Application<br \/>\nNo.1285 of 2005 while enlarging the applicant-accused on bail.\n<\/p>\n<p>\tLearned<br \/>\nAdvocate for the applicant has submitted that since 2005 applicant is<br \/>\ngetting his presence marked regularly with Police and case is<br \/>\ncommitted to the Court of Sessions and it would now result in<br \/>\nhardship and inconvenience to the applicant to get his mark presence<br \/>\nbefore the Police Station.       He, therefore, submitted that<br \/>\nCondition No.17 (iv) imposed vide order dated 25th July,<br \/>\n2005 passed in Criminal Misc. Application No.1285 of 2005 may kindly<br \/>\nbe deleted from the said order and applicant may be exempted from<br \/>\nmarking his presence before the concerned Police Station.\n<\/p>\n<p>\tLearned<br \/>\nAdvocate for the applicant has further submitted that Gujarat<br \/>\nUniversity has permitted applicant-accused to retire from his service<br \/>\nand therefore with a view to get his retiremental benefit, the<br \/>\napplicant will have to go to office of Gujarat University for<br \/>\nadministrative purpose.  He has submitted that unless the applicant<br \/>\nis not permitted to go to Office of Gujarat University, it will not<br \/>\nbe possible for him to expedite the things.  He has, therefore,<br \/>\nsubmitted that Condition No.17 (vi) imposed vide order dated 25th<br \/>\nJuly, 2005 passed in Criminal Misc. Application No.1285 of 2005 may<br \/>\nalso be deleted.\n<\/p>\n<p>\tHaving<br \/>\nconsidered the totality of the case and facts and circumstances<br \/>\nplaced before the Court and considering the fact that investigation<br \/>\nhas been over; charge-sheet has already been filed and case is also<br \/>\ncommitted to the Court of Sessions, present application is partly<br \/>\nallowed.  Condition No.17 (iv) imposed vide order dated 25th<br \/>\nJuly, 2005 passed in Criminal Misc. Application No.1285 of 2005 is<br \/>\nhereby deleted and applicant-accused is exempted from marking his<br \/>\npresence before the concerned Police Station.\n<\/p>\n<p>\tSo<br \/>\nfar as prayer for deletion of condition No.17 (vi) imposed vide order<br \/>\ndated 25th July, 2005 in Criminal Misc. Application<br \/>\nNo.1285 of 2005 is concerned, this Court is not inclined to delete<br \/>\nthe said condition because considering the nature of  allegation made<br \/>\nagainst the accused and the fact that investigation has been over,<br \/>\ncharge-sheet has been filed and departmental proceedings has been<br \/>\ninitiated against the applicant-accused in the office of Gujarat<br \/>\nUniversity, it will prejudice to the prosecution as well as to the<br \/>\ndepartmental proceedings because the applicant was enjoying high<br \/>\nprofile at relevant point of time.  In this fact situation, learned<br \/>\nAdvocate for the applicant does not press this application so far as<br \/>\nprayer for deletion of condition No.17 (vi) is concerned at this<br \/>\nstage.\n<\/p>\n<p>\tIt<br \/>\nis, however, clarified that rest of conditions imposed vide order<br \/>\ndated 25th July, 2005 passed in Criminal Misc. Application<br \/>\nNo.1285 of 2005 shall remain as it is.
