4. The suit is   seeking for<\/p>\n
possession–  ‘schedule property. In the<\/p>\n
schedule  the   is described as a house<\/p>\n

    __ South situated at Vidyaranyapuram<\/p>\n

 Itxsis contended by the plaintiff that Housing<\/p>\n
  has issued lease cum sale agreement dated<\/p>\n
a  2co.f:2.19s2 which is registered on 7.1.1983 in favour of<\/p>\n
the plaintiff and that he is paying installments in regard
\nto the said property. It is further pleaded that the<\/p>\n
defendant is related to the plaintiff, in order to <\/p>\n
the property, defendant raised a quarrel <\/p>\n
possession of the property. S0, pray  v. <\/p>\n
suit.\n<\/p>\n

 the  ‘it is contended that plaintiff is allotted.<\/p>\n

   and fraudulent, obtained by the plaintiff in<\/p>\n
collusion with the Karnataka Housing Board,<\/p>\n
Bangalore. The next contention taken by the <\/p>\n
is that the Court has no jurisdiction<\/p>\n

 siftrration, the reasoning of the learned trial<\/p>\n
Judge  Con account of the enhancing of the<\/p>\n
jnugrisdfiction of the Junior Division Courts, it has<\/p>\n
  ‘jurisdiction is improper. As on the date of the suit, the<\/p>\n
if  -\u00bbv-suit ought to have been instituted in a Court of Civil<\/p>\n
Judge, Senior Division. So, pray for allowing the<\/p>\n
appeal.\n<\/p>\n
12. It is resisted by the advocate for the <\/p>\n
supporting the \ufb01ndings of the learned  _<\/p>\n
the Courts.\n<\/p>\n
13. The first contention  <\/p>\n
for the defendant is that the-._defend_a’11t   got <\/p>\n
allotment but by playing  plaintiffltlhasylfggot the
\nallotment. This submiSi\u00e9\u00e9’io’nf._loses”it\u00a7;,,p signi\ufb01cance as the<\/p>\n
\ufb01nding’   speci\ufb01c performance is not
\ncha11enged\u00ab.’oy –the’:_ijdefe_:nd.a.:~1t and it has become final.<\/p>\n
One more circ_i1rn.sta.ia.ce”‘ to reject the submission is that<\/p>\n

14. The second ground of attadk is on the
\npecuniary jurisdiction. It is settled law that the
\njurisdiction of the Court as on the date of the decision of<\/p>\n
the case has to be taken. So, as on the date “the<\/p>\n
judgment, there is no dispute that the  <\/p>\n
Judge, Jr. Dvn. had jurisdiction. So, <\/p>\n
urged are rejected.\n<\/p>\n
15. Appeal is w1’thout.ar_1y niiexfilt’; irejecgted <\/p>\n
