{"id":68481,"date":"2010-05-10T00:00:00","date_gmt":"2010-05-09T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/vijay-kumar-singh-and-others-vs-the-state-of-u-p-through-on-10-may-2010"},"modified":"2016-02-25T20:03:50","modified_gmt":"2016-02-25T14:33:50","slug":"vijay-kumar-singh-and-others-vs-the-state-of-u-p-through-on-10-may-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/vijay-kumar-singh-and-others-vs-the-state-of-u-p-through-on-10-may-2010","title":{"rendered":"Vijay Kumar Singh And Others vs The State Of U.P.Through &#8230; on 10 May, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">Vijay Kumar Singh And Others vs The State Of U.P.Through &#8230; on 10 May, 2010<\/div>\n<pre>Court No. - 23\n\nCase :- SERVICE SINGLE No. - 2800 of 2010\n\nPetitioner :- Vijay Kumar Singh And Others\nRespondent :- The State Of U.P.Through Principal Secy.Home\nLucknow\nPetitioner Counsel :- Devi Prasad Singh\nRespondent Counsel :- C.S.C.\n\nHon'ble Devendra Kumar Arora,J.\n<\/pre>\n<p>By means of present writ petition, the petitioners are seeking a writ in<br \/>\nthe nature of certiorari for quashing of the transfer order dated<br \/>\n22.04.2010, passed by the Police Establishment Board contained in<br \/>\nAnnexure No. 1 to the writ petition.\n<\/p>\n<p>Submission of learned counsel for the petitioner is that orders of<br \/>\ntransfer are being passed in an arbitrary manner without adhering the<br \/>\npolicies made by the Government from time to time, that too without<br \/>\napplication of mind by a common order transferring various police<br \/>\npersonals from one place to another.\n<\/p>\n<p>Further submission is that the police personals are being transferred in<br \/>\nview of Government Order dated 11.07.1986. The said Government<br \/>\nOrder dated 11.07.1986 has been amended on 20.9.1987 and again it<br \/>\nwas modified on 25.03.1995. From 1995 to 2009 various orders of<br \/>\ntransfers were being passed on the basis of modified Government Order<br \/>\n25.03.1995, though in the year 2009 a dispute was raised that the<br \/>\nGovernment Order dated 25.03.1995 has not been issued by the<br \/>\ncompetent authority, and, therefore, that cannot be taken into<br \/>\nconsideration.\n<\/p>\n<p>Learned counsel for the petitioner submits that the Government Order<br \/>\ndated 19.02.2010 is discriminatory in view of the fact that it<br \/>\ndiscriminates the employees of the police department stating therein that<br \/>\nthe police personals who are under the securities of V.I.Ps like<br \/>\nMinisters and other persons, policy of transfer will not be applicable to<br \/>\nthem and they cannot be transferred in view of the government policy<br \/>\neither of 1996 or subsequent policies, issued by the government.\n<\/p>\n<p>                           This Court while considering similar controversy, pleased to pass the<br \/>\n                          following order on 07.5.2010 in Writ Petition No. 25016 of 2010,<br \/>\n                          <a href=\"\/doc\/121838\/\">Jagannath Prasad Gaur &amp; others vs. State of U.P. &amp; others<\/a>:<br \/>\nIn such circumstances, as there is no subjective satisfaction by the Board in view of the<br \/>\ndirections issued by the apex court as well as the Board has to take the decision first,<br \/>\ntherefore, in may opinion, in spite of the fact that this is a case of transfer of the<br \/>\ngovernment employee this Court interfere, if the action of the State appears to be<br \/>\narbitrary and without application of mind.\n<\/p>\n<p>In view of aforesaid facts, in my opinion, the petitioners are entitled for interim relief.<br \/>\nTill the next date of listing, the order of transfer against the petitioners shall remain<br \/>\nstayed.\n<\/p>\n<p>In such circumstances, as the controversy is such which has to be adjudicated upon<br \/>\nexchange of the counter and rejoinder affidavits, therefore, in my opinion, it will be<br \/>\nappropriate that an opportunity be given to the parties to exchange the affidavits for<br \/>\nthe purposes of adjudication of the matter on merits. The respondents are granted<br \/>\ntwo weeks&#8217; time to file a counter affidavit. Petitioners will have two weeks, thereafter,<br \/>\nto file a rejoinder affidavit.\n<\/p>\n<p>List after expiry of aforesaid period.\n<\/p>\n<p>I have considered the arguments of learned counsel for the parties and gone through the record<br \/>\nof the writ petition as well as the order passed by this Court in Writ Petition No. 25016 of 2010,<br \/>\n<a href=\"\/doc\/121838\/\">Jagannath Prasad Gaur &amp; others vs. State of U.P. &amp; others<\/a>.\n<\/p>\n<p>                          Learned Standing Counsel does not dispute the fact that the petitioner&#8217;s<br \/>\n                          case is identical to that of petitioners of Writ Petition No. 25016 of<br \/>\n                          2010.\n<\/p>\n<p>                          Since present petitioners are identically placed and, therefore,<br \/>\n                          proprietary demands that their interest should also be protected in the<br \/>\n                          similar manner. Apart from this, the impugned transfer order dated<br \/>\n                          22.04.2010 appears to be a result of non application of mind.<br \/>\n                          The transfer order dated 22.04.2010, as contained in Annexure No. 1 to<br \/>\n                          the writ petition, so far as it relates to the petitioners, is hereby stayed<br \/>\n                          till the next date of listing.\n<\/p>\n<p>                          Learned Standing Counsel may file counter affidavit within three<br \/>\n                          weeks&#8217;
