DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Learned APP, waives service of notice of Rule for respondent &#8211;<br \/>\nState.\n<\/p>\n<p>2.\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-276\/2010 with Vatva Police Station,  for the offences<br \/>\npunishable under Sections 365, 114 etc. of the Indian Penal Code.\n<\/p>\n<p>3.\tLearned<br \/>\ncounsel appearing for the applicants submits that considering the<br \/>\nnature of allegations, role attributed and the fact that Kiran son of<br \/>\nthe complainant was found within 2 \u00bd hours from a public place<br \/>\nand no other role is attributed, the applicants may be enlarged on<br \/>\nbail.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and looking to the fact and circumstances of the case, I am<br \/>\ninclined to enlarge the applicants on bail.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicants are ordered to be released on bail in connection<br \/>\nwith first information report registered at CR No.I-276\/2010 with<br \/>\nVatva Police Station, on executing bond of Rs.5,000\/- (Rupees Five<br \/>\nThousand only) each with one surety of the like amount to the<br \/>\nsatisfaction of the trial Court and subject to the conditions that<br \/>\nthey shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\ttheir passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\ttheir presence at Junagadh City &#8216;A&#8217; Division police station on the<br \/>\n\tfirst Sunday of every month between 10.00 a.m. and 3.00 p.m. till<br \/>\n\tthe trial commences;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of residences to the I.O. and also to the Court<br \/>\n\tat the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>7.\tThe<br \/>\nAuthorities will release the applicants only if they are not required<br \/>\nin connection with any other offence for the time being.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>10.\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicants on bail.\n<\/p>\n<p>11.\tRule<br \/>\nis made absolute to the aforesaid extent.
