SHAH\n\t\t\n\t\n\n \n\nDate\n: 16\/09\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\npetitioner Gujarat State Electricity Corporation Limited has<br \/>\npreferred the present Special Civil Application for an appropriate<br \/>\nwrit, direction or order quashing and setting aside the impugned<br \/>\njudgment and award dated 21.01.2010 passed by the learned Presiding<br \/>\nOfficer, Industrial Tribunal, Surat in Reference (IT) No.136\/1999, by<br \/>\nwhich the Tribunal has allowed the said reference directing the<br \/>\npetitioner to give all consequential benefits to the respondent of<br \/>\nSenior Assistant with effect from 07.07.1983.\n<\/p>\n<p>2.\tThe<br \/>\nbrief facts leading to the present Special Civil Application in<br \/>\nnut-shell are as under:\n<\/p>\n<p>2.1\tThat<br \/>\nrespondent was appointed as NMR workman as Junior Assistant, however,<br \/>\nright from day one, work of Senior Assistant was taken from him and<br \/>\ntherefore, he raised industrial dispute to give all benefits of<br \/>\nSenior Assistant to him with effect from 07.07.1983 and the said<br \/>\ndispute was referred to the Industrial Tribunal, Surat which was<br \/>\nnumbered as Reference (IT) No.136\/1999.  That it was specifically the<br \/>\ncase on behalf of the respondent that though he was appointed as<br \/>\nJunior Assistant on paper, however, work of Senior Assistant was<br \/>\ntaken from him right from very beginning and therefore, it was<br \/>\nsubmitted that he is entitled to all the benefits of Senior<br \/>\nAssistant.  It was also the case on behalf of the respondent that<br \/>\ntime and again even the concerned department under which he was<br \/>\nworking recommended the case of the respondent to the higher<br \/>\nauthority to give all benefits of Senior Assistant to the respondent<br \/>\nas in fact the respondent is performing all the duties of a Senior<br \/>\nAssistant.\n<\/p>\n<p>2.2\tThe<br \/>\nreference was resisted by the petitioner by submitting that as such<br \/>\nthe appointment of the respondent was on the post of Junior Assistant<br \/>\nand at the relevant time as there was a stay by the Court, he could<br \/>\nnot have been given appointment as a Senior Assistant.  It was<br \/>\nfurther case on behalf of the petitioner that as the post of Senior<br \/>\nAssistant is a promotional post and therefore also, the respondent<br \/>\ncannot be appointed and\/or promoted to the post of Senior Assistant<br \/>\nautomatically.\n<\/p>\n<p>2.3\tOn<br \/>\nappreciation of evidence and considering the deposition of the<br \/>\nwitnesses, more particularly, the witness namely Rajeshbhai M. Gamit,<br \/>\nDeputy General Manager, who was examined on behalf of the petitioner<br \/>\nat Exh.15, who specifically admitted that the respondent was<br \/>\nperforming duties as Senior Assistant right from the very beginning<br \/>\ni.e. 07.07.1983 and that he is entitled to benefits of Senior<br \/>\nAssistant right from 07.07.1983, the learned Tribunal by impugned<br \/>\njudgment and award allowed the said reference by directing the<br \/>\npetitioner to give all benefits to the respondent as a Senior<br \/>\nAssistant with effect from 07.07.1983.  Being aggrieved and<br \/>\ndissatisfied with the judgment and award passed by the Industrial<br \/>\nTribunal, petitioner has preferred the present Special Civil<br \/>\nApplication under Article 227 of the Constitution of India.  By way<br \/>\nCivil Application, petitioner wants to produce certain documents on<br \/>\nrecord which were admittedly not before the learned Tribunal.  By<br \/>\nadditional evidence, the petitioner wants to make out a new case and<br \/>\nsubmit that concerned department were already informed in 1998 that<br \/>\nthe respondent cannot be appointed as a Senior Assistant as the said<br \/>\npost is a promotional post.  Admittedly, the said documents are not<br \/>\nproduced on record before the Tribunal and the same are being<br \/>\nproduced for the first time before this Court, however, the same<br \/>\nshall be dealt with hereinafter.\n<\/p>\n<p>3.\tShri<br \/>\nPremal Joshi, learned advocate appearing on behalf of the petitioner<br \/>\nhas vehemently submitted that Industrial Tribunal has materially<br \/>\nerred in allowing the reference by directing the petitioner to give<br \/>\nall consequential benefits to the respondent of a Senior Assistant.<br \/>\nIt is submitted that the post of Senior Assistant is a promotional<br \/>\npost and therefore, the Tribunal ought not to have directed the<br \/>\npetitioner to consider and continue the respondent as a Senior<br \/>\nAssistant. It is further submitted that in fact due to the stay<br \/>\ngranted by the Civil Court, the respondent could not have been<br \/>\nappointed as a Senior Assistant and therefore also, the learned<br \/>\nTribunal has committed a grave error in directing the petitioner to<br \/>\ngrant all consequential benefits to the respondent of the post of<br \/>\nSenior Assistant.  Relying upon some documents produced along with<br \/>\nthe Civil Application and one communication of year 1983, Shri Joshi,<br \/>\nlearned advocate appearing on behalf of the petitioner has submitted<br \/>\nthat as such the higher authority had already communicated to the<br \/>\nconcerned department under which the respondent was working, that he<br \/>\ncannot be appointed on the post of Senior Assistant as the said post<br \/>\nis a promotional post.  Shri Joshi, learned advocate appearing on<br \/>\nbehalf of the petitioner has also submitted that even the dispute was<br \/>\nraised belatedly.  Therefore, it is requested to allow the present<br \/>\nSpecial Civil Application.\n<\/p>\n<p>4.\tHeard<br \/>\nShri Joshi, learned advocate appearing on behalf of the petitioner.<br \/>\nIt is true that respondent was appointed in the year 1983 as Junior<br \/>\nAssistant.  However, it is not in dispute and cannot be disputed and<br \/>\neven admitted in the cross-examination by the witness who was<br \/>\nexamined on behalf of the petitioner that right from the very<br \/>\nbeginning, the respondent was performing the duties as a Senior<br \/>\nAssistant and all throughout till date he was performing the duties<br \/>\nas a Senior Assistant.  In the cross-examination, it is specifically<br \/>\nadmitted by the said witness that respondent is entitled to all the<br \/>\nbenefits of Senior Assistant since 07.07.1983 i.e. from the inception<br \/>\nof his appointment.  It is also specifically admitted by the said<br \/>\nwitness that the case of the respondent was recommended to the higher<br \/>\nauthorities, however, there is no reply from the higher authority.<br \/>\nNow, by way of Civil Application, the petitioner wants to produce the<br \/>\ndocuments of 1998 to show that the higher authority has already<br \/>\ncommunicated to the concerned department rejecting the claim of the<br \/>\nrespondent on the post of Senior Assistant.  When in the<br \/>\ncross-examination, it was the specific case on behalf of the witness<br \/>\nwho was cross-examined on behalf of the petitioner that on<br \/>\nrecommendation, there was no reply by the higher authority how the<br \/>\npetitioner can be permitted to produce the documents which will be<br \/>\njust contrary to the deposition of the witness who was examined on<br \/>\nbehalf of the petitioner.  As stated herein above, the concerned<br \/>\nwitness of the Company had specifically stated that there was no<br \/>\nreply by the higher authority on the recommendation send by the<br \/>\ndepartment.  Be that as it may, the fact remains that and as admitted<br \/>\nby the witness who was examined on behalf of the petitioner Company<br \/>\nthat the respondent was performing the duties as a Senior Assistant<br \/>\nright from his first appointment dated 07.07.1983 and is entitled to<br \/>\nall the benefits of a Senior Assistant from 07.07.1983.  It is to be<br \/>\nnoted and it appears that because of the some order granted by the<br \/>\nCivil Court, the respondent was not actually appointed and\/or issued<br \/>\nthe appointment order as a Senior Assistant and was issued the<br \/>\nappointment order of a Junior Assistant though right from the<br \/>\nbeginning he was assigned the duties of a Senior Assistant and he<br \/>\nworked as a Senior Assistant.  Considering the aforesaid facts and<br \/>\ncircumstances, it cannot be said that the Tribunal has committed any<br \/>\nerror in directing the petitioner to grant all other benefits and<br \/>\nconsequential benefits to the respondent of the post of Senior<br \/>\nAssistant right from 07.07.1983 i.e. from the date on which he was<br \/>\nperforming the duties as a Senior Assistant, which calls for<br \/>\ninterference of this Court while exercising powers under Article 227<br \/>\nof the Constitution of India.\n<\/p>\n<p>\tNow,<br \/>\nso far as the contention on behalf of the petitioner that the dispute<br \/>\nwas raised belatedly is concerned, it is to be noted that when the<br \/>\nreference was made, the petitioner did not challenge the same.  Even<br \/>\notherwise even considering the evidence on record, the respondent was<br \/>\nagitating before the appropriate authority for considering his case<br \/>\nand granting the benefit of Senior Assistant and in fact as admitted<br \/>\nby the witness who was examined on behalf of the petitioner, the<br \/>\npetitioner was making demands before the department and in fact his<br \/>\ncase was even recommended by the department from time to time to the<br \/>\nhigher authority and there is an admission on the part of the<br \/>\npetitioner that respondent is entitled to the benefit of Senior<br \/>\nAssistant right from 07.07.1983.  Under the circumstances, even if<br \/>\nthere is a delay, it cannot defeat the rightful claim of the<br \/>\nrespondent which is even admitted by the company.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above and for the reasons stated above, petition deserves<br \/>\nto be dismissed and is, accordingly, dismissed.  So far as Civil<br \/>\nApplication is concerned, petitioner is permitted to produce on<br \/>\nrecord the Circular No.446 only, which was referred by the Industrial<br \/>\nTribunal and is not permitted to produce on record other documents<br \/>\nwhich were admittedly not before the Tribunal and if they are<br \/>\npermitted to brought on record, it is likely to cause serious<br \/>\nprejudice to the respondent and to get out of the cross-examination<br \/>\nof the concerned witness who was examined on behalf of the petitioner<br \/>\nand by which the petitioner wants to make out altogether a new case<br \/>\nof rejecting the claim of the respondent earlier, which was not the<br \/>\ncase of the petitioner before the Industrial Tribunal.
