Vadodara dated 27.10.2009 in<br \/>\n\tM.A.C.P. No. 304 of 2006. The impugned order has been passed in<br \/>\n\tapplication under Section 140 of the Motor Vehicle Act whereby the<br \/>\n\tlearned Tribunal has awarded Rs.50,000\/- in view of the  no<br \/>\n\tfault liability  Clause.\n<\/p>\n<p>Mr.MTM<br \/>\n\tHakim, learned advocate for the defendants, has entered appearance<br \/>\n\tfor Opponent nos. 1, 2 and 3 i.e. the widow, the daughter and the<br \/>\n\tson of the deceased.\n<\/p>\n<p>In<br \/>\n\tview of the contentions raised in the application, it is appropriate<br \/>\n\tand necessary to hear and decide the same finally at this stage.<br \/>\n\tHence, admit.\n<\/p>\n<p>Mr.MTM<br \/>\n\tHakim, learned advocate for the Orig.defendants, waives service of<br \/>\n\tnotice of admission. So far as the Defendant No.4 is concerned, Mr.<br \/>\n\tSunil B. Parikh, learned advocate for the appellant submitted that<br \/>\n\tthe process could not be served qua the Defendant no.4. The<br \/>\n\tappellant has submitted that the interest of Opponent No.4 would not<br \/>\n\tbe adversely affected if the relief as prayed for by the Appellant<br \/>\n\tin present appeal is granted. Considering the order, which is<br \/>\n\tproposed to be passed, the appellant appears to be right in his<br \/>\n\tsubmission.  Hence, the appeal is, with the consent of learned<br \/>\n\tadvocate for both the sides who have entered appearance is taken-up<br \/>\n\tfor final decision.\n<\/p>\n<p>It<br \/>\n\tis the case of the appellant that the appellant had raised<br \/>\n\tsubstantial contention and defence before the learned Tribunal even<br \/>\n\tat the time of hearing of the application under Section 140 of the<br \/>\n\tMotor Vehicle Act. So far as the the contention raised by the<br \/>\n\tappellant raising dispute about the involvement of the vehicle<br \/>\n\t(truck) bearing Registration No. RJ-07-G-3039 in the accident (in<br \/>\n\twhich the husband of present Defendant no.1 has expired), it has to<br \/>\n\tbe noted that the appellant appears to have raised contention before<br \/>\n\tthe Tribunal that the vehicle insured by it was not involved in the<br \/>\n\taccident in question. Differently put, the Appellant-Insurance<br \/>\n\tCompany had raised a  contention before the learned Tribunal that it<br \/>\n\twas not the insurer of the truck allegedly  involved in the<br \/>\n\taccident. The appellant Insurance Company also appears to have<br \/>\n\traised a contention that the claim petition was fraudulent and was<br \/>\n\tfiled with malafide intention of extracting money from Insurance<br \/>\n\tCompany.\n<\/p>\n<p>The<br \/>\n\tappellant has alleged that though the contention was raised the<br \/>\n\tlearned Tribunal has proceeded to pass the impugned order without<br \/>\n\taddressing the said contention. Mr.Parikh has submitted that the<br \/>\n\tspecific contentions raised by the Appellant-Insurance Company have<br \/>\n\tnot been dealt with by the learned Tribunal before passing the<br \/>\n\timpugned award and the statutory defence raised by the Insurance<br \/>\n\tCompany have not been taken into account. It is submitted that the<br \/>\n\timpugned award is therefore, bad in law and contrary to the law laid<br \/>\n\tdown by the Hon&#8217;ble Apex Court in case of Yallwwa &amp; Ors. Versus.<br \/>\n\tNational Insurance Company Ltd (2007 ACJ 1934) wherein the Hon&#8217;ble<br \/>\n\tApex Court has held that the statutory defence and the contentions<br \/>\n\traised by the Insurance Company are required to be considered and<br \/>\n\tdecided  by the  learned Tribunal at the time of deciding even an<br \/>\n\tapplication under Section 140 of the Act.\n<\/p>\n<p>In<br \/>\n\tlight of the judgment of Hon&#8217;ble Apex Court in Yallwwa &amp; Ors.<br \/>\n\tVersus. National Insurance Company Ltd (2007 ACJ 1934) , the legal<br \/>\n\tposition with regard to the application and claim under Section 140<br \/>\n\tof the Act and as regards the requirement of considering the defence<br \/>\n\tand objections of the Insurance Company is well settled and the<br \/>\n\tlearned Tribunal was required to address the defence raised by the<br \/>\n\topponent even while deciding the application under Section 140 of<br \/>\n\tthe Motor Vehicle Act, however, learned Tribunal has while passing<br \/>\n\tthe impugned order, not properly dealt with the defence and the<br \/>\n\tcontentions raised by the appellant.\n<\/p>\n<p>The<br \/>\n\tappellant is, in present case, justified in raising the contention<br \/>\n\tagainst the impugned award since the defence raised by the appellant<br \/>\n\thas not been addressed. Mr. MTM Hakim, learned advocate for the<br \/>\n\tdefendants have opposed the request of the appel\u00adlant, however,<br \/>\n\the has not been able to oppose the preposition urged by the<br \/>\n\tappellant.\n<\/p>\n<p>Having<br \/>\n\tregard to the the facts of the case and after examining the award,<br \/>\n\tit emerges that the objection raised by the appellant against the<br \/>\n\timpugned order, deserves to be accepted.\n<\/p>\n<p>Hence,<br \/>\n\t\ton this limited ground viz that the statutory defence and the<br \/>\n\t\tcontentions raised by the Insurance Company have not been properly<br \/>\n\t\taddressed while passing the order in application under Section 140<br \/>\n\t\tof the Act though they should have been dealt with by the learned<br \/>\n\t\tTribunal in view of the judgment of the Hon&#8217;ble Apex Court reported<br \/>\n\t\tin 2007 ACJ 1934, the appeal deserves to be allowed.\n<\/p>\n<p>If,<br \/>\n\t\thowever, appeal is admitted and retained for final hearing then it<br \/>\n\t\twill remain pending at least until the application under Section<br \/>\n\t\t166 of the Act is decided or it may result into delaying the<br \/>\n\t\tproceedings of the application under Section 166 of the Act.\n<\/p>\n<p>Hence,<br \/>\n\t\tit appears that it would be in the interest of both the contesting<br \/>\n\t\tparties that present appeal may be disposed of at this stage in<br \/>\n\t\tview of the judgment of the Apex Court. Without going into the<br \/>\n\t\tmerits of other contentions but by requiring the Insurance Company<br \/>\n\t\tto deposit the entire award amount, the cost and interest with the<br \/>\n\t\tlearned Tribunal.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tSunil B. Parikh, learned advocate for the appellant has submitted<br \/>\n\tthat pursuant to the order impugned in present appeal, the appellant<br \/>\n\thas already deposited a sum of Rs. 68,375\/- .\n<\/p>\n<p>Since<br \/>\n\tthe amount as per the impugned order has already been deposited, it<br \/>\n\tis directed, while setting aside the impugned order at this stage,<br \/>\n\tthat :\n<\/p>\n<p><span class=\"hidden_text\">(1)<\/span><\/p>\n<p>\tThe amount deposited by the appellant shall be invested by the<br \/>\n\tlearned Tribunal in a fixed deposit initially for a period of 3<br \/>\n\t(three) years.\n<\/p>\n<p>(2)The<br \/>\n\tinterest shall not be paid to the claimants but shall be<br \/>\n\taccumulated.\n<\/p>\n<p>(3)Opponents<br \/>\n\twill not be permitted to withdraw the deposited amount or a part<br \/>\n\tthereof and\/or to raise any loan or create any charge against the<br \/>\n\tsaid F.D. in any manner whatsoever.\n<\/p>\n<p><span class=\"hidden_text\">(4)<\/span><\/p>\n<p>\tThe learned Tribunal shall proceed to decide the main petition under<br \/>\n\tSection 166 of the Motor Vehicle Act expeditiously and shall<br \/>\n\tendeavour to decide the said application finally within period of 18<br \/>\n\tmonths from the receipt copy of writ of this order.\n<\/p>\n<p>(5)The<br \/>\n\tinterim award shall be subject to the final directions.\n<\/p>\n<p>(6)The<br \/>\n\tlearned Tribunal shall decide the main petition under Section 166 of<br \/>\n\tthe Act without being influenced by the impugned order passed under<br \/>\n\tSection 140 of the Act and\/or this order and particularly the fact<br \/>\n\tthat the  impugned order has been set aside at this stage.\n<\/p>\n<p>(7)Learned<br \/>\n\tTribunal shall decided the main petition independently on the basis<br \/>\n\tof the evidence, which may be brought on record by contesting<br \/>\n\tparties.
