DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/03\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>In<br \/>\n\tthis matter, RULE was issued and the respondent has<br \/>\n\talready filed an Affidavit.\n<\/p>\n<p>A<br \/>\n\tcontention is raised by learned Senior Counsel Mr. N.D. Nanavaty<br \/>\n\tappearing for the petitioner that no detention order could have been<br \/>\n\tpassed terming the petitioner as a &#8216;Immoral Traffic Offender&#8217; as<br \/>\n\tdefined under Section 2(g) of the PASA Act since the petitioner is<br \/>\n\tnot a person who has habitually committed or abetted the offences<br \/>\n\tunder Suppression of Immoral<br \/>\n\tTraffic in Women and Girls Act, 1956.  In support of<br \/>\n\tthe above contention, reliance is placed on the decision of the<br \/>\n\tHon&#8217;ble Apex Court in the case of S.M.D. Kiran Pasha Vs.<br \/>\n\tGovernment of Andhra Pradesh reported in 1990<br \/>\n\t(1) SCC 328 as well as the other decisions of the Apex Court<br \/>\n\tas well as this Court including the circumstances in which the<br \/>\n\tpowers can be exercised by this Court at pre-execution of the order<br \/>\n\tof detention.   The affidavit filed by the respondent does not deal<br \/>\n\twith the specific contention raised by the petitioner.\n<\/p>\n<p>In<br \/>\n\tview of the above, I am inclined to grant stay of execution of the<br \/>\n\torder at this stage, keeping it open for the respondent to file an<br \/>\n\taffidavit with regard to the contention as raised above.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>(Anant<br \/>\nS.
