SEWERAGE BOARD &amp; 3 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nSHAILESH C SHARMA for\nPetitioner(s) : 1, \nGOVERNMENT PLEADER for Respondent(s) : 1, \nNone\nfor Respondent(s) : 2 -\n4. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.K.RATHOD\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/08\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned Advocate Mr. SC Sharma for petitioner and Mr. AL Sharma,<br \/>\n\tlearned AGP appearing for respondent State Authority.\n<\/p>\n<p>In<br \/>\n\tthis petition, petitioner is praying for following reliefs as per<br \/>\n\tparagraph 9(B) and 9(C) of petition:\n<\/p>\n<p>&#8220;9(B)<br \/>\n\tYOUR LORDSHIPS  be pleased to issue writ of mandamus or any other<br \/>\n\tappropriate writ in nature of mandamus and issue a direction to<br \/>\n\trespondents to grant the seniority and promotion to the present<br \/>\n\tpetitioner on the post of Fitter as well as to grant the Higher Pay<br \/>\n\tScale of Rs.1200-2040 and different of revised pay scale in the<br \/>\n\tinterest of justice.\n<\/p>\n<p>(C)<br \/>\n\t\tYOUR LORDSHIPS  be pleased to grant the seniority and promotion to<br \/>\n\tthe present petitioner on the post of fitter as well as to grant the<br \/>\n\tHigher Pay Scale of Rs.1200-2040 and different of revised pay scale<br \/>\n\tas per the similar situated persons identical matter Special Civil<br \/>\n\tApplication No.12128 of 1994 and Special Civil Application No. 12129<br \/>\n\tto 12135 of 1994 and decided the claim of the petitioner by the<br \/>\n\trespondent board within a period of three months in the interest of<br \/>\n\tjustice.&#8221;\n<\/p>\n<p>\tThus,<br \/>\n\tpetitioner is claiming seniority as well as on that post promotion.<br \/>\n\tFor that, learned advocate Mr. Sharma for petitioner has relied upon<br \/>\n\tdecision of this Court given in Special Civil Application No. 612 of<br \/>\n\t1994 with SCA No. 12128 of 1994 with SCA No.12129 of 1994 to 12135<br \/>\n\tof 1994 dated 30.12.2004 which is at page 14.\n<\/p>\n<p>In<br \/>\n\tlight of these facts, considering prayers made by petitioner in this<br \/>\n\tpetition, let petitioner may make detailed representation to<br \/>\n\trespondent authority within one month from date of receipt of copy<br \/>\n\tof this order and also to supply copy of order of this court in<br \/>\n\tSpecial Civil Application No. 612 of 1994 with SCA No. 12128 of 1994<br \/>\n\twith SCA No.12129 of 1994 to 12135 of 1994 dated 30.12.2004 to<br \/>\n\trespondent authority along with representation that may be made by<br \/>\n\tpetitioner.\n<\/p>\n<p>As<br \/>\n\tand when such representation made by petitioner is received by<br \/>\n\trespondent authority along with decision of this court as referred<br \/>\n\tto above, it is directed to respondent authority to consider such<br \/>\n\trepresentation on the basis of decision of this Court in  Special<br \/>\n\tCivil Application No. 612 of 1994 with SCA No. 12128 of 1994 with<br \/>\n\tSCA No.12129 of 1994 to 12135 of 1994 dated 30.12.2004 and pass<br \/>\n\tappropriate reasoned order within three months from date of receipt<br \/>\n\tof representation from petitioner and then to communicate decision<br \/>\n\timmediately to petitioner.\n<\/p>\n<p>With<br \/>\n\tthese observations and directions, this petition is disposed of by<br \/>\n\tthis Court without expressing any opinion on merits.\n<\/p>\n<p>Direct<br \/>\n\tService is Permitted.\n<\/p>\n<p>(H.K.\n<\/p>\n<p>Rathod,J.)<\/p>\n<p>Vyas<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Fataji vs Gujarat on 30 August, 2011 Author: H.K.Rathod, Gujarat High Court Case Information System Print SCA\/12964\/2011 3\/ 3 ORDER IN THE HIGH COURT OF GUJARAT AT AHMEDABAD SPECIAL CIVIL APPLICATION No. 12964 of 2011 ========================================================= FATAJI TEJAJI THAKOR &#8211;
