe purpose of following the principles of natural justice is the<br \/>\nprevention of miscarriage of justice.\n<\/p>\n<p>      Besides, natural justice is an inseparable ingredient of<br \/>\nfairness and reasonableness. It is even said that the principles of<br \/>\nnatural justice must be read into unoccupied interstices of the<br \/>\nstatute, unless there is a clear mandate to the contrary.\n<\/p>\n<p>       The Hon&#8217;ble Supreme Court in iota of cases has reiterated<br \/>\nthat a person who is put to any harm, he shall first be afforded<br \/>\nadequate opportunity of showing cause. In D.K. Yadav Vs.<br \/>\nJ.M.A. Industries; (1993) 3 SCC 259 the Supreme Court while<br \/>\nlaying emphasis on affording opportunity by the authority which<br \/>\nhas the power to take punitive or damaging action held that<br \/>\norders affecting the civil rights or resulting civil consequences<br \/>\nwould have to answer the requirement of Article 14. The Hon&#8217;ble<br \/>\nApex Court concluded as under:-\n<\/p>\n<blockquote><p>             &#8220;The procedure prescribed for depriving a<br \/>\n      person of livelihood would be liable to be tested on<br \/>\n      the anvil of Article 14. The procedure prescribed by<br \/>\n      a statute or statutory rule or rules or orders<br \/>\n      affecting the civil rights or result in civil<br \/>\n      consequences would have to answer the<br \/>\n      requirement of Article 14. Article 14 has a<br \/>\n      pervasive procedural potency and versatile quality,<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>       equalitarian in its soul and principles of natural<br \/>\n       justice are part of Article 14 and the procedure<br \/>\n       prescribed by law must be just, fair and<br \/>\n       reasonable, and not arbitrary, fanciful or<br \/>\n       oppressive.&#8221;<\/p><\/blockquote>\n<p>       Keeping the above aspects of the matter in view, the writ<br \/>\npetition is allowed and the impugned orders dated 3.1.1991 and<br \/>\n4.1.1991 are hereby quashed.
