JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/06\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;10)\tThe<br \/>\npetitioner, therefore, prays that this Hon&#8217;ble Court may be pleased<br \/>\nto issue a writ of mandamus or any other writ, order or direction:\n<\/p>\n<p>A)\tDirecting<br \/>\nthe Respondents to apply the judgment dt. 18.2.2010 passed in Special<br \/>\nCivil Application No.324 of 2010 and judgment dated 6.8.1999 passed<br \/>\nin Special Civil Application no.8181 of 1998 in the case of the<br \/>\npetitioner and grant 1st higher grade scale to the<br \/>\npetitioner from 21.1.1986 i.e after completion of 9 years of service<br \/>\nfrom the date of appointment with consequential benefits and revise<br \/>\nher retirement benefits.\n<\/p>\n<p>B)\tDuring<br \/>\nthe pendency and final disposal of this petition, the Respondents may<br \/>\nbe directed to grant the higher grade scale to the petitioner w.e.f.<br \/>\n21.1.1986 in light of the judgment dt.18.2.2010 passed in Special<br \/>\nCivil Application No.324 of 2010 and judgment dt. 6.8.1999 in Special<br \/>\nCivil Application no.8181 of 1998.\n<\/p>\n<p>C)\tTo<br \/>\ngrant such and further relief as may be deemed fit and proper.&#8221;\n<\/p>\n<p>2.\tHeard<br \/>\nMr. A.S. Supehia, learned counsel for the petitioner. It is submitted<br \/>\nby him that the petitioner has become entitled to the first higher<br \/>\ngrade scale with effect from 21.1.1986 i.e. after completion of nine<br \/>\nyears of service as Mukhya Sevika. However, no higher grade scale has<br \/>\nbeen granted to the petitioner though she has been promoted as Child<br \/>\nDevelopment Officer, vide order dated 21.5.1999. It is further<br \/>\ncontended by the learned counsel for the petitioner that in similar<br \/>\nsituations, similarly situated persons filed Special Civil<br \/>\nApplication No.8181\/1998, which was allowed by judgment dated<br \/>\n6.8.1999. The said judgment was subject matter of challenge in<br \/>\nLetters Patent Appeal No.663\/2000 and the appeal filed by the<br \/>\nrespondent department was rejected by order dated 28.1.2010 of the<br \/>\nDivision Bench.\n<\/p>\n<p>It is further urged that the other similarly situated persons have<br \/>\nalso filed Special Civil Application No.324\/2010 and allied matters,<br \/>\nwhich have been allowed by judgment dated 18.2.2010 of the learned<br \/>\nSingle Judge. The respondents have complied with the judgment of the<br \/>\nlearned Single Judge dated 18.2.2010 by passing order dated<br \/>\n30.10.2010. Hence,<br \/>\nas the case of the petitioner is similar, the same treatment ought to<br \/>\nbe meted out to her.\n<\/p>\n<p>3.\tAt<br \/>\nthis stage, the learned counsel for the petitioner states that<br \/>\nthe interest of justice would be met, if the petitioner is permitted<br \/>\nto make a representation to respondent No.1, within a period of two<br \/>\nweeks from today and the said respondent may be directed to consider<br \/>\nand decide the same, in the light of the judgments of this Court and<br \/>\nthe orders, passed in the case of similarly situated persons.\n<\/p>\n<p>4.\tUpon<br \/>\nthe above statement being made by the learned counsel for the<br \/>\npetitioner, the following order is passed :\n<\/p>\n<p>\tThe<br \/>\npetitioner shall make a representation to respondent No.1, within a<br \/>\nperiod of two weeks from today. In the<br \/>\nevent that the representation is made within the stipulated period of<br \/>\ntime, respondent No.1 shall consider and decide the same, in the<br \/>\nlight of the judgments of this Court in the cases of similarly<br \/>\nsituated persons, as also order dated 30.10.2010 passed in the case<br \/>\nof persons, whose cases are stated to be similar to that of the<br \/>\npetitioner.
