JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/11\/2011  \n \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships be pleased to admit this Special Civil Application;\n<\/p>\n<p>(B)\tYour<br \/>\nLordships further be pleased to issue a writ of mandamus or any other<br \/>\nappropriate writ, order or direction directing respondent no.1 t<br \/>\ndecide the petitioner&#8217;s Appeal No.525 of 2009 and if the respondent<br \/>\nno.1 has decided the same then the respondent no.1 may be directed to<br \/>\ndecide the appeal at the earliest and within some time frame as<br \/>\nthought fit by this Hon&#8217;ble Court in the facts and the circumstances<br \/>\nof this case and in the interest of justice; or in the alternative;\n<\/p>\n<p>(C)\tPending<br \/>\nadmission, hearing and final disposal of this petition, Your<br \/>\nLordships be pleased to direct respondents to maintain status quo<br \/>\nwith respect to the land survey no.1401, admeasuring 2 Hectares of<br \/>\nriver Bhogavo, Taluka: Limbdi, District: Surendranagar, till the<br \/>\npetitioner&#8217;s application dated 10.2.2005 is finally decided in<br \/>\naccordance with law in the peculiar facts and the circumstances of<br \/>\nthe case and in the interest of justice.\n<\/p>\n<p>2.\tThe<br \/>\ngrievance of the petitioner is that the appeal filed by him in the<br \/>\nmonth of September, 2009 before respondent No.1 has still not been<br \/>\ndecided.\n<\/p>\n<p>3.\tMs.\n<\/p>\n<p>Asmita Patel, learned Assistant Government Pleader states, under<br \/>\ninstructions, that the appeal shall be decided within a period of 8<br \/>\nweeks.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>P.J.
