Justice V.GIRI\n\n Dated :08\/05\/2009\n\n O R D E R\n                        V.GIRI, J\n                      -------------------\n                  W.P.(C).13245\/2009\n                      --------------------\n         Dated this the 8th day of May, 2009\n\n                      JUDGMENT\n<\/pre>\n<p>      Petitioner challenges Ext.P3 order by which his<\/p>\n<p>application for construction of a building in his<\/p>\n<p>property, was rejected by the Municipality        on the<\/p>\n<p>ground that the said land might be required for an<\/p>\n<p>acquisition at a later point of time. Petitioner refers<\/p>\n<p>to the judgment in <a href=\"\/doc\/1115418\/\">Padmini v. State of Kerala<\/a><\/p>\n<p>(1999 (3) KLT, 465) and other judgments which<\/p>\n<p>have taken the same view. In my view, it is not<\/p>\n<p>necessary for this Court to consider the contentions<\/p>\n<p>of the petitioner at this stage. Ext.P3 is appealable<\/p>\n<p>before the Tribunal.
