Sarita Sinha, Daughter of Janardan Prasad\n    All of Mohalla Nai Basti Mahadewa, PS Siwan Muffasil, District Siwan ---- Petitioners\n                                                Versus\n                                   State Of Bihar --- Opposite Party\n                                               -----------\n<\/pre>\n<pre>2       28.7.2011                     Heard the parties.\n\n                                      The    petitioners        had    earlier      filed     a\n\n<\/pre>\n<p>                          case under Sections 323 and 324 of the Indian<\/p>\n<p>                          Penal Code.         The informant of the present case<\/p>\n<p>                          i.e. Siwan Muffasil PS Case No. 109 of 1996 is<\/p>\n<p>                          the tenant of the house of the petitioners.<\/p>\n<p>                          Apparently        there    is    a   dispute     between      them.<\/p>\n<p>                          The allegation in the First Information Report<\/p>\n<p>                          is that all the petitioners which includes the<\/p>\n<p>                          entire family entered into the lane leading to<\/p>\n<p>                          the     house     of   the      informant     and    threw        Acid<\/p>\n<p>                          through a window which seriously injured the<\/p>\n<p>                          son     and     daughter        of   the    informant.            The<\/p>\n<p>                          Investigating Officer in this case has retired<\/p>\n<p>                          and, therefore, the petitioners have filed an<\/p>\n<p>                          application under Section 310 of the Code of<\/p>\n<p>                          Criminal Procedure.             Section 310 of the Code of<\/p>\n<p>                          Criminal       Procedure        envisages     that     after      due<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>notice to the parties, the Court may order for<\/p>\n<p>inspection      of       any    place    when        an    offence       is<\/p>\n<p>alleged to have been committed, or any other<\/p>\n<p>place which it is in his opinion is necessary<\/p>\n<p>to     view,      for          the     purpose        of        properly<\/p>\n<p>appreciating the evidence given at such inquiry<\/p>\n<p>or trial.         It is further               provided         that the<\/p>\n<p>memorandum will be part of the proceedings.<\/p>\n<p>           Learned counsel appearing on behalf of<\/p>\n<p>the petitioners submits that it is not possible<\/p>\n<p>that at 9.30 p.m. in the night in the township<\/p>\n<p>of Siwan, persons will enter in such a manner<\/p>\n<p>and commit an offence of this nature.                              It is<\/p>\n<p>submitted that it is improbable that the Acid<\/p>\n<p>could have been thrown from the window in such<\/p>\n<p>a manner as to injure the son and daughter to<\/p>\n<p>such an extent.\n<\/p>\n<p>           Counsel        appearing          on   behalf          of     the<\/p>\n<p>opposite       party       submits       that        the       place      of<\/p>\n<p>occurrence      has      now     changed.            There      are     two<\/p>\n<p>options     for      the       Court,        either       to    give      an<\/p>\n<p>opportunity to the petitioners to exhibit the<\/p>\n<p>case    diary      which         indicates        the          place     of<\/p>\n<p>occurrence        or      the        Court     may        order        local<\/p>\n<p>inspection to determine whether it is probable<\/p>\n<p>that an occurrence could have been taken place<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>         in the manner it did, as it would be in the<\/p>\n<p>         interest of justice to determine this question.<\/p>\n<p>                   In the result, I direct that the Fast<\/p>\n<p>         Track Court No. I at Siwan (concerned Court) to<\/p>\n<p>         follow    either       process        suggested     above     in<\/p>\n<p>         Sessions Trial No. 6 of 2000.                    In case the<\/p>\n<p>         Court below orders local inspection, the date<\/p>\n<p>         may be fixed in presence of the person who is<\/p>\n<p>         to inspect and in presence of the parties.                    The<\/p>\n<p>         inspection       should    be     done     by    the    present<\/p>\n<p>         Officer       Incharge    of    the    Police     Station     who<\/p>\n<p>         would be in a better position to appreciate the<\/p>\n<p>         facts and record the place of occurrence in<\/p>\n<p>         this case.       The said inspection should be done<\/p>\n<p>         within a period of two months on receipt of a<\/p>\n<p>         copy     of     this     order.
