JUSTICE MOHIT S. SHAH)<\/p>\n<p>\t\tThis<br \/>\nappeal is directed against the judgment dated \t19.9.2008 in\tSpecial<br \/>\nCivil Application No.11712 of 2008 and the \torder dated\t23.10.2008<br \/>\npassed by the learned Single Judge in \tMisc.Civil\tApplication No.2733<br \/>\nof 2008, for review of the said \tjudgment.\tThe judgment dated<br \/>\n19.9.2008 was rendered by the \tlearned Single Judge in Special Civil<br \/>\nApplication, which was \tfiled \tby the respondent   wife complaining<br \/>\nabout the protracted cross \texamination of the wife\tin the<br \/>\nmaintenance application filed by \ther before the   Civil   Court   at<br \/>\n  Baroda  in  1995. The  learned       \tSingle Judge allowed the said<br \/>\nSpecial Civil Application and\tdirected that &#8211;\n<\/p>\n<p>&#8216;Under<br \/>\n\t\tany circumstances cross-examination of the wife shall be concluded<br \/>\n\t\tlatest by 30.9.2008. Respondent and his learned advocate shall<br \/>\n\t\trender full cooperation and ensure that above direction is<br \/>\n\t\tscrupulously complied with. Learned Judge is directed to ensure<br \/>\n\t\tthat there is no laxity in compliance with the directions. If need<br \/>\n\t\tbe learned Judge shall fix the proceedings for cross-examination of<br \/>\n\t\tthe wife on day to day basis. The Counsel for the petitioner<br \/>\n\t\tassures the Court the petitioner will make herself available in the<br \/>\n\t\tcross examination on the date that trial Court may fix. &#8216;<\/p>\n<p>The<br \/>\n\tpresent appellant thereafter filed the above numbered review<br \/>\n\tapplication, submitting that the cross examination was not yet<br \/>\n\tcompleted, as the appellant wanted to cross-examine the respondent<br \/>\n\twith reference to certain documents, which were earlier produced in<br \/>\n\tthe divorce suit filed by the appellant   husband against the<br \/>\n\trespondent   wife. The learned Singe Judge has dismissed the<br \/>\n\treview application, after observing that nothing was stated on<br \/>\n\trecord as to convince the Court, why cross examination should be<br \/>\n\tcarried on endlessly without termination, that the learned trial<br \/>\n\tJudge ought to have controlled the advocate of the appellant and<br \/>\n\tensured that only relevant questions were asked, so as to complete<br \/>\n\tthe cross examination, within a reasonable time. The learned Single<br \/>\n\tJudge also noted that after the order dated 19.9.2008, the appellant<br \/>\n\thad four full days to cross examine the respondent and there has to<br \/>\n\tbe strong materials from the record to demonstrate that even after<br \/>\n\tafter four full days, why cross examination could not be completed.<br \/>\n\tThe Court also noted that the appellant was offered short extension<br \/>\n\tto complete whatever cross examination the appellant may wish to<br \/>\n\tcarry out further. But, the appellant submitted that such short time<br \/>\n\twould not be sufficient and insisted that time be extended till<br \/>\n\t31.12.2008.\n<\/p>\n<p>The<br \/>\n\tlearned counsel for the appellant places reliance on the decision of<br \/>\n\tthe Apex Court in the case of  P.Ramachandra Rao V\/s. State of<br \/>\n\tKarnataka<br \/>\n\treported in  AIR 2002 SC 1856<br \/>\n\tin support of the submission that the learned Single Judge could not<br \/>\n\thave imposed a time limit, for completing cross examination.\n<\/p>\n<p>The<br \/>\n\tlearned counsel for the appellant submits that several other<br \/>\n\tproceedings are also pending between the same parties, and that the<br \/>\n\tappellant, who is a retired employee, has been paying maintenance to<br \/>\n\tthe respondent   wife to the tune of Rs.4500\/- per month, and<br \/>\n\ttherefore, there is no prejudice to the wife. The other proceedings<br \/>\n\tare also not being completed.\n<\/p>\n<p>\tIn<br \/>\n\tthe facts and circumstances of the case, we do not think that the<br \/>\n\tdiscretion exercised by the learned Single Judge was exercised in an<br \/>\n\tunreasonable manner. In any view of the matter, whatever grievances<br \/>\n\tthe appellant has against the interlocutory orders of the trial<br \/>\n\tCourt, the appellant may make a grievance against such interlocutory<br \/>\n\torders at the time of challenging the final decree or final order,<br \/>\n\tin case such final decree or final order is adverse to the<br \/>\n\tappellant.\n<\/p>\n<p>\tIn<br \/>\n\tthe facts and circumstances of the case, we do not find any reason<br \/>\n\tto interfere with the order of the learned Single Judge. The appeal<br \/>\n\tis, therefore, dismissed.\n<\/p>\n<p>While<br \/>\n\tdisposing of this appeal, we direct that if the appellant has<br \/>\n\tpreferred any proceedings against respondent regarding any property<br \/>\n\tof the appellant, we leave it open to the appellant to request the<br \/>\n\ttrial Court to hear and decide such suits\/applications<br \/>\n\texpeditiously, if such proceedings are pending for more than 7<br \/>\n\tyears.\n<\/p>\n<p>\tThe<br \/>\n\tCivil Application for stay also stands disposed of accordingly.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(MOHIT<br \/>\nS.
