It is<\/pre>\n<p>      submitted by the learned counsel for the petitioner that in spite of<br \/>\n      the orders\/recommendations of the Collector to that effect on the<br \/>\n      representation filed by the petitioner, the respondent No. 2 has<br \/>\n      not done so. It is submitted that the petition be disposed of with a<br \/>\n      direction to the respondent No. 2 to consider and decide the<br \/>\n      aforesaid representation.\n<\/p>\n<p>            In view of the aforesaid, without entering into the merits of<br \/>\n      the case the petition filed by the petitioner is disposed of with a<br \/>\n      direction to the respondent No. 2 to consider and decide the<br \/>\n      petitioner&#8217;s case duly taking into account the recommendations of<br \/>\n      the Collector, expeditiously preferably within a period of two<br \/>\n      months from the date of furnishing a copy of the order passed by<br \/>\n      this Court today along with a copy of the petition by the petitioner<br \/>\n      before the said authority.\n<\/p>\n<p>            With the aforesaid directions the petition filed by the<br \/>\n      petitioner stands disposed of.\n<\/p>\n<p>            C.C. as per rules.\n<\/p>\n<p>                                                         (R.S.Jha)<br \/>\n                                                           Judge<br \/>\nmct<br \/>\n                        W.P.No. 3938 \/ 2010<\/p>\n<p>        (Ram Manohar Tiwari .. v. ..State of MP &amp; others)<\/p>\n<p>07-05-2010<\/p>\n<p>Shri V.P.Nema, counsel for the petitioner.\n<\/p>\n<p>      The petitioner has filed this petition being aggrieved by the<br \/>\norder dated 3-10-2009 passed by the Divisional Forest Officer,<br \/>\nTikamgarh and the order dated 1-1-2010 passed in appeal by the<br \/>\nConservator of Forest, Chhatarpur.\n<\/p>\n<p>      The case of the petitioner before this court is tht the<br \/>\npetitioner who at the relevant time was posted as Forest Guard, in<br \/>\nthe   Sukoura    Range     was    allotted   Government     quarter.<br \/>\nSubsequently, he was given charge of a beat in Tikamgarh<br \/>\nRange. On 8-9-2009 a notice was issued to the petitioner asking<br \/>\nhim to vacate the quarter or to submit his explanation by<br \/>\n22-9-2009. As the petitioner failed to furnish his explanation by<br \/>\nthe aforesaid date, by orders dated 1-10-2009 and 3-10-2009 the<br \/>\nDivisional Forest Officer, Tikamgarh has directed recovery of<br \/>\npenal rent from November 2008 to October, 2009, i.e. a total sum<br \/>\nof Rs.16,000\/- from the petitioner. The appeal filed by the<br \/>\npetitioner has also been dismissed by Conservator of Forest,<br \/>\nChhatarpur by order dated 1-1-2010.\n<\/p>\n<p>      It is submitted by the learned counsel appearing for the<br \/>\npetitioner that the notice issued to the petitioner was received late<br \/>\nby him i.e. on 29-9-2009 and on receiving the same he has<br \/>\nimmediately submitted his reply but the respondent-authority<br \/>\n without considering the same has imposed the aforesaid minor<br \/>\npunishment of recovery on the petitioner and the contention of the<br \/>\npetitioner to this effect was also raised before the appellate<br \/>\nauthority in appeal but the same has also been mechanically<br \/>\nrejected.\n<\/p>\n<p>      From a perusal of the impugned order dated 3-10-2009 and<br \/>\nthe reply filed by the petitioner to the show cause notice, Ex.P-7,<br \/>\nit is apparent that the authority did not consider the reply filed by<br \/>\nthe petitioner to the show cause notice dated 1-1-2009 and,<br \/>\ntherefore, the reasons for occupation of the quarter as stated by<br \/>\nthe petitioner were not taken to the account by the said authority<br \/>\nwhile considering the matter. The petitioner is a Forest Guard and<br \/>\nhe has stated that he continued in occupation of the said quarter<br \/>\nbeing orally permitted to do so by the Divisional Forest Officer. In<br \/>\nsuch circumstances, it is apparent that the interest of justice<br \/>\nrequired the authority to consider the reply filed by the petitioner<br \/>\nbefore passing the order of punishment.\n<\/p>\n<p>      In the circumstances, without entering into the merits of the<br \/>\ncase the petition filed by the petitioner is disposed of by<br \/>\nremanding the matter back to the Divisional Forest Officer,<br \/>\nTikamgarh to take a fresh decision on the issue relating to the<br \/>\noccupation of the Government quarter by taking into the<br \/>\nconsideration the reply filed by the petitioner. The said exercise<br \/>\nbe completed by the authority as expeditiously as possible<br \/>\npreferably within a period of two months from the date the<br \/>\npetitioner furnishes a copy of the order passed by this Court today<br \/>\nalong with a copy of the petition before the concerned authority.
